SUBJECT: PUBLIC SAFETY BUILDING PROJECT FUNDING AMENDMENT

City Council consider:
authorizing additional funding for the PSB Project in the amount of $350,000.00.
adopting an ordinance amending the 2016 Capital Improvement Plan.
and take any necessary action.
FUNDING SOURCE:
Upon approval of the attached Ordinance a transfer of $350,000 from the Capital/Street
Maintenance Replacement Fund will be appropriated to the Capital Project General
Facilities Fund.
BACKGROUND:
Although soil testing had been done in preparation for the design of the project, the
subsurface ground water levels had risen so significantly because of the heavy rains in
2015 that the building foundation piers had to be redesigned.
The new design, which was the least costly of all alternatives considered, was significantly
more costly than the original method that was included in the guaranteed maximum price
(GMP). The GMP is developed assuming a certain design, quantities, etc. once that is
altered the price difference becomes the responsibility of the owner.
Absorbing this cost into the project has resulted in a significant depletion of the owner's
contingency funds and will soon impact the ability to address routine change orders that
are common in any project of this scope. The contractor also has control over half of our
contingency. Once the project reaches certain completion milestones, the contractor has
agreed to release those funds to our side of the contingency.
We are hopeful that once the contractor releases the remainder of the contingency, funds
will remain at the end of the project allowing us to reimburse ourselves for a portion of this
change order.
The City Council Facilities Committee meets monthly to discuss any change orders and
supports this strategy.
Staff recommends approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE TRANSFER OF
FUNDS FROM THE CAPITAL/STREET MAINTENANCE
REPLACEMENT FUND TO THE CAPITAL PROJECT
GENERAL FACILITIES FUND; APPROPRIATING FUNDS TO
THE CAPITAL PROJECT GENERAL FACILITIES FUND;
DECLARING AN EMERGENCY; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of Grapevine acknowledges and supports
the construction of the Public Safety Building Project; and
WHEREAS, the Project has encountered unanticipated costs directly related to the
May 2015 flooding event; and
WHEREAS, the May 2015 flooding event resulted in a significant rise in the
subsurface ground water elevation on the site which resulted in a more costly process to
install the building foundation piers; and
WHEREAS, the additional $350,000 in funding for the building foundation piers is
not currently included in the FY 2015-2016 Capital Improvements Plan Budget; and
WHEREAS, all constitutional and statutory prerequisites for the approval of this
ordinance have been met, including but not limited to the Open Meetings Act; and
WHEREAS, the City Council deems the adoption of this ordinance to be in the best
interests of the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the City Council hereby authorizes the transfer of funds in the
Capital/Street Maintenance Replacement Fund to the Capital Project General Facilities
Fund in an amount of $350,000.
Section 3. That the City Council hereby authorizes an amount of $350,000 to be
appropriated to the Capital Project General Facilities Fund.
Section 4. That a copy of the revised FY 2015-2016 Capital Improvements Plan
Budget document shall be kept on file in the office of the City Secretary and on the City of
Grapevine website.
Section 5. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 6. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety,
and general welfare which requires that this ordinance shall take effect immediately from
and after its passage and it is accordingly so ordained.
