SUBJECT: RIGHT-OF-WAY AND ALLEY ABANDONMENT — PALACE
THEATER ADDITION
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 12 foot wide portion of Right -of -
Way along Barton Street, a 20 foot wide portion of Alley along Barton Street, and 6.36 foot
wide portion of Alley along Weems Alley adjacent to the Palace Theatre and take any
necessary action.
BACKGROUND INFORMATION:
The development of the Palace Theatre property as currently underway requires that the
City abandon the three attached right-of-way and alleys parcels to expand the Palace
Theatre footprint into these areas. A replat of the Palace Theater site is being considered
in the July 18, 2000 Agenda which will incorporate these three parcels into the lot.
The two parcels to be abandoned adjacent to Barton Street are for the Back Stage Area
and will align with the rear of City Hall to the north. The Weems Alley abandonment is for
the Terrace / Concession Area along the north side of the building.
Exhibit 'A' provides a metes and bounds description for the 12' x 131.37' (1,576 s.f. of land)
of right-of-way in Barton Street to be abandoned. Exhibit 'B' provides a metes and bounds
description for the 20' x 131.36' (2,678 s.f. of land) of alley in Barton Street to be
abandoned. Exhibit 'C' provides a metes and bounds description for the 6.36' x 94' (598
s.f. of land) of Weems Alley to be abandoned.
All utilities within the proposed abandonment areas have been relocated.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF THE BARTON STREET RIGHT-OF-WAY,
BARTON STREET ALLEY AREA, AND WEEMS ALLEY AREA
IN THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; SAVE AND EXCEPT THE RETENTION OF
SAID RIGHT-OF-WAY AND ALLEY AREAS FOR PUBLIC
USE IN THE RE -DEVELOPMENT OF THE PALACE
THEATER; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the re -development of the Palace Theatre requires the abandonment
of right-of-way and alley areas for the proposed building footprint; and
WHEREAS, the right-of-way and alley areas are not needed for public vehicular
and pedestrian use and will not be needed in the future for such use; and
WHEREAS, abandoning and vacating the right-of-way and alley areas will relieve
the City of Grapevine, Texas from the cost and expense of maintaining said property as
a vehicular and pedestrian passageway.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the Barton Street right-of-way described in Exhibit "A", attached
hereto and incorporated herein for all purposes, is hereby abandoned and vacated for
street right-of-way purposes and is retained as public property for the redevelopment of
the Palace Theater.
Section 2. That the Barton Street alley area described in Exhibit "B", attached
hereto and incorporated herein for all purposes, is hereby abandoned and vacated for
alley purposes and is retained as public property for the redevelopment of the Palace
Theater.
Section 3. That the Weems Alley area described in Exhibit "C", attached hereto
and incorporated herein for all purposes, is hereby abandoned and vacated for alley
purposes and is retained as public property for the redevelopment of the Palace Theater.
Section 4. The fact that the right-of-way and alley areas are no longer needed
by the public for right-of-way and alley purposes and would create a hardship or burden
upon the City of Grapevine to keep open and maintain creates an urgency and an
emergency for the immediate preservation of the public health, safety, and general welfare
which requires that this ordinance shall take effect immediately from and after its passage
and it is accordingly so ordained.
Section 5. That the terms and provisions of this ordinance shall be deemed to
be severable, and that if the validity of any section, subsection, word, sentence or phrase
shall be held to be invalid, it shall not affect the remaining part of this ordinance.
