PROJECT DESCRIPTION: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. Submitted BZA application for a special exception to allow the existing residential dwelling and its accessory buildings to remain as developed, with a 2-foot encroachment into the side yard setback for a detached garage and to allow vehicle parking in the required front yard on Lot 1A (BZA23-04A); and a variance to allow a 10- foot reduction in the lot depth requirement for Lot 1B (BZA23-04B). This case will be heard by BZA at their June 5 meeting if all comments are sufficiently addressed prior to notification deadlines. PLANNING SERVICES Provide Floor plan/plan view of the proposed dwelling on Lot 1B. We mainly need to se where the garage is located. Plot Plan: 1. Add the site data table per the checklist. See format below under Comment No. 8. 2. Add a title block per the checklist. a. Ensure the case numbers , BZA23-04A and BZA23-04B are within the title block. b. Ensure the proposed zoning is labeled as “Proposed Zone: R-7.5, Single-Family District” within the title block 3. Add the following purpose statement to the plot plan sheet: a. The purpose of BZA23-04A is for a special exceptions to allow t he existing residential dwelling and its accessory buildings to remain as developed, with a 2-foot encroachment into the side yard setback for a detached garage and to allow vehicle parking in the required front yard on Lot 1A (BZA23-04A); and the purpose of BZA23-04B is for a variance and a variance to allow a 10-foot reduction in the lot depth requirement for Lot 1B (BZA23-04B). 4. Add the following standard plot plan notes: BZA23-04 APRIL 12, 2023 THE WYKES GROUP 226 NORTH LUCAS DRIVE LOTS 1A AND 1B, BLOCK 2, W.C. LUCAS ADDITION BZA23-04.1 2 1. Mechanical and electrical equipment including air conditioning units, shall be designed, installed and operated to minimize noise impact on surrounding property. All such equipment shall be screened from public view. 2. All requirements of the City of Grapevine soil erosion control ordinance shall be met during the period of construction. 5. Will you be replatting the property? If not, leave building lines as shown per the approved 1967 plat. The front building lines on both lots need to be amended – shown and labeled as 30 feet. 6. On Lot 1A: a. Dimension the distance between the face of the detached garage and the property line along Worthington Drive on the plot plan b. Dimension the distance between the most southern storage building from the southern property line. c. Label and provide interior dimensions of the carport attached (west elevation) to the detached garage. d. Label and provide interior dimensions of the attached structure on the south elevation of the detached garage. e. L abel total lot 1A area on the plot plan drawing. f. Label the total building area on Lot 1A the plot plan drawing. 7. On Lot 1B: a. Does this proposed structure have a garage? If so, dimension the distance between the face of the garage and the 25-foot building line. b. Label the 30-foot building line. c. Provide the dimensions of width and depth for the “cut-out” portion on the west side of the proposed dwelling. d. Show relocation of drive approach off of Worthington Drive to line up with required parking pad out of required front yard or towards proposed garage. e. Label total lot area on Lot 1B on the plot plan drawing. f. Label the total building area for Lot 1B on the plot plan drawing. g. Label the proposed dwelling as “proposed.” h. This case will be recommended for approval with a condition that the existing storage/garage building be demolished. 8. TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA23-04A and #BZA23-04B 226 NORTH LUCAS DRIVE MEETING DATE: MONDAY, JUNE 5, 2023 BACKGROUND INFORMATION: The City Council at their May 16, 2023 meeting approved the first reading of an ordinance, zone change request Z23-04 to allow 0.512 acre of land to be rezoned from “CC”, Community Commercial District to “R-7.5”, Single-Family District. The applicant intends to keep the existing single-family residence on Lot 1A and to develop a new, single-family residence on Lot 1B. The plat of Block 2, Lots 1A and 1B, W.C. Lucas Addition was filed in 1967. The subject property consists of two lots, 1A and 1B. Lot 1A has frontage on both Lucas Drive and Worthington Drive and is developed with a one-story, 1,958 square foot single- family detached residence constructed in 1955 on a 13,500 square foot (0.309 acre) property. Lot 1A also features an approximately 891 square foot detached garage and carport and a 96 square foot shed. Lot 1B has frontage only along Worthington Drive, is approximately 8,820 square feet (0.203 acre) in size, and currently features an approximately 800-square-foot detached storage building. Lots 1A and 1B have historically been treated as one parcel for property tax purposes as one owner has retained ownership of both lots. The existing single-family residence on Lot 1A was constructed the same year as the City’s first zoning ordinance was adopted, August 2, 1955. On July 15, 1980, City Council approved zone change request Z1980-32 (Ord. 80-40) for the property from “R-2”, Two- Family Dwelling to “C-2”, Community Business District. The zoning case file from 1980 states it was the intent of the property owner to relocate his carpet business to the property. During the 1984 City-wide Rezoning, the property was rezoned from “C-2”, Community Business District to the “CC”, Community Commercial District. The application was submitted by Sue Wykes, The Wykes Group., the representative for the property owner David Joel Smith. REQUEST: The applicant intends to utilize the existing single-family residence on Lot 1A and construct a new single-family residence on Lot 1B. Agenda Item #8 BZA23-04.4A & B 2 The following special exception is requested for BZA23-04A: Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing residential dwelling and its accessory buildings to remain as developed, with a 2-foot encroachment into the side yard setback for a detached garage, a 2-foot encroachment into the required side yard setback for a shed, and to allow vehicle parking in the required front yard along Worthington Drive for the detached garage on Lot 1A as shown on the plot plan. The following variance is requested for BZA23-04B: Subsection 15.G.5, Area Regulations of Section “R-7.5”, Single Family District, requires a minimum lot depth of 100 feet. A variance of approximately 10 feet is requested for the existing lot depth which is 90 feet on Lot 1B as shown on the plot plan and final plat. SPECIAL CONDITION: Staff finds that special conditions exist for the requested special exception and variance. Specifically, the existing single-family dwelling was built in 1955 prior to the platting of the property in 1967 and subsequent rezoning before and during the 1984 City-wide Rezoning to “CC”, Community Commercial District. Currently and as platted, Lot 1B is not compliant with Zoning Ordinance 82-73 relative to the required minimum lot depth. Developed, platted property and right-of-way exist adjacent to the subject site, on the north, south, east, and west property lines eliminating the possibility to expand Lot 1B to meet minimum lot depth requirements. Currently and as proposed, Lot 1A is not compliant with Zoning Ordinance 82-73 relative to a 2-foot encroachment into the side yard setback for a detached garage, a 2-foot encroachment into the required side yard setback for a storage shed, and to allow vehicle parking in the required front yard for the detached garage facing Worthington as the improvements exist today. The proposed rezoning of the property does not exacerbate the existing lot depth for Lot 1B, nor the side yard setbacks adjacent to the east and south property lines for accessory structures, and parking in the front yard for Lot 1A. The applicant understands that any future additions would have to comply with the requirements of the Zoning Ordinance 82- 73. RECOMMENDATION: Staff recommends the Board of Zoning Adjustment: 1. Approve a special exception (BZA23-04A; Lot 1A) to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3, Nonconforming Uses and Structures to allow a special exception for the existing residential dwelling and its accessory buildings to remain as developed, with a 2-foot encroachment into the side yard setback for a detached garage, a 2-foot encroachment into the required side yard setback for a shed, and to allow vehicle parking in the required front yard for the Agenda Item #8 BZA23-04.4A & B 3 detached garage facing Worthington Drive on Lot 1A as shown on the plot plan; and 2.
