RECOMMENDATION: Consider calling a public hearing regarding AM23-06 Payton -Wright Addition Pole Signs to amend Subsection B.1., On -Premise Signs of the Zoning Ordinance to include a segment of State Highway 114 between Lots 1 R4, 2R, 3R and Lot 4 of the Payton -Wright Addition to allow a shared pole or pylon signs between lots within the planned commercial center, and take any necessary action. FUNDING SOURCE: BACKGROUND: On July 20, 2021. City Council approved CU21-12 (Ord. 21-33) and CU21-13 (Ord. 21-34) to establish a planned commercial center and allow the possession, storage, retail sale, and on- and off -premise consumption of alcoholic beverages (beer, wine, and mixed beverages), outdoor dining, outdoor speakers, and one 40-foot pole/pylon signs in conjunction with a restaurant (Rock and Brews) and to allow within a planned commercial center, a restaurant (Velvet Taco) with the possession, storage, retail sale, and on- and off -premise consumption of alcoholic beverages (beer, wine, and mixed beverages), drive -through service, outdoor dining, outdoor speakers, and one, 40-foot pylon sign. The Master Site Plan for the planned commercial center included three lots, with seven restaurants, and three pole signs. Signs without elevations were not approved. Subsections 60.B.1.b, On -Premise Signs, 60.2.d.12, Pole Signs Conditional Uses, currently prohibits off promise signs except for signs located within developments with frontage on Grapevine Mills Parkway (F.M. 2499), Grapevine Mills Boulevard North, North State Highway 121 and Freeport Parkway. If located along the aforementioned frontages, the sings shall be considered on -premise signs, regardless of the lot on which they are placed, provided the following conditions are met: 1. A conditional use for such sign is approved by City Council. 2. Written permission for the placement of such sign is submitted to the City by the owner of the property on which the sign is placed. Tradecor Pebblecreek, LLC is the property owner of Block 1 R, Lot 3R2 and Lot 3R1 of Payton -Wright Addition. On -premise signs. A permanent sign including multi -tenant pole signs, which directs attention to a business or profession conducted, or to a commodity or service sold, offered or manufactured, or an entertainment offered, on the premises where the sign is located or to which it is affixed. (2) Written permission for the placement of such sign is submitted to the city by the owner of the property on which the sign is placed. Section 60 Subsection B.2.d.12.f, Pole Sign Conditional Uses Subsection 60.2.d.12.f., Pole Sign Conditional Uses f. Pole signs and multi -tenant pole signs on property zoned Highwav Commercial located along a segment of West State Highwav 114 frontage on the Pavton- Wright Addition, Lots 1 R4, 2R, 3R, and 4, with a planned commercial center designation, may include a multi -tenant sign, be a minimum of twentv (20) feet in height up to fortv (40) feet in height. For pole signs and multi -tenant pole signs exceeding twentv (20) feet in height, the sign cabinet dimensional requirements shall not exceed 24 (twenty-four) feet in width or height, a maximum of thirtv-six (36) inches in depth and a maximum gross surface area of two hundred eighty- eight (288) square feet, provided the following conditions are met: i. A conditional use for such sign is approved by City Council. ii. Written permission for the placement of such sign is submitted to the Citv by the owner of the property on which the sign is placed. /at Agenda Memo 237615
