TRIPLETT, JR., PLANER II DATE: SEPTEMBER 6, 2023 SUBJECT: CONDITIONAL USE REQUEST CU23-24; HTEAO RESTAURANT RECOMMENDATION Staff recommends the Site Plan Review Committee (SPRC) consider the proposed changes to conditional use request to amend the previously approved site plan CU21- 01 (Ord. 2021-09) for a drive-through restaurant, with outdoor dining, outdoor speakers, and a 20-foot pole sign. This request is specifically to allow outside storage of a 180 square foot HTeaO trailer to be in located in the existing parking lot of the HTeaO restaurant adjacent to West Wall Street and for the building to act as a commissary for the trailer. The property is located at 1113 West Northwest Highway and is currently zoned “HC”, Highway Commercial District and is owned by GKP Investments, LLC – Todd Bockenfeld. REQUEST On March 16, 2021, City Council approved conditional use request CU21-01 on the second reading of an ordinance to was to allow for a drive-through restaurant, with outside dining, outdoor speakers and a 20-foot pole sign on the site of the former Taco Bueno Restaurant. The applicant proposes to designate a 180 square foot space for an existing HTeaO trailer to be in located in the existing parking and vehicle maneuvering area adjacent to West Wall Street and for the existing restaurant building to act as a commissary for the trailer. The subject trailer is defined as a mobile food unit per the Tarrant County Public Health Department for permitting purposes and the owner utilizes the trailer to bring their drinks to special events both in and around the City of Grapevine. All mobile units must operate from an approved commissary. The mobile unit owner must submit to this department a letter from the owner of the commissary giving permission to use that facility for the proper storage of supplies and for the clean- up of the unit. Upon approval of CU23-24, the applicant is required to comply with the conditions related to the use of the restaurant as a commissary from the Tarrant County Public Health Department. BACKGROUND INFORMATION The subject site and sites to the north, east and west were rezoned in the 1984 City- wide Rezoning from “C-2”, Community Business District to “HC”, Highway Commercial District.
