The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, July 6, 2015 at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd
Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:

constituting a quorum with Secretary Ken White absent. Also present were City Council
Representative Sharron Spencer and the following City Staff:

CALL TO ORDER
Chairman Holt called the Briefing Session of the Board of Zoning Adjustment to order at
approximately 6:01 P.M.
NEW BUSINESS
Mr. Triplett briefed the Board of Zoning Adjustment regarding the item scheduled to be
heard in the regular public hearing.
ADJOURNMENT
With no further discussion, Robert Rainwater made a motion to adjourn. Mike Morris
seconded the motion which prevailed by the following vote:

Chairman Debbie Holt called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:17 P.M.
PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA15-05 JOE TEAKELL 513 SMITH
STREET
The first item for the Board of Zoning Adjustment to consider was BZA15-05 submitted
by Joe Teakell for property located at 513 Smith, platted as Lot 1A, Block 29, City of
Grapevine Addition.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot; with an
existing structure built in 1966 prior to the 1984 rezoning of the subject site to "R-7.5"
Single Family District.
Mr. Triplett stated that on March 25, 2015, the Historic Preservation Commission
approved a Certificate of Appropriateness. The owner intended to expand the existing
dwelling from approximately 2,125 -square feet to approximately 2,765 -square feet by
adding a 552 -square foot addition to the dwelling and an 88 -square foot covered
terrace.
Mr. Triplett went on explain that the subject site was noncompliant with the current
Zoning Ordinance (82-73) relative to the required 30 -foot front yard,setback and the six-
foot (6') side yard setback adjacent to the north property line for the existing dwelling.
With no questions for Mr. Triplett, Joel Teakell of 513 Smith Street, Grapevine, Texas,
took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of the request and offered to answer any questions of the
Board.
With no questions for Mr. Teakell and no additional speakers, Robert Rainwater made a
motion to close the public hearing. Mike Morris seconded the motion which prevailed by
the following vote:
Ayes: Holt, Rainwater, Dalton, Morris
Nays: None
Absent: White
Robert Rainwater made a motion that a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot; with an
existing structure built in 1966 prior to the 1984 rezoning of the subject site to "R-7.5"

following vote:

Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at

Staff finds that a special condition exists for the special exception request. Specifically, the
subject site is an existing developed lot, and the existing structure was built in 1966 prior

of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:

On Monday evening, July 6, 2015 at 6:15 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the Board of Zoning Adjustment of the City of
Grapevine will hold a public hearing to consider the following items:

Proposal: The request is for the following special exception to the
Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3, Nonconforming Uses
and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or
enlargement of a nonconforming use. The applicant is requesting a special exception to
allow the existing residential structure to remain as developed along with an expansion as
shown on the plot plan.

RECOMMENDATION:
Staff recommends the Historic Preservation Commission approve with conditions
Certificate of Appropriateness #CA15-23 for the property located at 234 East Franklin
Street, legally described as Block 31, Lot 2C &3A, City of Grapevine, to the Grapevine
Historic Preservation Ordinance 91-73 (Appendix G — Grapevine Code of Ordinances),
as amended for the following items:
Construct new addition to the rear of the existing one-story house as per the
attached plans with conditions that a permit is obtained from the Building
Department.
Certificate of Appropriateness application #CA15-24 was submitted on March 11, 2015
by the owner/applicant Joe Teakell for construction of a new 629 sq. ft. addition to the
existing house. The addition includes 541 sq. ft. of living area and an 88 sq. ft. covered
porch. The house is located in the Historic Township and presently does not have
historic landmark overlay designation. The new addition includes a new master
bedroom closet and extension of the existing family room and bedroom.
Plans for the renovation and additions were developed by M. J. Wright architects
following the updated June 2013 Preservation Ordinance. The existing house contains
1,595 sq. ft. The new additions would bring the total air-conditioned living area to 2,136
sq. Since the existing 435 sq. ft. two -car garage is directly attached to the house it is
considered living area for calculation purposes per the Ordinance, which brings the total
living area to 2,571 sq. ft. The existing and new porches and terraces do not count
against the maximum square footage of 3400 sq. ft.
In order to construct the new addition, an existing owner built deck and temporary trellis
that is detached from the house, would be removed.
Staff recommends approval of #CA15-24 for the new addition to the rear of the house
with the condition that a permit is obtained from the Building Department.
