Purpose of Request:
The request, BZA23-08, is for the following special exception to the Grapevine
Comprehensive Zoning Ordinance 82-73: Subsection 16.G.5, Area Regulations, of
Section 16, “R-5.0”, Zero-Lot-Line District, which requires that every lot have a depth of
100 feet. The existing Lot 4 has a lot depth of 82 feet and the variance is to reduce the
required minimum lot depth from 100 feet to 82 feet.

PROJECT DESCRIPTION: Section 16.G.5, Area Regulations of Section R-5.0, Zero Lot Line District,
requires a minimum lot depth of 100 feet. A variance for the minimum lot depth to be 82 feet.
PLANNING SERVICES
1. Add the following purpose statement to say: “The purpose of BZA23-0 8 is a request for
a variance to Subsection 16.G.5., Minimum Lot Depth, of Section 16, “R-5.0”, Zero-Lot-
Line District of the Zoning Ordinance, which requires that every lot have a minimum lot
depth of 100 feet. The existing lot has a depth of 82 feet. A variance is needed to
reduce the required minimum lot depth from 100 feet to 82 feet.”
2. Add BZA23-08 to the Title Block as… Zoning Exhibit For Z23-06 and BZA23-08.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA23-08

BACKGROUND INFORMATION:
The City Council at their May 16, 2023 meeting approved the first reading of an ordinance,
zone change request Z23-04 to allow 0.131 acre of land to be rezoned from “R-MF-1”,
Multifamily District to “R-5.0”, Zero-Lot-Line District. The applicant intends to construct a
single-family residence on the lot.
The subject site was originally platted in 1949 and initially zoned “R-1”, Single-Family
Dwelling District prior to the 1984 City-wide Rezoning at which time the subject site was
rezoned to “R-MF-1” Multifamily District. The “R-MF-1” Multifamily District zoning on the
subject site rendered the site and use legal non-conforming (vested), however the removal
of the dwelling (dangerous structure) has resulted in the loss of the legal non-conforming
status.
Code Enforcement received complaints commencing in October 2015, about a structure on
the subject site which was designated by Code Enforcement as an open and vacant
structure. In January 2022, the structure was declared a dangerous building and the
property owner voluntarily demolished the structure in March 2022. The subject site has
remained vacant. The application was submitted by Cheyenne Haddad for property owner
Shadi Mansour.
REQUEST:
The applicant is requesting a variance to construct a new single-family residence on the
subject site.
The subject site does not meet the lot depth requirement found in Subsection 16.G.5, Lot
Depth Requirements of Subsection 16.G.5, Area Regulations, of Section 16, “R-5.0”, Zero-
Lot-Line District Regulations requires of the Zoning Ordinance that every lot have a
minimum lot depth of 100-feet. The subject site has an existing lot depth of 82-feet.
SPECIAL CONDITION:
Staff finds a special condition exists for the variance request. Specifically, the subject site
was platted prior the 100-foot lot depth requirement in the 1984 City-Wide Rezoning to the
“R-MF-1”, Multifamily District.

RECOMMENDATION:
City Council at their May 16, 2023 meeting approved the first reading of an ordinance, zone
change request Z23-04 on the subject site, therefore staff recommends the Board of
Zoning Adjustment approve a variance to the Grapevine Comprehensive Zoning
Ordinance 82-73, Subsection 16.G.5, Area Regulations of Section “R-5.0”, Zero-Lot-Line
District to allow for a reduction in the minimum lot depth of 18 feet as shown on the plot
plan and plat for property located at 218 West Peach Street, platted as Lot 4, The Ellis
Subdivision.
