HomeMy WebLinkAboutItem 09 - Parks and Recreation BoardMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: JULY 18, 2023 SUBJECT: AMEND PARKS AND RECREATION BOARD MEMBERSHIP RECOMMENDATION: City Council to consider an ordinance to amend the Grapevine Code of Ordinances, Chapter 16 Parks and Recreation to add a position to allow for an additional student ex-officio member to the Parks and Recreation Board, and take any necessary action. FUNDING SOURCE: BACKGROUND: Currently, Chapter 16 of the City Code allows for a Parks and Recreation Board ex-officio member to be a high school student and Grapevine resident. Since both Grapevine High School and Colleyville Heritage High School serve the City of Grapevine, staff proposes adding a second ex-officio member position to allow two high school students to serve on the Board. These appointments will be recommended to City Council from the Parks and Recreation Director for approval during the regular Board and Commission appointment process each summer. ORDINANCE NO. 2023-036 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 16 PARKS AND RECREATION RELATIVE TO THE STUDENT EX-OFFICIO MEMBER OF THE PARKS AND RECREATION BOARD; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council adopted Ordinance No. 2005-042 on June 7, 2005 to create a position for high school age students to provide input on activities and facilities of the Parks and Recreation Department; and WHEREAS, the Parks and Recreation Board and City staff have determined that since there are two high schools in the Grapevine-Colleyville Independent School District, it would be appropriate to provide the opportunity for both schools to have a Student Ex- Officio Member on the Parks and Recreation Board, if so desired; and WHEREAS, all constitutional and statutory prerequisites for the approval of this Ordinance have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That Section 16-2 of the Grapevine Code of Ordinances is hereby amended by amending paragraph five to read as follows: "There is hereby created that a minimum of one, and no more than two, of the ex- officio members of the board shall be a high school student and shall be Grapevine resident. The student(s) shall be approved by City Council at the recommendation of the Parks and Recreation Director. The appointment of the ex-officio member(s) shall be for a minimum of one year and a maximum of two years." Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Five Hundred Dollars ($500.00) for each offense and a separate offense shall be deemed committed each day during or on which an offense occurs or continues. Section 4. All ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect. Section 5. If any section, subsection, sentence, clause or phrase of this ordinance shall for any reason be held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates undesirable conditions for the preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it is accordingly so ordained.
