The site contains I y�so approximately 3.90 acres and has approximately T _ 599.47 feet of frontage along West Grapevine Mills Glade Rd. d 1 Circle. 3 REQUESTED CONDITIONAL USE REQUEST, PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a conditional use permit to establish an outdoor commercial amusement and a planned development overlay to include but not be limited to the deviation from the front yard landscape setback area for the development of a miniature railroad and miniature botanicals exhibit. The applicant intends to develop a miniature railroad exhibit and miniature botanical and bonsai garden. The development will utilize an approximate 18,226 square foot building featuring an open air trainscape exhibit, retail store, event room and interactive children play area. The miniature botanicals will be displayed outdoors incorporating numerous plants and new hardscape features in addition to utilizing existing vegetation of the subject site. Total parking provided is 120; 113 are required. Please see the attached letter for a detailed description of the proposed use. 0:\ZCLl\CLl13-20.4&PD13-01.4 1 October 7,2013(5:05PM) The planned development overlay is necessary for the applicant to develop the site as intended relative to the following: • Area requirements relative to front yard: the ordinance requires a minimum front yard of not less than twenty-five(25)feet to be utilized as a landscape setback area with no portion of the area to be paved; the applicant proposes utilizing approximately fifteen (15)feet of the landscape setback area for paving and vehicle use areas and if approved would allow a front yard setback of ten (10) feet. The applicant asserts that the planned development overlay request is necessary due to an existing sixty (60) foot overhead electrical easement, steep contours on the subject site and thirteen (13)feet of right-of-way along West Grapevine Mills Circle from the curb to the property line. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject property was zoned 1-1" Light Industrial District prior to the 1984 City Rezoning. In 1984 the City changed the zoning designation for the site to "PID" Planned Industrial Development. The property was then rezoned in 1985 as a part of the "Terra Tract'to "R-MF-2" Multi-Family District(Z85-60, Ord. 85-60) however the property was not developed. In October 1995, the site was part of a zoning request (Case No. Z95-06) whose purpose was to amend, revise, eliminate or terminate portions of the deed restrictions and the letter of agreement as adopted in Ordinance No. 85-60, and rezone portions of the site. At the September 7, 1999 meeting, City Council approved Z99-05 (Ord. 99-124) rezoning the subject site from "R-MF-2" Multi-Family District to "CC Community Commercial District. At the November 16, 2004 meeting, Council approved a rezoning of approximately 8.69 acres of property to the south of the subject site from "CC"Community Commercial District to"R-MF-1"for a proposed multifamily/condominium project. This same property was later rezoned at the February 21, 2006 (Z06-02) to "R-TH" Townhouse District for the development of a 39 unit townhouse development. A planned development overlay(PD06- 01)was also used relative to access to the public right-of-way, minimum lot width and size, front, rear, and side yard setbacks, maximum building coverage and maximum impervious area. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi-family apartments, motels, office buildings, movie theaters, restaurants, and personal and business services. Single-family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. Microland America is an exciting and innovative entertainment venue designed to bolster and lift the current businesses of Grapevine while inspiring and capturing family togetherness and community unity. This entertainment venue will significantly add to the city's tourism venue sales while strengthening the community bond.This unity will be gained through the celebration of exhibits featuring a miniature replica of the city of Grapevine in the 1800's along with many of our national parks, sculpted from natural stone; its breath taking beauty will keep patrons coming back.The main trains will be modeled after our very own Grapevine Vintage Railway trains.Through masters and experts in the industry,we will help to further educate visitors on historical and environmental legends as well as engage families in active hobbies and learning programs. The venue will operate from gam to 9pm, 6 days a week and 12pm—9pm on Sunday's.There are 24 employees who account for operations, sales, maintenance, customer service and security.There are four main business areas: 1) a museum quality natural exhibit highlighting miniature railroad and miniature botanicals and bonsai; 2)the retail store featuring concessions, exhibit keepsakes,general merchandise; 3)event/community rooms (these areas are reserved for birthday parties,corporate events and learning instruction for hobbyist and the general public and 4) an entertainment area for children to explore interactive activities.The ticket prices for the main park exhibit will be$12.50 for adults and $7.50 for children. The following hardships form the basis of this variance request,which will only have an effect on hardscape, and no effect on vertical improvements: 1)the power easement,which cannot be feasibly relocated, restricts the placement of vertical and horizontal improvements to behind the easement. 2) The severe rear topography, combined with an attempt to eliminate any sight-lines to the townhouse community down the hill, necessitates placement of vertical improvements toward the street and electric easement, having a domino effect on the parking. 3)There is a 13' buffer from the curb-line to the property line: When combined with the proposed 10' parking setback,the 23'wide buffer creates an attractive and adequate landscape/sidewalk buffer. Finally,4)the setback variance has an established precedent at Terrawood Apartments on the same street with no ill effects. Nationally recognized bonsai experts and leaders in LGB scale garden railroads will manage the venue's breath taking scenic landscaping and railroads. adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities; and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation,water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and, therefore, feels that the issuance of this conditional use permit for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, and helps promote the general health, safety and welfare of this community. and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested planned development overlay should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 41 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this planned development overlay, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made;
