HomeMy WebLinkAbout1979-03-29STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning & Zoning Commission of the City of Grapevine, Texas, met in Special Session on this the 29th day of March, 1979, at 7:00 P.M. with the following members present to -wit: Harlen Joyce Dwayne Rogers Bob Stewart Acting Chairman Member Member constituting a quorum with Robert Sands and Jerry Burgess, absent, with J. R. Baddaker, City Engineer in attendance. CALL TO ORDER The meeting was called to order by Mr. Joyce. PUBLIC HEARING - AMENDMENT PARKING REQUIREMENT ORDINANCE The first order of business was to open a Public Hearing concerning the effects of a new parking requirement recently approved by the City Council on apartment complexes that had not requested building permits, but had plans and financing in progress when the new require- ments were established. Mr. Willard Baker explained that he had a multi -phase project proposed on Timberline Drive in the vicinity of State Highway 157, which was affected quite seriously by the new parking requirement ordinance. He explained that he had submitted site plans to the City in November, 1978, and had received a letter from the City Staff stating that the plans met the requirements of the City Zoning Ordinance at that time. He then took this letter to his banker for financing of the project based on the number of units on the site plan, and the City's letter. He further explained that if the new requirement is enforced, it would jeapordize the feasibility of the project. Discussion followed, and it was brought to the attention of the Commission that there was one other developer in this situation: Mr. Ticknor with Ticknor Terrace with financing from Farmer's Home Administration. The jurisdiction of the Zoning Board of Adjustments was discussed as well as the duration of a building permit. A build- ing permit is valid for one year after issuance. The City Staff rec- ommended tht the new ordinance be amended such that the old parking ratio apply to multi -family projects where the developer could show construction financing committments prior to February 20, 1979 (the date the new ordinance was approved) and that building permits be acquired prior to June 1, 1979. Mr. Stewart made a motion that these circumstances be considered on a case by case basis byt he Planning & Zoning Commission. The mo- tion failed for lack of a second. Mr. Stewart then made a motion that the Zoning Board of Adjustments decide the merits of such cases. Motion failed for lack of a second. Mr. Rogers made a motion to recommend the City Staff's proposal to Council. Mr. Joyce seconded the motion. The motion prevailed by the following vote: Ayes: Rogers and Joyce Nays: Stewart Absent: Burgess and Sands Mr. Stewart asked that the City Staff research the legality of add- ing another restriction requiring a letter dated prior to February 20, 1979, from City Staff stating that the site plan met Zoning Ordinance requirements. Mr. Baddaker indicated he would discuss this with the City Attorney. PUBLIC HEARING - SIGN SETBACKS The next order of business was to open a Public Hearing concerning sign setbacks. There were no members of the general public to speak on this issue. Mr. Baddaker explained that five (5) out of (6) sign permits went to the Zoning Board of Adjustments and all were approved for setback variances. He explained that existing sign setback requirements eliminated parking spaces in the commer- cial developments. The Staff recommendation was to eliminate the 15 foot front setback requirement and substitute a traffic visi- bility requirement with no signs being permitted to cantilever or extend into the public R.O.W. Discussion followed as to who would determine the visibility factor. Mr. Stewart made a motion to recommend the Staff's proposal to City Council. Mr. Rogers seconded the motion and all in attendance voted aye.. ADJOURNMENT Mr. Rogers made a motion to adjourn, Mr. Stewart seconded the motion and all in attendance voted aye.
