REQUESTED ZONE CHANGE/CONDITIONAL USE/SPECIAL USE AND COMMENTS:
The applicant is requesting to amend the previously approved site plan of CU99-22 (Ord.
99-79) for a planned commercial center, specifically, to provide for the addition of a 72
space parking lot in conjunction with the existing restaurant. The additional proposed
parking is located on the site located on the south side of the lot on which the restaurant
is located. The applicant is proposing to replat the two lots into one lot for this purpose.
PRESENT ZONING AND USE:
The property is zoned "CC" Community Commercial District and is developed. The
property has a Conditional Use Permit (CU96-34) for the provision of parking on a separate
lot, and allowing the possession, storage, retail sale, and on -premise consumption of

alcoholic beverages in conjunction with a restaurant, and an amendment to the 40 -foot
pole sign. Conditional Use permit (CU95-20) also exists for a Planned Commercial Center
with two 40 -foot pole signs on Lot 7 and one on Lot 6, and a total of seven monument
signs, one each on Lots 1, 3, 5, 6, 7 and two on Lot 4.
HISTORY OF TRACT AND SURROUNDING AREA:
The Planned Commercial Center was rezoned (Z90-04) from "PID" Planned Industrial
Development District to "CC" Community Commercial District. The subject property and
the property to the east, west and south were rezoned in the 1984 City Rezoning from "R-
1" Single Family District and 1-1" Light Industrial to "PID" Planned Industrial Development.
The property to the west was rezoned (Z93-04) from "PID" Planned Industrial
Development to "CC" Community Commercial District in 1993.
Lot 1 of the Metroplace Addition Planned Commercial Center has a conditional use permit
(CU94-35) for the possession, storage, retail sale, and on -premise consumption of
alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant
within a hotel. Lot 1 of the Metroplace Addition Planned Commercial Center, has another
conditional use permit (CU95-10) which reduces the number of stories and reconfigures
the building, along with the possession, storage, retail sale, and on -premise consumption
of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant
within a hotel. Lot 4 of the Metroplace Addition Planned Commercial Center has a
conditional use permit (CU95-20) for the possession, storage, retail sale, and on -premise
consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with
a restaurant (Schlotzsky's). Lot 2 of the Metroplace Addition Planned Commercial Center
has a conditional use permit (CU95-21) allowing a 2 -story hotel (Super 8) and relocating
one 40 -foot pole sign from Lot 7 to Lot 2. This pole sign was later revised through
Conditional Use Permit96-12. Lot 7 has a Conditional Use Permit (CU95-28) allowing an
automotive service and tire retail store on the site and a Conditional Use Permit allowing
off-site parking for Saltgrass Restaurant, however the parking agreement was not filed with
the county. CU99-22, approved on May 18, 1999, allowed for a 430 square foot dining
room addition.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CC" Community Commercial District — State Highway 114, Chevron,
Grandy's Restaurant and McDonalds Restaurant.
SOUTH: "PID" Planned Industrial Development District and "GU" Governmental
Use — undeveloped.
EAST: "PID" Planned Industrial Development District — National Tire and
Battery

WEST: "CC" Community Commercial District — South Main Street and Joe's
Crab Shack restaurant.
AIRPORT IMPACT:
The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property for Commercial land use. The existing
property is developed in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates South Main Street as a Type D Minor Arterial, requiring
a minimum of 75 -feet of right-of-way to be developed as four lanes.

This Conditional Use Permit Application is requesting to revise the approved site plan of
Conditional Use Permit CU99-22 (Ordinance 99-79) for a planned commercial center
with the possession, storage, retail sale, and on -premise consumption of alcoholic
beverages (beer, wine, and mixed drinks), specifically to allow the addition of parking to
a 7,568 square foot restaurant, Saltgrass Steak House, with the possession, storage,
retail sale, and on -premise consumption of alcoholic consumption of alcoholic beverages
(beer, wine, and mixed drinks) on Lot 6-R-1, Block 3, Metroplace Addition.
There will be no outside service of alcoholic beverages.
There are no special requirements or conditions imposed on this conditional use by the
C -C district regulations. The addition of additional parking to the existing restaurant will
not cause substantial harm to the value, use or enjoyment of other property in the
neighborhood, and it will provide an additional amenity to patrons of the restaurant by
providing additional parking.

GRANTING CONDITIONAL USE PERMIT CU00-26 TO
AMEND THE SITE PLAN APPROVED BY ORDINANCE
NO. 99-79 FOR A PLANNED COMMERCIAL CENTER WITH
THE POSSESSION, STORAGE, RETAIL SALE AND ON -
PREMISE CONSUMPTION OF ALCOHOLIC BEVERAGES
(BEER, WINE AND MIXED BEVERAGES) IN CONJUNCTION
WITH A RESTAURANT FOR THE ADDITION OF A 72 SPACE
PARKING LOT IN A DISTRICT ZONED "CC" COMMUNITY
COMMERCIAL DISTRICT REGULATIONS ALL IN

WHEREAS, an application was made requesting issuance of a conditional use
permit by making applications for same with the Planning & Zoning Commission of the City
of Grapevine, Texas, as required by State statutes and the zoning ordinance of the City
of Grapevine, Texas, and all the legal requirements, conditions and prerequisites having
been complied with, the case having come before the City Council of the City of
Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having
been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council did consider the following factors in making a determination as
to whether this requested conditional use permit should be granted or denied: safety of the
motoring public and the pedestrians using the facilities in the area immediately
surrounding the site; safety from fire hazards and measures for fire control; protection of
adjacent property from flood or water damages, noise producing elements, and glare of the
vehicular and stationary lights and effect of such lights on established character of the
neighborhood; location, lighting, and types of signs and relation of signs to traffic control
and adjacent property; street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate neighborhood;
adequacy of parking as determined by requirements of this ordinance for off-street parking
facilities; location of ingress and egress points for parking and off-street locating spaces,
and protection of public health by surfacing on all parking areas to control dust; effect on
the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following
factors in making a determination as to whether this requested conditional use permit
should be granted or denied; effect on the congestion of the streets, the fire hazards,
panics and other dangers possibly present in the securing of safety from same, the effect
on the promotion of health and the general welfare, effect on adequate light and air, the
effect on the overcrowding of the land, the effect on the concentration of population, the
effect on the transportation, water, sewerage, schools, parks and other public facilities;
and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have
been satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character
of the existing zoning district and its peculiar suitability for particular uses and with the
view to conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there
is a public necessity for the granting of this conditional use permit, that the public demands
it, that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference
to the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration
of population, facilitates the adequate provisions of transportation, water, sewerage,
schools, parks and other public requirements; and

WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, an is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general
health, safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning
Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the
City Code, by granting Conditional Use Permit No. CU00-26 to amend the site plan
approved by Ordinance No. 99-79 for a planned commercial center with the possession,
storage retail sale and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) in conjunction with a restaurant (Saltgrass), for the addition of a 72
space parking lot in a district zoned "CC", Community Commercial District Regulations
within the following described property: Lots 5R and 6R1, Block 3, Metroplace Addition
(102 East State Highway 114) all in accordance with a site plan approved pursuant to
Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as Exhibit "A",
and all other conditions, restrictions, and safeguards imposed herein, including but not
limited to the following: None.
Section 2. The City Manager is hereby directed to amend the official zoning map
of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City
of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the
City of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business,
commercial needs and development of the community. They have been made with
reasonable consideration, among other things, of the character of the district, and its

peculiar suitability for the particular uses and with a view of conserving the value of
buildings and encouraging the most appropriate use of land throughout the community.
Section 5. This ordinance shall be cumulative of all other ordinances of the City
of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to
be severable and that if the validity of the zoning affecting any portion of the tract or tracts
of land described herein shall be declared to be invalid, the same shall not affect the
validity of the zoning of the balance of the tract or tracts of land described herein.
Section 7. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not
to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

owners of that certain parcel of land situated in the City of Grapevine, Tarrant
County, Texas, being more particularly described as shown on this plat.
NOW THEREFORE, in consideration of the sum of ONE AND 00/100 ($1.00) DOLLAR
and other good and valuable consideration, the receipt and sufficiency of which is
hereby fully acknowledged and confessed. Owner does hereby waive, release, remise
and quitclaim to the City of Grapevine, Tarrant County, Texas, and Dallas—Fort
Worth International Airport Board, the Cities of Dallas. Texas and Fort Worth,
Texas, their successors and assigns, hereinafter called 'Cities'. for the use and
benefit of the public and its agencies, any and all clavus for damages of any kind
to persons or property that Owner may suffer by reason of the passage and Right
of all aircraft in the air space above Owners properly above the height restriction

as the Airport Zoning Ordinance of the Dallas—Fort Worth International Airport, to
on infinite height above some. whether such damage shall originate from noise,
vibration, fumes, dust. fuel and lubricant particles, and all other effects that may
be caused by the operation of aircraft, landing at, a taking off from, or operating
at or on the Dallas—Fort Worth International Airport.
This instrument does not release the owners or operators of aircraft from liability
for damage to person or properly caused by foiling aircraft a failing physical
objects from aircraft, except as staled herein with respect to noise, fumes, dust,
fuel, and lubricant particles.
It is agreed that this Release shall be binding upon said owner and his heirs and
assigns, and successors in interest to said properly, and it is further agreed that
thisinstrument shall be a covenant running with the land, and shall be recorded in
the Deed Records of the county or counties in which the property is situated.

I. GENERAL:
1. Mr. Jim Dewey, Jr., the applicant, is platting this site to expand parking for the
Saltgrass Steakhouse restaurant.
2. This 2.6143 acre site is located on the southeast corner of State Highway
114 and South Main Street.
3. The site is currently developed as the Saltgrass Steakhouse restaurant.
II. STREET SYSTEM:
1. This site has access to State Highway 114 Eastbound Frontage Road and
South Main Street.
III. STORM DRAINAGE SYSTEM:
1. There is an existing 27 -inch RCP storm drain west of the property. This site
drains southwest toward this system.
2. The developer will be required to design for on site and off site drainage in
accordance with the City of Grapevine Code of Ordinances.
IV. WATER SYSTEM:
1. There is an existing 12 -inch water line west of the property along South Main
Street.
2. The existing water distribution system is adequate to serve the domestic and
fire protection needs of this and future surrounding developments.

V. SANITARY SEWER SYSTEM:
There is an existing 12 -inch sanitary sewer in the right of way of State
Highway 114.
2. The existing sanitary sewer collection system is adequate to serve the needs
of this and future surrounding developments.
VI. MISCELLANEOUS:
1. The current Water and Wastewater Impact Fees is $5,402.00 per acre for
future development.
VII. STATEMENT OF FINDINGS:
A. The City has determined that the right-of-way required to be dedicated for
streets, utilities, drainage and other municipal needs and services are
consistent with the City's ordinances and master plan, are reasonable and
are connected to the proposed project in the following manner:
1. The utility easements dedicated by this plat are necessary to provide
for public and franchised utility service to this and surrounding
developments
2. The access easements dedicated by this plat are necessary to allow
for increased vehicular mobility within this property.
B. The City further finds that the required dedication is related both in nature and
extent to the impact of the proposed development as follows:
1. The utility easements dedicated by this plat will allow for public and
franchise utilities to serve this development and surrounding sites.
2. The access easements dedicated by this plat are necessary to allow
for increased vehicular mobility within this property.
3. All of the dedications benefit the development to at least the extent of
the impact of such on the development.
VIII. RECOMMENDATION:
1. The members of the City Council and The Planning & Zoning Commission
consider the following motion:
"Move that the City Council (Planning and Zoning Commission) approve the
Statement of Findings and the Final Plat of Lot 6-R-1, Block 3,Metroplace
Addition."
