This is the first reading of the ordinance for this application, pending approval of a variance
to Section 24.8.3 of the Zoning Ordinance requiring:
"Screened garbage storage on a concrete pad [must be located] no nearer
than fifty feet to a residentially zoned district and not located between the
front of the building and any street right-of-way."
PRESENT ZONING AND USE:
The subject site is currently zoned "CN", Neighborhood Commercial District with a
conditional use permit allowing the storage, retail sale and off -premise consumption of
alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant and
a 20 -foot pole sign. The site is developed as Retail Center.
HISTORY OF TRACT AND SURROUNDING AREA:
Conditional Use Permit CU82-39 (Ordinance No. 82-57) was approved for the subject site
in 1982, allowing the storage, retail sale and off -premise consumption of alcoholic
beverages (beer only) incidental to the operation of a convenience store with a twenty -foot
pole sign.
The subject site and the sites located to the south were rezoned in the 1984 City Rezoning
from "C-2", Community Business District and "SP", Specific Use Permit to "CN",
Neighborhood Commercial. The property to the south was subsequently developed as
Clear Meadow Estates.
The property located to the east was rezoned from "C-2" Community Business to "R-3.5"
Two -Family District in the 1984 citywide rezoning. In 1993 the site zoning was changed
to "R-5.0" Zero Lot Line District (Z93-06, Ordinance 93-370). The site was subsequently
developed as the Town Park subdivision.
The property to the west and north was rezoned from "R-3" Multiple Family District to "R-
MF -1" and "R -MF -2" Multi -family District. The site to the north was developed as the Lakes
of Williamsburg. The site to the west has not been developed.
In 1988, Conditional Use Permit CU88-07 (Ordinance 88-54) was approved for the subject
site allowing the sale, storage and on -premise consumption of alcoholic beverages (beer,
wine and mixed drinks) in conjunction with a restaurant (Moretti's Italian Cuisine).
Conditional Use Permit CU90-18 (Ordinance No. 90-78) was approved in 1990, allowing
a 20 -ft. pole sign on the site. On July 6, 1999, the Council heard CU99-14. The applicant
was requesting to amend the approved floor plan and site plan of CU90-18 for the addition
0:\ZC1J\C000-24.44 3 June 14, 2000 (9:14AM)
of a deli counter and on-site gasoline sales in conjunction with a convenience store and
a 10 -ft. monument sign. The Council tabled the request to give the applicant an
opportunity to address concerns expressed at the public hearing. The application was
withdrawn in March 2000.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "R -MF -2" Multifamily District — The Lakes of Williamsburg
SOUTH: "R-3.5" Two -Family District — Clear Meadow Estates
EAST: "R-5.0" Zero Lot Line District — Town Park
WEST: "R -MF -1" Multifamily District —Vacant
AIRPORT IMPACT:
The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Low Intensity Commercial Use. A
convenience store with gasoline sales is an appropriate use for this site.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Mustang Drive as a Type D Minor Arterial, requiring a
minimum of 75 -feet of right-of-way to be developed as four lanes. Tanglewood Drive is
designated as a local street.

RE: Application for Conditional Use Permit
Request for Commercial Gasoline Retail/Convenience Store Shopping
Business Address -- 2713 Mustang Dr., Grapevine, Texas 76051
Existing Commercial Center Site - 2701 through 2713 Mustang Drive, Grapevine, Texas
Lot 1, Blk., 1, Y. C. Yee Addition, City of Grapevine, County of Tarrant, State of Texas
Owner -- Mustang Center - Mr. Amin Hadwani and Mr. Abdul Hadwani
Applicant/Operator -- Mr. Amin Hadwani
Dear Sirs:
We are respectfully requesting a "conditional use permit" to offer gasoline retail sales and alcoholic
beverage sales (beer & wine), as part of operating a convenience store located at the above
referenced commercial shopping center. The following outlines our reasons for our request.
Prior to the applicant's ownership of the existing convenience store facilities, at the referenced
location, gasoline retail and alcoholic beverage sales were a part of the overall services provided
to customers.
Gasoline retail services ceased eighteen (18) months before the applicant's business undertaking.
Under the current zoning of CN (neighborhood commercial), the issuance of a "conditional use
permit" will allow gasoline retail and alcoholic retail sales to become a part of the applicant's
convenience store retail business once again.

We advise that upon the issuance of a "conditional use permit" the applicant, incoordination with JE
& Associates, will work toward meeting TNRCC requirements and regulations governing the
adequacy of underground storage facilities. No gasoline retail operations will begin until all aspects
of the facilities are accepted under TNRCC criteria.
Sincerely,
