The Board approved the following request

order at approximately 6:15 P.M.

The first item for the Board of Zoning Adjustment to consider was BZA15-12 submitted
by David Buhr for property located at 913 South Church Street, proposed to be platted
as Lot 2RA, Block 51, Osian Commercial Addition.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant is requesting a special exception allowing the existing non-
residential structure and detached accessory structure to remain as developed along
with a parking lot expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the majority of the site was an existing developed lot.
Developed in 1960, the proposed reconfigured site was now noncompliant with the
current zoning ordinance (82-73) relative to the required front yard setback and
minimum front yard open space requirement.
Mr. Triplett stated that the proposed improvements to the subject site necessitated the
special exception to address the existing structure within the required front yard setback
and front yard landscape area. The developed portion of the subject site and the
undeveloped lot to the north were proposed to be platted into one lot. The existing
1,229 -square foot structure was proposed to be used for office, and a 256 -square foot
detached accessory structure existed on the subject site east of the primary structure
within the rear yard. Site improvements on the reconfigured lot included eight off-street
parking spaces and provided for 57% open space.
With no questions for Mr. Triplett, David and Cindy Buhr of 3307 Westover Court,
Grapevine, Texas, took the Oath of Truth; they gave a brief presentation to the Board
and requested favorable consideration of their request and offered to answer any
questions of the Board.
With no questions for Mr. and Mrs. Buhr and no additional speakers, Robert Rainwater
made a motion to close the public hearing. George Dalton seconded the motion which
prevailed by the following vote:
Ayes: Holt, Rainwater, White, Dalton, Morris

The next item for the Board of Zoning Adjustment to consider was BZA1 5-13 submitted
by Jason Richardson for property located at 3504 Lakeridge Drive, platted as Lot 28,
Lake Forest Addition.

Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant is requesting a special exception to allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot, and the
existing structure was built in 1970 prior to the 1984 City Rezoning to "R-7.5" Single
Family District, The site was noncompliant with the current Zoning Ordinance (82-73)
relative to the required 25 -foot rear yard setback adjacent to the east property line for
the existing dwelling.
Mr. Triplett went on to explain that the owner intended to expand the existing dwelling
from approximately 2,982 -square feet, to approximately 3,363 -square feet with a 126 -
square foot addition to the rear of the dwelling and a 255 -square foot covered front
porch.
With no questions for Mr. Triplett, Jason Richardson of, 2220 Lakeridge Drive,
Grapevine, Texas, took the Oath of Truth; he requested favorable consideration of his
request and offered to answer any questions of the Board.
With no questions for Mr. Richardson and no additional speakers, Robert Rainwater
made a motion to close the public hearing. Mike Morris seconded the motion which
prevailed by the following vote:

Ken White made a motion that a special condition existed for the requested special
exception. Specifically, the subject site was an existing developed lot, and the existing

Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
913 South Church Street, proposed to be platted as Lot 2RA, Block 51, Osian Commercial
Addition as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception allowing the existing non-residential
structure and detached accessory structure to remain as developed along with a parking lot
expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically, the
majority of the site is an existing developed lot. Developed in 1960, the proposed
reconfigured site is now noncompliant with the current zoning ordinance (82-73) relative to
the required front yard setback and minimum front yard open space requirement.
Proposed improvements to the subject site have necessitated a special exception request
to address the existing structure within the required front yard setback and front yard
landscape area. The property is currently zoned "PO" Professional Office District. The
developed portion of the subject site and the undeveloped lot to the north are proposed to
be platted into one lot. An existing 1,229 -square foot structure is proposed to be used for
general office uses. A 256 -square foot detached accessory structure exists on the subject
site east of the primary structure within the rear yard. Site improvements on the
reconfigured lot include: providing 57% open space and providing eight off-street parking
spaces. The application was submitted by Dave Buhr.

In conjunction with consideration of the application for 909 & 913 S. Church Street,
the following information is hereby provided:
The property is located in PO Zoning District, and will be used for a permitted use,
i.e. professional office space • financial services such • • certified financial planner
and/or accountant. The property has on it existing structures which substantially
comply with Section 27 Professional Office District Regulations. We will be adding a
parking lot, remodeling the interior of the building, and updating the exterior, but the
exterior footprint of the structures will not be altered.
The existing structure is old and in disrepair. We will be remodeling and bringing
value to the area. The design will fit the •' theme • Grapevine, including new
siding in • color that will compliment Grapevine's Historic District. The front porch
will be redone to enhance curb appeal. Overall, to give you an idea • •
commitment to improving this property, the parking lot and renovation budget for this
small 1,176 square foot building is approximately $1,40,000. Thus, you can see, we
intend • substantially improve the structure and property, adding value and
enjoyment of both this property and other properties in this PO District.
Due to the existing structure, a few of PO District Regulations cannot be strictly met,
and, • we request exceptions. Please note that the proposed exceptions will
not cause harm to the value, use, •; enjoyment • • property in the
neighborhood. Indeed, it will improve it and bring it up to or exceed the standards or
• professional offices in the area.
Exception I - Front Yard: Section 27 G (3) states the front yard shall be 25'. The
existing structure is more than 25' from the street, but only 235" from the property

line, and has a small porch in front of it. There is certainly more than 25 square feet
in the front yard, but if the regulation is intended as a 25' set back from the property
line, then an exception is required given the existing building falls approximately one
jind a half feet short of the regulation.
Exception 2 - Existing framed shed: ♦ small framed shed, which we • to use for
storage, sits in to the side, in back of the house. It is closer to the house than 27 G
(6) requires, and is less than 10 feet from the side property line. As it is an existing
structure, allowing it to remain causes no harm. We will be painting it to match the
exterior of the house.
Exception 3: Parking spaces. The plans for the house will create 7A.4 square feet of
office space, with the remainder being common areas (hallways, kitchen, restroom,
and conference room). If the office space were 600 or less square feet, the parking
required would be 7 spaces. Going over 600 square feet, however, increases the
requirement to 8. The available surface space for the new parking lot to be
constructed is limited, however, once consideration is given to set -back requirements.
The new parking lot will accommodate 7 spaces. Fortunately, the existing house
already has a paved driveway on one side which can be used as the • space. We
ask that the plans be approved with 7 spaces in the new lot, and allow the one
• driveway • count as the 8th space.

ongoing development of Grapevine.

E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
