PROJECT DESCRIPTION: BZA23-07 A, B, & C; Finn Residential, LLC – 518 E Texas, platted as College
Heights Addition, Block 104, Lot 5.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve
the remodeling and/or enlargement of a nonconforming use. Submitted BZA application for a special
exception (BZA23-07A) to allow the current dwelling to remain as developed with a 4-foot
encroachment into the required side yard setback and a building expansion along the south elevation.
Section 15.F.2, Density Requirements of Section R-7.5 Single Family District, requires a minimum lot
area of 7,500 square feet. A variance (BZA23-07B) for the minimum lot area to be 7,000 square feet.
Section 15.G.4, Area Regulations of Section R-7.5 Single Family District, requires a minimum lot with
of 65 feet. A variance (BZA23-07C) for the minimum lot width to be 50 feet.
PLANNING SERVICES
All Sheets:
1. Remove all sheets but the plot plan, existing and proposed floor plans for the dwelling and
detached garage. Elevations, electrical, roofing, etc. are not needed for the BZA’s purposes.
2. Remove signature block from the plot plan and floor plans.
3. Add the purpose statement the plot plan and floor plans, “ The purpose of BZA23-07A is for
a special exception to allow the current dwelling to remain as developed with a 4-foot
encroachment into the required side yard setback and a building expansion along the south
elevation; BZA23-07B is a variance from the minimum lot area to be 50 feet.”
Plot Plan:
1. Title block: remove “Site Plan/Floor Plan/Façade Plan.”
2. Title block: do not write in the plan type of Plot Plan. This should be typed or not in marker
that has blead through.

3. Title block: Add the case number, BZA23-07A, B, and C in proximity to the title block.
4. Remove the signature/approval block.
5. Add the purpose statement on the plot plan drawing, “ The purpose of BZA23-07A is for a
special exception to allow the current dwelling to remain as developed with a 4-foot
encroachment into the required side yard setback and a building expansion along the south
elevation; BZA23-07B is a variance from the minimum lot area to be 7,000 square feet; and

6. Plot Plan drawing: dimension the rear yard setback from the existing southern elevation to
the rear property line and the proposed building addition’s new southern elevation to the
rear property line. The required rear yard setback in the R-7.5, Single-family District is 25
feet.

Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant is requesting a special exception (BZA23-07A) to allow the current dwelling to
remain as developed with an encroachment into the required side yard setback and a building
expansion along the west elevation. The request is for the following variance (BZA23-07B) to the
Grapevine Comprehensive Zoning Ordinance 82-73: Subsection 15.F.2, Minimum Lot Area, of
Subsection 15, “R-7.5”, Single Family Residential District, which requires that every lot have a
minimum lot size of 7,500 square feet. The existing lot has a lot area of 7,000 square feet. The
request is for the following variance (BZA23-07C) to the Grapevine Comprehensive Zoning
Ordinance 82-73: Subsection 15.G.4., Minimum Lot Width, of Section 15, “R-7.5”, Single Family
Residential District, which requires that every lot have a minimum lot width of 65 feet. The lot has an

07B and #BZA23-07C

MEETING DATE: MONDAY, JUNE 5, 2023
BACKGROUND INFORMATION:
The subject property is platted as College Heights Addition, Block 104, Lot 5 and zoned “R-
7.5”, Single-Family Residential District. Lot 5 has frontage on East Texas Street and a
partially improved alley and is developed with a one-story, 1,478 square foot single-family
detached residence constructed in 1952 on a 7,000 square foot (0.161 acre) lot. The
College Heights Addition plat was filed in 1921.
The subject property was zoned “R-3”, Multiple-Family Dwelling District prior to the 1984
City-wide Rezoning at which time it was rezoned to “R-7.5”, Single-Family District.
The application was submitted by John Finn, Finn Residential, LLC, contractor.
REQUEST:
The applicant intends to utilize the existing single-family dwelling and proposes an
expansion along the west, south and east elevations. The existing dwelling has an
approximately 2-foot encroachment into the required minimum 6-foot setback to the west
property line. The proposed expansion along the west elevation would be in-line with the
existing side-yard setback of approximately 4-feet, 2-inches.
The property is an existing platted lot, Lot 5, Block 104 of the College Heights Addition.
Subsection 15.F.2, Minimum Lot Area, of Subsection 15, “R-7.5”, Single Family Residential
District of the Zoning Ordinance, requires that every lot have a minimum lot size of 7,500
square feet. The existing lot has an area of 7,000 square feet. A variance is needed to
reduce the required minimum lot area from 7,500 square feet to 7,000 square feet.
Subsection 15.G.4., Minimum Lot Width, of Section 15, “R-7.5”, Single Family Residential
District of the Zoning Ordinance, requires that every lot have a minimum lot width of 65 feet.
The existing lot has a width of 50 feet. A variance is needed to reduce the required
minimum lot width from 65 feet to 50 feet.
As part of the requested expansion to the existing dwelling the property owner is also
proposing to construct a detached two-car garage that will meet all required yard setbacks
for an accessory building.

The following special exception is requested for BZA23-07A:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential dwelling to
remain as developed, with a 2-foot encroachment into the west elevation’s side yard
setback. Additionally, the proposed dwelling expansion along the west elevation would be
in-line with the existing side-yard setback of approximately 4-feet, 2-inches.
The following variance is requested for BZA23-07B:
Subsection 15.F.2, Minimum Lot Area, of Subsection 15, “R-7.5”, Single Family
Residential District, requires a minimum lot area of 7,000 square feet. A variance of
approximately 500 square feet is requested for the existing lot area which is 7,000 square
feet on Lot 5 as shown on the plot plan and final plat.
The following variance is requested for BZA23-07C:
Subsection 15.G.4., Minimum Lot Width, of Section 15, “R-7.5”, Single Family
Residential District, which requires that every lot have a minimum lot width of 65
feet. A variance of approximately 15 feet is requested for the existing lot width which is 50
feet on Lot 5 as shown on the plot plan and final plat.
SPECIAL CONDITION:
Staff finds that special conditions exist for the requested special exception and variances.
Specifically, the existing single-family dwelling was built in 1952 prior to adoption of the
City’s first zoning ordinance and the 1984 City-wide Rezoning to “R-7.5”, Single Family
Residential District. The College Heights Addition plat in which the lot is located was also
filed in 1921 showing multiple 50-foot-wide lots along Washam Avenue, currently known as
East Texas Street. Currently and as platted, Lot 5 is not compliant with Zoning Ordinance
82-73 relative to the required minimum lot area and lot width. The existing residential
dwelling is not compliant with Zoning Ordinance 82-73 relative to building placement within
the required side-yard setback for the west elevation. Developed, platted property and
right-of-way exist adjacent to the subject site, on the north, south, east, and west property
lines eliminating the possibility to expand Lot 5 to meet minimum lot area and width
requirements.
The proposed residential dwelling expansion does not exacerbate the existing side-yard
setback adjacent to the west property line, nor does it affect the existing lot area or lot
width. The applicant understands that any future additions would have to comply with the
requirements of the Zoning Ordinance 82-73.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment:
1. Approve a special exception (BZA23-07A) to the Grapevine Comprehensive Zoning
Ordinance 82-73, Section 43.E.3, Nonconforming Uses and Structures to allow a
special exception for the existing residential dwelling to remain as developed, with a
2-foot encroachment into the west elevation’s side yard setback; and
2. Approve a variance (BZA23-07B) to the Grapevine Comprehensive Zoning
Ordinance 82-73, Subsection 15.F.2, Minimum Lot Area, of Subsection 15, “R-7.5”,
Single Family Residential District to allow for a reduction in the minimum lot area of
500 square feet as shown on the plot plan and final plat; and
3. Approve a variance (BZA23-07C) to the Grapevine Comprehensive Zoning
Ordinance 82-73, Subsection 15.G.4., Minimum Lot Width of Section “R-7.5”, Single-
Family District to allow for a reduction in the minimum lot width of 15 feet as shown
on the plot plan and final plat.
