August 15, 2023 Conditional Use Application/Site Plan Application Development Services Planning Division 200 S. Main St. Grapevine, TX 76051 To Whom it May Concern, We request conditional use approval to allow the second of two planned office building heights to be 60’ to the primary parapet. The existing office building height is 60’ to the primary parapet and the existing parking garage is 67’-6” to the primary parapet. The Paycom project site is approximately 14 acres in size. Considering the area of site containing waters of the United States and the 30% requirement for open area, only 10 acres of the site are buildable. Paycom has completed the initial phase of one 150,000 S.F. 4-story office building plus basement, a 14,000 S.F. gymnasium, a 7-level parking structure to accommodate all potential employees, and approximately 650 surface parking spaces. This phase includes a second 120,000 S.F. 4-story office. Due to the size restrictions of the site we need to go taller with the office buildings and parking garage than the current 50’ height limit allowable by the Community Commercial District Regulations as stated in Section 25-I-1. Considering the existing building to the north of the Paycom site exceeds the 50’ building height we do not feel that our proposed building height will cause any harm to surrounding neighbors or other property owners. The additional height as requested will allow Paycom to create a vibrant campus providing many jobs for the community. This property contains 13.1 acres and has approximately 977 feet of frontage along Kubota Drive and approximately 535 feet of frontage along State Highway 121. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the previously approved site plan CU18-22 (Ord. 2018-81) to exceed the maximum height limit. This request is specifically to construct a new 4-story office building and to extend the maximum height limit of 50 feet for the “CC”, Community Commercial District at the existing Paycom site. The applicant has an established corporate campus on a 13.1-acre site that was planned in two phases. The first phase consisted of a 150,000 square foot, 5-story (60-feet) tall office building, 14,200 square foot employee gymnasium, and a 7-story parking garage parking structure. The second phase of this development is to construct a new 4-story, 60-foot tall office building (123,340 square feet) and to extend the maximum building height limit of 50 feet. As part of this second phase, the applicant is also reconfiguring existing parking to the northwest of the proposed building resulting in 23 surface parking spaces along the western elevation of the building. CU23-25.4 2 Required parking for the first phase of the project was 505 spaces and the applicant provided 1,891 parking spaces between surface and a garage. Required parking with the addition of the second building is a total of 964 spaces and the site has an existing 1,822 spaces between the 1,563 spaces located within the parking structure and 259 surface parking spaces. The subject site has two existing points of access, both from Kubota Drive and both controlled. The main access to the Paycom site is from a drive at the northeastern corner of the site. An existing median break at this location allows two-way traffic both entering and exiting the site. The second access point is approximately 790 feet to the south and is right-in/right-out, only. Along with the controlled access entering the site, the applicant constructed a wrought-iron fence, six feet in height that secures the entire property. PRESENT ZONING AND USE: The subject property is presently zoned “CC”, Community Commercial District and is developed as a corporate office campus. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was zoned “I-1”, Light Industrial District prior to the 1984 City-wide Rezoning. The area incorporating the D/FW Hilton to the north, Anderson- Gibson Road to the south and east to State Highway 26 and State Highway 121 North to the Tarrant/Dallas County line was rezoned to “HCO”, Hotel/Corporate Office District during the 1984 City-wide Rezoning. A 35-acre tract to the west of the subject site was rezoned to “CC”, Community Commercial District with zone change request Z96-08, by City Council on June 18, 1996. The area to the east of the Tarrant/Dallas County line, south of Anderson-Gibson Road, and the area to the north of Anderson-Gibson Road east to State Highway 121 was rezoned to “PID”, Planned Industrial Development during the 1984 City-wide Rezoning. On December 19, 2006, City Council denied zone change request Z06-15 and Planned Development Overlay PD06-09, on 162.13 acres for a potential residential, office, retail, restaurant and hotel development. On July 21, 2009, City Council approved zone change request Z09-03 and Conditional Use request CU09-17, to rezone 16.36 acres from “CC” Community Commercial District to “MXU” Mixed Use District for the development of a multi- phase apartment project and to allow on-premise consumption of alcoholic beverages in conjunction with a restaurant and hotel development. On September 15, 2015, City Council approved Conditional Use request, CU15- 38 to allow for the North American headquarters of Kubota USA to exceed the maximum building height of 50 feet in the “CC” Community Commercial District. CU23-25.4 3 The approval allowed for a 78-foot-tall building portion of the primary structure with the majority of the structure being 60 feet in height. On October 16, 2018, City Council approved Conditional Use request, CU18-22 (Ord. 2018-81) for the subject property to allow the maximum building height to exceed 50 feet in the “CC” Community Commercial District. Section 2. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
