No. 788, Tarrant County, Texas and being more fully described in Instrument No. D218272010 and Special Warranty Deed, Instrument No. D218233308 COUNTY OF TARRANT * 3030 Hall Johnson Road CITY OF GRAPEVINE * Tarrant County, Texas The undersigned Affiant, being a Code Compliance Official, and being duly sworn, on oath makes the following statements: There is in the City of Grapevine, Tarrant County, Texas the suspected premises located in 3030 Hall Johnson Road, a 0.934-acre tract of land out of the J.W. Haynes Survey, Ab. No. 788, Grapevine, Tarrant County, Texas and being more fully described in Instrument No. D218272010 and Special Warranty Deed, Instrument No. D218233308. The owner of record of said property is: Clifton F. McCollum, 3030 Hall Johnson Road, Grapevine, TX 76051. This is a vacant property with high weeds and grass, which states, that it is a violation to allow weeds and grass to grow to the height of six (6) inches in residential areas. Affiant has probable cause to believe that a fire or health hazard are present upon said premises, to wit: grass and or weeds that are more than six (6) inches in height on the property and which meets or exceeds city standards as per Subsection 12-111(a), Weeds, trash, brush and other unsightly matter, of the City of Grapevine's Code of Ordinances. Such belief is based upon a personal inspection of the property made by the Affiant within the past twenty- four (24) hours. Said inspection was made from public right-of-way or property adjoining the noted property. Said inspection revealed grass and weeds exceeding six (6) inches in height on the property areas as indicated by attached photos and or viewable portions of property by Affiant. Affiant request the Warrant for the purpose of allowing himself, along with other Code Enforcement, Grapevine Police personnel and Grapevine City contractors to inspect and remediate all the yard areas of the specified property to determine the presence of a nuisance of grass and weeds exceeding six (6) inches in height which are detrimental to the health and safety of a persons or property. Affiant will execute this warrant between the hours of 7:30 am and 4. 0 pm dAing the next three (3) days, exclusive of the day of issuance and the day of execution. GREETINGS: WHEREAS, the Affiant, whose signature is affixed to the Affidavit attached hereto, is a Code Enforcement Official, did this day subscribe and swear to said Affidavit before me (which said Affidavit is by this reference incorporated herein for all purposes); AND WHEREAS, I find that said Affidavit establishes the proper grounds for issuance of this warrant for the inspection of the specified premises to determine the presence of a fire or health or unsafe building condition or a violation of a fire, health, code or building regulation statute or ordinance; NOW THEREFORE, you are commanded, along with other Code Enforcement, Grapevine Police personnel and Grapevine City contractors to enter upon the named property located in 3030 Hall Johnson Road, a 0.934- acre tract of land out of the J.W. No. 788, Grapevine, Tarrant County, Texas and being more fully described in Instrument No. D218272010 and Special Warranty Deed, Instrument No. D218233308. and premises described in said Affidavit and there to conduct a search for the presence of a of a nuisance of grass and weeds exceeding six (6) inches in height which are detrimental to the health and safety of a persons or property; and remove (abate) said violations (i.e. mow the grass and/or weeds) pursuant to a lawful order issued pursuant to City Ordinances, Subsection 12-111(a), Weeds, trash, brush and other unsightly matter. HEREIN FAIL NOT, but have you then and there execute this warrant within three (3) days, exclusive of the day of its issuance and the day of its execution, with your return thereon. WAYLAND JUDGE, MUNICIPAL COURT CITY OF GRAPEVINE, TARRANT, DALLAS, & DENTON COUNTY TEXAS Case # 23-000299 RETURN Pursuant to Article 18.10 of the Texas Code of Criminal Procedure, I, James Adams, a Code Enforcement Officer for the City of Grapevine, inspected property located in the 3030 Hall Johnson Road, a 0.934-acre tract of land out of the J.W. Haynes Survey, Ab. No. 788, Grapevine, Tarrant County, Texas and being more fully described in Instrument No. D218272010 and Special Warranty Deed, Instrument No. D218233308 I conducted said inspection and warrant execution on this date May 25, 2023 at 8:05 am, under the authority of the attached Affidavit for Administrative Search Warrant and Administrative Search Warrant. Pursuant to said inspection. I found the following fire or health hazards or unsafe building conditions or violations of fire, health, or building regulations, statutes, or ordinances: High grass and or weeds over 6-inches in height that exceed city standards.
