RECOMMENDATION:
Staff recommends the City Council deny the appeal to the decision of the Historic
Preservation Commission regarding CA99-37.
BACKGROUND INFORMATION:
This appeal was filed by Mr. Donald Ham, the owner of the home located at 722 W.
College Street. Certificate of Appropriateness Case CA99-37 was denied at the
Wednesday, November 17, 1999 Historic Preservation Commission meeting.
The applicant's request was to install vinyl siding over the existing wood siding and
decorative trim.
The residence, constructed circa 1921, is an outstanding example of Grapevine's
bungalow homes. The architectural features include a low pitched cross gables roof with
wide overhanging eaves and brackets, exposed rafter tails, battered wood columns and
brick piers. Of particular note is the porte-cochere on the East Side of the house, which
distinguishes this example from any of Grapevine's other bungalow residences.
Mr. Ham contracted with Sears Siding and Windows for this work. Staff placed a stop work
order on the project as soon as it was discovered, however, at that time, the work in staff's
opinion was approximately 70% complete.
At the Historic Preservation Commission meeting, the representative for Sears stated that
he was told by Staff that a permit was not required. None of the Building Department Staff
could recall speaking with Sears about siding, although it is true no building permit is
required. However, the fact that a permit is not required does not relieve the requirement
for a Certificate of Appropriateness in the College Street Historic District.
At the hearing, Mr. Ham's representative, Ms. Sarah Ham -Marshal, who stated that she
married Mr. Ham in 1981, verified that she attended the historic district meeting (Staff
verified through the 1993 meeting minutes that it was clearly stated that vinyl siding would

not be permitted). Ms. Ham -Marshall indicated that she now lives out of State, and could
have told Mr. Ham about the approval requirements if she had known what was happening.
Mr. Ham did not speak at the hearing.
Hugo Gardea, Historic Preservation Officer, spoke with Mr. Ham after the violation was
discovered, suggesting he apply for a grant. Mr. Ham replied that he had previously
considered a grant, but decided not to because it would not allow him to install vinyl siding.

Some considerations in regard to improvements to home of
Mr. Don Ham -- 722 W. College St. Grapevine, Texas.
Mr Ham was forthright and sincere when he contracted with (THE HOME
Sears to iDstall siding on the wood trim of his home.The IS BRICK)
work is approximatelylcomplete, and the work has very much
inhansed and improvedzthe home, He was unable to re -paint
because of the many coats of paint applied over the years.
It seems that the Sears sub-contracter appraached the City
of Grapevine for a permit to apply the siding and was told
one was not necessary, so he proceeded with the work.
The work has been on hold for weeks now and it should be
resolved by the City -- so that MR -Ham can continue with
the improvements.
As a neighbor and friend of Mr. Ham -- also friend of the
City and all of the employees -- also members of the
Historical Society -- and Heritage Foundation, I feel that
we should grant Mr Ham permission to proceed with his work.
I have been assured by the conjracter that the work will
be completed in a proffessional manner and will improve
the looks of the ism home.
In further consideration -- we need to be aware that Mr.
Ham has recently been through a divorce, also lost his
job with a company he has been with for several years.
Considering; all of this -- I fe&l that Mr. Ham should be
contacted immediately and permitted to continue his im-
provements. This would go a long way in improving relatio-
nships with the community. He had hoped and planned on
completion of the work before Christmas -- it should not
be delayed en y longer.

the Heritage Foundation to keep anyone from improving
their property or home.,,., therefore I,f_eel that the
Council should act decl:S vely and gmickly on this

Mr. Donald Ham, property owner of 722 W. College Street since 1984, is requesting
a Certificate of Appropriateness to complete the installation of vinyl siding to his
residence. Mr. Ham contracted with Sears Siding and Windows for this work. His
contractor was not aware that this property required a Certificate of Appropriateness
for exterior modifications.
The College Street Historic District Design Guidelines (under Building Fabric —
Finishes) maintains that original wood finishes should be maintained and painted
or when necessary, replaced in-kind. Modern synthetic siding materials (such as
vinyl) should not be installed. The installation of such siding often involves the
removal or covering up of decorative elements, such as those mentioned above.
EXISTING CONDITIONS
Mr. Ham's contractors have begun installation of the vinyl siding and are
approximately 70% complete. Staff approached the contractors on Thursday,
November 4 and requested work be stopped until the owner has applied for and
received a Certificate of Appropriateness.
As part of the installation of the vinyl siding, the original wood brackets (providing
support for the overhanging eaves) have been removed. Some of the exposed
soffits and rafter tails have been covered.

This letter confirms that on November 17, 1999, the Historic Preservation Commission
denied CA99-37 for property addressed at 722 West College Street, legally described as
Tract 10J02, A. Foster Survey A-518, for the following work:
1. Installation of vinyl siding over existing wood siding.
As per Section 13 (Appeals) of the Grapevine Historic Preservation Ordinance 91-73
(Appendix G — Grapevine Code of Ordinances), any person denied a Certificate of
Appropriateness may, within thirty (30) calendar days of receipt of the written decision, file
a written application with the City Council through the office of the City Secretary for a
review of the decision. The City Council will hold a public hearing to consider the appeal.
A decision of the City Council is final and not appealable.
A copy of the minutes will be available after they have been approved at the next regular
Historic Preservation Commission meeting. If you need a copy for your records, please
