SUBJECT: CONDITIONAL USE REQUEST CU16-02; LOT 5R1, BLOCK 1, TOWNE
CENTER ADDITION
RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU89-93 (Ord. 89-93) approved at the December 5, 1989
meeting for development of a restaurant, specifically to modify the exterior elevations of
an existing restaurant, and take any other action necessary.
Conditional Use Request CU89-15 was considered and approved by City Council at
their December 5, 1980 meeting to allow for the development of a 1,997 square foot
restaurant (Arby's) on the subject site. The restaurant has a drive thru window located
along the west elevation.
With this request the applicant proposes to revise the exterior elevations of the existing
restaurant. The proposed exterior elevation changes include removal of an existing
canopy and columns along the east and south elevations and adding a new canopy
along the south, east and west elevations. The existing brick along each elevation will
be painted. No additional changes are proposed to the subject site.

This letter is to verify that your request for a conditional use permit located at 1260 William D Tate
Avenue and platted as Lot 5R1, Block 1, Towne Center for development of a restaurant, specifically
to modify the exterior elevations of an existing restaurant was approved by the Site Plan Review
Committee on March 2, 2016. A copy of the approved site plan is included.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.
