Any application for a change in zoning or for an amendment to the zoning ordinance shall

four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all riling fees. The application,

Being a portion of lot 4, Lipscomb -Daniel subdivision, an addition to the city of

Beginning at a 1/2" iron pin found in the West R.O.W. line of Main Street for the
Northeast comer of Tract being described, said Point being the Northeast comer of said Lot 4,

PROPOSED CONDITIONAL USE:
The proposed use is an extension of THE MAIN STREET BLUES ROOM which has both live
and recorded entertainment. The property is Zoned CBD. There are no regulatory conditions
imposed on the property other than those included in the requirements of the Central Business
District and the City and Texas Bureau of Alcohol Control licencing for the on premise sale and
consumption of alcoholic beverages.
This site is adjacent to the MAIN STREET BLUES ROOM and is within twenty four (24) feet of
that business, and adjacent to the sculpture garden which is included in their present alcoholic
beverage licence. There is no indication of any deleterious effect on surrounding properties
from the present location of the MAIN STREET BLUES ROOM and there is no indication that
this property's (816 South Main Street) use as such will cause future harm to the value, use or
other property in the neighborhood.

You received this notice because you area property owner within 200 feet of the subject tract
of land as shown by the most recent City -approved tax rolls. If you can not or do not wish to
attend the hearing, the attached form is provided for your convenience.
If owners of more than 20% of the property within 200 feet of the subject tract object to the
case, a 3/4 vote of the City Council is required to approve the request. To be considered a
part of the area property owners that object, the attached form, or a written response must be
returned to the Department of Development Services no later than 5:00 p.m. on the day
preceding the public hearing.
You may appear in person during the public hearing to state your opinion concerning the

The public hearing is to consider an application submitted by Monika Gusman for property

The applicant is requesting a conditional use permit to allow for the possession, storage,
retail sale and on -premise consumption of alcoholic beverages (beer, wine and mixed

The subject property is located at 814 and 816 South
Main Street, and is platted as Lot 4D, Lipscomb
Daniel Addition. The addition contains 20,406 square
feet (.468 acres). The property has approximately 106
feet of frontage along South Main Street and 128 feet
of frontage along Dallas Road.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the approved site plan of
CU04-41 (Ord. 04-86) for a restaurant with the possession, storage retail sale and on -
premise consumption of alcoholic beverages (beer, wine and mixed drinks) in conjunction
with a restaurant, specifically to allow for an expansion of the existing restaurant.
The applicant intends to expand the restaurant into the space previously occupied by the
Mad Duck bicycle shop, shown as Building "B" on the attached site plan. With a maximum
occupant load of 392 persons, parking required for the restaurant totals 131 spaces.
Parking spaces available immediately to the north on the Heritage Foundation property
totals 71 spaces. The City parking lot located on the north side of Dallas Road across from
the Police and Courts Building totals 106 spaces. In total, 177 parking spaces are
available to serve the restaurant.

PRESENT ZONING AND USE:
The property is currently zoned "CBD" Central Business District and was originally
developed as an artisan studio/foundry. Three buildings (Buildings A, B, and C as shown
on the site plan) are located on site with several retail businesses operating within Building
C. Currently the restaurant, "Main Street Blues Room" occupies Building A in its entirety—
the applicant proposes to expand operations into Building B as shown on the site plan.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was rezoned from '14' Limited Industrial District to
"LI" Light Industrial District during the 1984 City Rezoning. The property to the south of
Dallas Road was rezoned from "C-2" Community Business District and '14' Limited
Industrial District to "PO" Professional Office District during the 1984 City Rezoning. At the
November 17, 1998 joint public hearing Council approved a rezoning of this site from "LI"
Light Industrial District to "CBD" Central Business District (Z98-24; Ord. 98-136) and a
conditional use permit (CU98-58; Ord. 98-147) for an artisan studio. The Board of Zoning
Adjustment approved at their December 7, 1998 public hearing (BZA98-40) a total variance
to the 70 percent masonry requirement in the "CBD" Central Business District on this site
thus allowing the metal buildings to exist as developed. At the April 6, 1999 meeting a
conditional use permit was granted (CU99-19) for a winery with on- and off -premise
consumption of alcoholic beverages (wine only). A conditional use permit (CU01-65) for
a restaurant with on -premise alcoholic beverage consumption called "The Venue" was
approved by Council at their December 18, 2001 meeting on the subject property;
however, the restaurant closed shortly thereafter. At Council's December 21, 2004
meeting a conditional use permit was approved (CU04-41) for a restaurant with on -premise
alcoholic beverage sales in the same location previously occupied by The Venue.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "LI" Light Industrial District—Tarantula Train parking lot
SOUTH: "CBD" Central Business District—proposed office/retail building
EAST: "LI" Light Industrial District—Security Manufacturing Corporation
WEST: "LI" Light Industrial District—Aircraft Interior Components

The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The proposed restaurant
expansion is an appropriate use in this noise zone.

The Master Plan designates the subject property as an Industrial Land Use. The proposed

Dear Ms Gusman:
This letter is to verify that your request for a conditional use permit located at 816 South Main Street and
platted as a portion of Lot 4D, Lipscomb Daniel Addition, to amend the site plan approved by Ordinance
No. 2004-86 for the expansion of a restaurant with the possession, storage, retail sale and on -premise
consumption of alcoholic beverages (beer, wine and mixed beverages), was approved by the City
Council and Planning and Zoning Commission on August 16, 2005. A copy of Ordinance 2005-64 and
the approved bluelines are enclosed.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which
the City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit
is obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is
obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying with
the notice and hearing requirements for an initial application for a Conditional Use Permit.

Conditional Use Request CU05-47, Main Street Blues Room was considered and
approved at the August 16, 2005 meeting which allowed for an expansion of the
consumption and service area relative to an existing restaurant with on -premise
alcoholic beverage sales. This expansion area, previously occupied by Mad Duck
Adventure Sports was separately addressed as 816 South Main Street. Given that this
building/expansion area is now being utilized by the Main Street Blues Room, for
purposes of location and addressing this expansion area will be given the same address
as the original restaurant which is addressed as 814 South Main Street. The expansion
area approved at the August 16 meeting will also be addressed as 814 South Main
Street.
