The site contains 16.619 acres and has approximately 493 feet of frontage along Genesis Way, approximately 1,116 feet of frontage along Enchanted Way, and approximately 1,433 feet of frontage along North State Highway 121. REQUESTED ZONE CHANGE, SITE PLAN, AND COMMENTS: The applicant is requesting to rezone 16.619 acres from “CC”, Community Commercial District to “BP”, Business Park District to construct an office-warehouse development. The applicant intends to develop a 272,160 square foot office and warehouse building. This development will consist of one 43-foot tall, two-story warehouse building with three proposed office spaces inside the 272,160 square foot building. The proposed development is partially in a planned commercial center (PCC), CU15-33 (Ord. 2015-47), consisting of seven lots. The request will remove 10.94 acres from the 16.2913-acre PCC. The remaining 5.35-acre PCC meets the 5.00 acre minimum for a PCC and includes the existing Hampton Inn Suites, Comfort Suites, Waffle House, and Shell gas station to the south. One monument sign is proposed along the north bound service road of State Highway 121, adjacent to the northern most proposed driveway. Six primary points of access are proposed: three along Enchanted Way, two along State Z23-07.4 and SP23-06.4 2 Highway 121, and one at the northwest corner of Genesis Way. Of the total access points proposed, three exist; two on State Highway 121 and one on Genesis Way. Currently three access points exist along State Highway 121. The northernmost existing access will be eliminated resulting in the two proposed points of access on State Highway 121. Total parking required for the proposed use is 219 parking spaces; 403 parking spaces are provided. If the rezoning request is approved, Site Plan SP23-06 can be staff approved. PRESENT ZONING AND USE: The property is currently zoned “CC”, Community Commercial District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject property and the surrounding area to the north and east were zoned “I-1”, Light Industrial District prior to the 1984 City-wide Rezoning. The property to the south was zoned “R-1”, Single Family Dwelling District prior to the 1984 City-wide Rezoning.  On February 20, 1996, City Council approved Z96-04 (Ord. 1996-13) to rezone 18.972 acres from “PID”, Planned Industrial Development District to “BP”, Business Park District for the development of hotel, retail and office uses generally located at 1900 State Highway 121.  On July 16, 1996, City Council approved Z96-02 (Ord. 1996-46) to rezone 17.6223 acres from “PID” Planned Industrial Development District to “CC”, Community Commercial District generally located at 1700 State Highway 121.  On September 17, 1996, City Council approved Z96-15 (Ord. 1996-73) to rezone 16.42 acres from “BP”, Business Park District to “CC”, Community Commercial District and 23.428 acres from “PID”, Planned Industrial Development District to “CC”, Community Commercial District generally located at 2040 State Highway 121 and 2005 Enchanted Way.  On May 20, 1997, City Council approved CU97-24 (Ord. 1997-051) to establish a planned commercial center for a 17.657-acre development with a 40-foot pole sign and to waive Section 47 E. 2. in accordance with section 47.
