TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA23-10 221 EAST WORTH STREET MEETING DATE: MONDAY, JUNE 5, 2023 BACKGROUND INFORMATION: The subject property is developed as a one-story, 2,625 square foot single-family detached residence with a 471 square foot detached garage (accessory structure) on a 17,261 square foot (0.396 acre) lot. The lot was developed in 1903 and is platted as Block 35, Lot 5a, City of Grapevine. The zoning district for the subject property at the time of development was “C-2”, Community Business District, and the property was rezoned to “R- 7.5”, Single-Family District in the 1984 City-wide Rezoning. On May 16, 2000, the Historic Preservation Commission (HPC) approved HL00-03 to designate 221 East Worth Street as a Historic Landmark Subdistrict. On February 25, 2009, the HPC approved CA09-07 to demolish an existing addition on the west end of the dwelling and construct a new addition containing a front porch, bathroom, mudroom and kitchen expansion with the condition that wood windows and doors be used and all exterior material and finishes be approved by Historic Preservation Staff. On April 15, 2013, the HPC approved CA13-36 for foundation demo and repair. On May 7, 2013, the HPC approved CA13-45 to extend an existing wood fence in the side yard to a deck and stain and seal deck. On November 15, 2019, the HPC approved CA19-116 to remove existing roof shingles and replace them with new Owens Corning Composition Shingle roof material, remove damaged vinyl siding and repair gutters. On February 24, 2023, the HPC approved CA23-15 to replace a white wood, picket fence and gate with fence of same material, design, and color. On May 24, 2023, the HPC approved CA23-18 to renovate and repurpose the original 471 square foot detached garage building located in the rear yard of the existing house for personal use. The application was submitted by Neal Cooper, Tin Barn, LLC, on behalf of the property owner. Agenda Item #12 BZA23-10.4 2 REQUEST: The applicant intends to renovate the existing 471 square foot historic detached garage and convert it to an accessory structure. The renovation includes constructing a new foundation, reframing, and a complete finish out of the interior. The area of the structure will not change. The structure is partially located on the adjacent property to their west and the applicant intends to shift the structure to the west property line within the required 6-foot side yard setback. BZA23-10 is a request for a special exception to allow the existing detached garage (accessory structure) to be located adjacent to the west property line within the required 6-foot side yard setback. The subject site does not meet the side yard requirement found in Subsection 15.G., Side Yard Requirements of Subsection 15.G, Area Regulations, of Section 15, “R-7.5”, Single Family District Regulations requires of the Zoning Ordinance that every lot have a minimum side yard setback of 6-feet. The existing detached garage (accessory structure) has a 6- foot encroachment into the required side yard setback. The following special exception is requested: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing detached garage (accessory structure) to be located adjacent to the west property line within the required 6- foot side yard setback. SPECIAL CONDITION: Staff finds that a special condition exists for the requested special exception. Specifically, the subject lot is an existing developed lot and the dwelling was built in 1903 prior to the rezoning of the property in the 1984 City-wide Rezoning to an “R-7.5”, Single-Family District. Currently and as proposed, the site is not compliant with Zoning Ordinance (82-73) relative to the required 6-foot side yard setback adjacent to the west property line. Due to the detached garage (accessory structure) being designated a historic landmark, the structure must remain as close to its original location within the 6-foot side yard setback on the west property line.
