Dear Mayor Tate:
Please allow me to address the referenced zoning change requested. The applicant is requesting to
build a 94 -unit 12 story (about 15B' tall) condominium complex on 10.58 acres identified as 2301
Grapevine Mills Boulevard North. The Dallas/Fort Worth International Airport views with concern
the proposed residential use of this property, given the noise levels, aircraft activity and related
public policy described below.
The project site lies well inside Zone B, identified by what is now called the 65 and 70Ldn contours.
It is immediately adjacent to Zone C, identified by what is now called the 75Ldn contour. The FAA
discourages residential construction in Zone B. The FAA also states that residential use of land
within the 75Ldn, Zone C, is "not compatible and should be prohibited", and makes no
recommendations for mitigation. The proximity of the proposed 158' tall condominium to the
75Ldn contour is not insignificant. Arriving aircraft will be passing within approximately 1200' of the
top floors of the structure.
The site is located approximately 3.4 statute miles from the end of Runway 36R. During South Flow,
70% of the time, the residents of the proposed complex should expect to hear approximately 350 to
400 arrivals passing within 0.5 statute mile to the west of the complex at altitudes of 750 — 900'
above the ground (AGL). During North Flow, the residents should expect to hear approximately
175 — 225 aircraft departures passing over and within 0.5 statute mile of the complex at altitudes of
about 1000'AGL and above.
The Airport encourages the City to consider the facts above in its decision. in the event that the
City determines the proposed conditional use permit is in its best interest, the Airport Board
recommends the following two actions:
1. in addition to, or as a replacement for the current Release required by the City, an
avigation easement be dedicated to the City of Grapevine, the Dallas/Fort Worth
International Airport Board, the City of Dallas, and the City of Fort Worth, An
easement will assure that sequential buyers of property at this site receive full
disclosure of the aircraft noise issue.
2. The 30clB Noise Level Reduction recommended by the FAA for residential
construction in the 70Ldn noise contour be mandated and confirmed.

The applicant intends to develop in four phases, a high-rise condominium project that will
consist of 12 stories of condominium space with two levels of parking starting at ground
level with a total height of approximately 160 -feet. The Federal Aviation Administration
(FAA) has authorized a build height up to 180 -feet at the subject location. Average unit size

project will be the northernmost lot.
PRESENT ZONING AND USE:
The property is currently zoned "PID" Planned Industrial Development District and is
developed in multiple lots with nonconforming single family homes.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and the property to the north, east, and west was zoned "I-1" Light
Industrial District prior to the 1984 City Rezoning. The property to the south was zoned ""L-
I" Light Industrial District prior to the 1984 City Rezoning. In 1984 the City changed the
zoning designation for the site to "PID" Planned Industrial Development. The property to
the north was then rezoned in 1985 as a part of the "Terra Tract" to "R -MF -2" Multi -Family
District (Case No. Z85-60, Ord. No. 85-60), however the property was not developed. In
October 1995, the property to the north was part of a zoning request (Case No. Z95-06)
whose purpose was to amend, revise, eliminate or terminate portions of the deed
restrictions and the letter of agreement as adopted in Ordinance No. 85-60, and rezone
portions of the site. At the September 7, 1999 meeting, Council approved the rezoning of
the property to the north (approximately 14.3 acres) from "R -MF -2" Multifamily District to
"CC" Community Commercial District for a proposed restaurant development that never
materialized. At the November 16, 2004 meeting, Council approved a rezoning of
approximately 8.69 acres of property to the north of the subject site from "CC" Community
Commercial District to "R -MF -1" for a proposed multifamily/condominium project.

The subject tract is located within "Zone B" Middle Zone of Effect as defined on the

the following uses may be considered only if sound treatment is included in building design:
multi -family apartments, motels, office buildings, movie theaters, restaurants, and personal
