HomeMy WebLinkAboutItem 24 - Lake Water Rights Accounting PlanMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: OCTOBER 17, 2023 SUBJECT: GRAPEVINE LAKE WATER RIGHTS ACCOUNTING PLAN RECOMMENDATION: City Council consider ratifying a letter agreement and approving an engineering services contract with Plummer Associates, Inc.to implement and administer the Lake Water Rights Accounting Plan and an ordinance to appropriate the funds. FUNDING SOURCE: Upon approval of the attached ordinance, funds will be available in the Utility Enterprise Fund in the estimated amount of $151,659. BACKGROUND: The Grapevine Lake Accounting Plan tracks the usage of water for the City of Grapevine, the City of Dallas and Dallas County Park Cities MUD from the lake against their water rights. This Plan, approved by the TCEQ in 2002, has been an ongoing process for many years. The Plan requires that a Registered Professional Engineer implement and administer the Plan. CP&Y, Inc. had provided those services to the City of Grapevine and the other two water rights holders on the lake over the past several years. The contract with CP&Y, Inc. has expired and three engineering firms were interviewed to take over the Grapevine Lake Accounting Plan. The past accounting was tracked on an Excel spreadsheet and the water rights holders were interested in modernizing the accounting plan to allow for data input via web -based input screens and to provide plan output via web -based dashboards. Plummer Associates, Inc. was selected by a committee of the the three water rights holders. Plummer will update the existing spreadsheet to a database format input structure and add graphics and reports to perform quality checks and to easily monitor the available capacity of each account. Plummer will then move to the next phase to create the Grapevine Lake Information Hub to make information easy to enter and retrieve. Amendments will be brought forward to council for approval for additional work on the Grapevine Lake Information Hub. Due to the extended hot and dry period experienced in North Texas, Grapevine Lake has experienced a rapid decline in water level and is approaching the level (530') that makes it critical to maintain daily updates of the the accounting plan. Staff issued Plummer a work authorization in the not to exceed amount of $14,500 while the larger contract was under review. The remaining contract amount for Phase 1 for approval is $61,559 for a total of $76,059. In addition, there is a $2,800 per month cost to manage the plan through December 31, 2025 (27 months X $2800/month) for a total of $75,600. Total compensation authorized in this contract is $151,659. The three parties agree to split the design costs and monthly administration costs equally. The City will pay upfront and request reimbursement from the City of Dallas and Dallas County Park Cities MUD in the amount of $101,106 as billed. Staff recommends approval. ORDINANCE NO. 2023-069 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE APPROPRIATION OF $151,659 IN THE UTILITY ENTERPRISE CAPITAL FUND; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine desires to complete and maintain the Grapevine Lake Water Rights Accounting Plan; and WHEREAS, funding is available in the Utility Enterprise Capital Fund; and WHEREAS, all constitutional and statutory prerequisites for the approval of this ordinance have been met, including but not limited to the Open Meetings Act and Chapter 211 of the Local Government Code; and WHEREAS, the City Council deems the adoption of this ordinance to be in the best interests of the health, safety, and welfare of the public. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council hereby authorizes an estimated amount of $151,659 to be appropriate from the Utility Enterprise Capital Fund for the for the Grapevine Lake Water Rights Accounting Plan. Section 3. That a copy of the revised FY 2023-2024 annual budget document shall be kept on file in the office of the City Secretary. Section 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 5. That the fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
