order at approximately 6:23 P.M.
WENTWOOD DRIVE
The first item for the Board of Zoning Adjustment to consider was BZA16-01 submitted
by Darrell Jarrell for property located at 2940 Wentwood Drive, platted as Lot 7, Block 9,
Oak Creek Estates.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot, and the
existing structure was built in 1977. A form survey of the subject site was unavailable
within the permit records. The site was noncompliant with the current Zoning Ordinance
(82-73) relative to the required twenty five foot rear yard setback adjacent to the north
property line for the existing dwelling.
Mr. Triplett stated that the owner intended to expand the existing dwelling from
approximately 1,936 square feet to approximately 2,591 square feet with the addition of
a 173 square foot rear yard patio enclosure and a 482 square foot addition above the
existing garage. The additions would not increase the level of non -conformity of the
subject site.
With no questions for Mr. Triplett, Darrell Jarrell, representing property owners John and
Shelley Christian of 629 Huntwich Dr., Bedford, Texas, took the Oath of Truth; he
requested favorable consideration of the request and offered to answer any questions of
the Board.
Chairman Holt announced that two (2) letters of approval had been received.
With no questions for Mr. Jarrell and no additional speakers, Robert Rainwater made a

Mr. Triplett stated that the owner intended to expand the existing dwelling from
approximately 1,700 square feet to approximately 1,780 square feet with the addition of
an 80 square foot bathroom addition to the rear of the property. The addition would not
increase the level of non -conformity of the subject site.

conformity on the subject site.
Mr. Triplett went on to explain that a Certificate of Appropriateness (CA15-20) for a new
one-story addition and renovations of the existing dwelling and a Historic Landmark
Subdistrict (HL15-02) were approved on the subject site by the Historic Preservation

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA16-02
2940 WENTWOOD DRIVE
MEETING DATE: MONDAY, MARCH 7, 2016
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
2940 Wentwood Drive, platted as Lot 7, Block 9, Oak Creek Estates as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically, the
subject site is an existing developed lot, and the existing structure was built in 1977. A
form survey of the subject site is unavailable within the permit records. The site is
noncompliant with the current Zoning Ordinance (82-73) relative to the required twenty five
foot rear yard setback adjacent to the north property line for the existing dwelling.
BACKGROUND INFORMATION:
The owner intends to expand the existing dwelling from approximately 1,936 -square feet,
which includes an attached garage to approximately 2,591 -square feet by adding a 173 -
square foot patio enclosure and a 482 -square foot addition above the existing garage. The
proposed rear yard patio enclosure and the addition above the existing attached garage
does not increase the level of non -conformity on the subject site. The application was
submitted by Darrell Jarrell representing property owners John and Shelley Christian.

4. List the pertinent sections (s) of the zoning ordinance and indicate the specific
variance amounts being requested.
a. The residence at 2940 Wentwood Dr, Lot 7, Block 9 in Oak Creek Estates is
currently encroaching on a 25 foot setback ordinance per the city of
Grapevine at approximately 2.7 feet.
5. State the grounds for the request and detail any special conditions which cause
hardship that in your opinion justify the variance or special exceptions you are
requesting.
b. The special conditions for this variance are associated with Owners of 2940
Wentwood Dr, Lot 7, Block 9 in Oak Creek Estates permitting a home
improvement project which has raised an awareness of existing
encroachment upon a rear 25' setback dating back to 1977 original build.
The current owners of the residence are seeking to make improvements to
the residence, but cannot proceed without the ordinance infringement being
recorded and permits completed.
6. Explain any unique circumstances, if applicable, not considered by the zoning
ordinance.
c. The original builder and city planning approved plans to build the home
located at 2940 Wentwood Dr, Lot 7, and Block 9 in Oak Creek Estates in 1977

of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
