Woods Avenue and is platted as Block 1, Lot 2-RA, Riverwoods Addition. The lot contains approximately 1.488 acres and has 201.76 feet of frontage along Ira E. Woods Avenue. REQUESTED ZONE CHANGE, CONDITIONAL USE, AND COMMENTS: The applicant is requesting to rezone 1.488 acres from "PO", Professional Office District to "CC", Community Commercial District. The applicant is also requesting a conditional use permit to develop a drive -through, automatic car wash. The applicant intends to develop a 34.6-foot tall, 5,895 square foot automatic car wash (Shammy's Car Wash) that includes a mechanical equipment room, an office, and break room with two restrooms for 3-5 employees. The north -facing blower that is adjacent to Ira E. Woods Avenue, located at the exit of the tunnel car wash is 89 feet from the property line and has a noise level of 32.9 dB. The applicant is proposing a total of 33 vacuum bays, 14 of which are located adjacent to Ira E. Woods Avenue and a 96 square foot shade structure over each bay. The north row of vacuum bays are 32.6 feet from the property line and have a noise level of 41.6 dB. The site has one existing access off of Ira E. Woods Avenue that is right -in/ right -out. Total required parking for the proposed use is 20 spaces, 36 parking spaces are provided. The proposed development is part of a planned office center (POC) CU08-30 (Ord. 2008- 68) consisting of three lots. The applicant is requesting to remove 1.488 acres from the existing POC to the north leaving the minimum acreage needed for a POC to remain for the existing Lodge at Bear Creek, Rehab & Healthcare Center to the west and Dancing River Assisted Living Facility to the south. PRESENT ZONING AND USE: The property is currently zoned "PO", Professional Office District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was annexed into the City of Grapevine in 1970 (Ord. 1970-30). The property was initially zoned "R-1 ", Single -Family Dwelling and then rezoned to 1-1 ", Light Industrial District prior to the 1984 City-wide Rezoning at which time the property was rezoned to "CN", Neighborhood Commercial District. • On April 17, 1979, City Council approved zone change request Z79-11 (Ord. 1979- 020) to rezone 12.42 acres from "R-1 ", Single -Family Dwelling to "I-1 ", Light Industrial. • On November 18, 2008, City Council approved Z08-11 (Ord. 2008-67) to rezone 12.1 acres from "CN", Neighborhood Commercial District to "PO", Professional Office District. • On November 18, 2008, City Council approved CU08-30 (Ord. 2008-68) to allow the development of a personal care facility and establish a planned office center on Lots 1-3. • On April 16, 2013, City Council approved CU13-01 (Ord. 2013-013) to amend the previously approved site plan of CU08-30 for a planned office center to allow the development of a 37,000 square foot, 60 bed, skilled nursing center (Lodge at Bear Creek) and a 40,250 square foot, 48 bed, assisted living facility (Rivervines) on Lots 1 and 2. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the City of Grapevine Ordinance No. 82-73, being the Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known Ordinance No. 2023-060 2 Z23-08 as Appendix "D" of the City Code of Grapevine, Texas, be, and the same is hereby amended and changed by Zoning Application Z23-08 to rezone the following described property to -wit: being a 1.488 acre tract of land out of the John N. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future, to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community.
