SUBJECT: DEVELOPERS AGREEMENT WITH WARE BROTHERS REMODELING,
LLC. AND AN APPROPRIATION ORDINANCE
RECOMMENDATION: City Council to consider approval of a Developers Agreement for the alley
between Austin Street and Dooley Street, between blocks 110 and 112 of
the College Heights Addition with Ware Brothers Remodeling, LLC and an
ordinance appropriating funds.
FUNDING SOURCE: Upon approval, funds will be available in the Capital Projects Streets Fund
estimated to be $34,915.
BACKGROUND: Ware Brothers Remodeling, LLC (Ware) is completing the construction of
a single family home at 519 E. Franklin Street. The home is approximately
mid -block between Dooley and Austin Streets. The house has a garage
that will be accessed from a public alley behind the property, which runs
the length of the block from east to west. Ware needs to construct a new
paved driveway for the new homeowner, within the alley to connect the
garage to Austin Street. This alley was platted as public right-of-way in
1921 as part of the College Heights addition. There are a total of five
alleys, within public right-of-way that exist in the College Heights Addition.
There are drainage concerns within the block. Existing flow drains from
the homes on the south side of the block across the public alley to the
north into the existing lots. Ware will improve the alley and pay for
approximately 115 feet of the alley (length across their development) while
the City will pay for the remaining 180 feet of the alley across the rear of
the other existing homeowners. This proposed developer's agreement will
improve the alley within this block along with the associated drainage
problem.
Ware received a quote in the amount of $34,915.20 from Pennington
Concrete Construction, a subcontractor for Ware for this work. The
individual work items were compared with the fixed unit pricing from the
City's annual contract for concrete services with Manning Concrete
Sawing and Cl Pavement. The amount for Manning Concrete to perform
the work would be $36,284 and Cl Pavement would be $36,029. The
quote from Ware is the best value for the City for this work.
The $34,915.20 is the City's share of the alley work and will be
reimbursed to Ware after the work is completed.

ORDINANCE NO. 2023-086
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, AUTHORIZING THE APPROPRIATION
OF $34,915.20 IN THE CAPITAL PROJECT STREET FUND;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of Grapevine desires tojoin in a Developers
Agreement for alley improvements between East Worth Street and East Franklin Street
between south Dooley Street and Austin Street; and
WHEREAS, the City isjoining in a developers agreementwith Ware Brothersforthe
alley improvements; and
WHEREAS, funding is available in the Capital Project Street Fund; and
WHEREAS, all constitutional and statutory prerequisites for the approval of this
ordinance have been met, including but not limited to the Open Meetings Act and Chapter
211 of the Local Government Code; and
WHEREAS, the City Council deems the adoption of this ordinance to be in the best
interests of the health, safety, and welfare of the public.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated hereinabove are found to be true and correct
and are incorporated herein by reference as if copied in their entirety.
Section 2. That the City Council hereby authorizes an estimated amount of
$34,915.20 to be appropriate for the engineering plans from the Capital Project Street
Fund for the alley improvements.
Section 3. That a copy of the revised FY 2023-2024 annual budget document
shall be kept on file in the office of the City Secretary.
Section 4. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase
shall be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 5. That the fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.
