PLANNER II DATE: OCTOBER 4, 2023 SUBJECT: CONDITIONAL USE REQUEST CU23-16; FUZZY’S TACO SHOP RECOMMENDATION Staff recommends the Site Plan Review Committee (SPRC) consider the proposed changes to conditional use permit CU12-26 (Ord. 2012-33) to amend the previously approved site plan for a planned commercial center to allow the possession, storage, retail sale of on and off premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor speakers and outside dining in conjunction with a restaurant. This request is specifically to revise the floor plan, building elevations, remove the outdoor bar and to add an indoor storage closet. The property is currently zoned “CC”, Community Commercial District. REQUEST On July 12, 2012, City Council approved CU12-26 (Ord. 2012-31) to establish a new 3,836-square foot restaurant (Fuzzy’s Taco Shop), including a 636-square foot outdoor patio within an existing 8,704 square foot multi-tenant building. Two outdoor speakers and two television screens were approved for the patio. The restaurant was approved to seat a total of 138 patrons – 94 seats inside and 44 seats outdoors within the fenced, covered patio. At the time the proposed restaurant required 56-parking spaces; 60- spaces are provided. With this request the applicant proposes a new indoor 24 square foot closet. Internal shifts to the floor plan include: the office, kitchen, restroom hallway, staff drink stations, seating layout, 000removal of the outdoor bar and shifting exit doors from the west building elevation to the south building elevation. Revisions proposed for the south building elevation include removal of the outdoor bar adding one exit door. The restaurant proposes total seating of 124 patrons – 76 seats indoors and 48 seats outdoors within the fenced covered patio. BACKGROUND INFORMATION The subject site was zoned “I-1”, Light Industrial District prior to the 1984 City-wide rezoning at which time the subject site was rezoned to “HCO”, Hotel Corporate Office District.  On June 18, 1996, City Council approved Z96-08 (Ord. 1996-42) to rezone 35.505 acres from “HCO”, Hotel Corporate Office District to “CC”, Community Commercial District.
