1999 POPULATION ESTIMATE
Staff recommends that the City Council adopt a resolution setting the population at 39,190
as of December 31, 1999.
BACKGROUND:
Staff estimated the City of Grapevine's 1999 population based on the number of existing
residential units and new units permitted and demolished in 1999 in the city. The number
of existing residential units on December 31, 1998 was 15,610. The number of single-
family units permitted in 1999 was 188 and there were no new multi -family units permitted
in 1999. Three demolitions of single-family units and four demolitions of multi -family units
took place in 1999. Based on these figures, the total number of units on December 31,
1999 was 15,791. The total units were then multiplied by an occupancy rate and an
average household size of 2.89 for single-family, 1.99 for multi -family and 2.66 for other
units such as mobile homes, fourplexes and duplexes. Based on these calculations, the
estimated 1999 population on December 31,1999 was 39,190. This is an increase of
1,244 from the 1998 population of 37,946.
As the attached charts indicate, Grapevine's population has grown rapidly since 1970. The
availability of residential land will limit Grapevine's growth in the future. The North Central
Texas Council of Governments estimates a population of 44,950 for Grapevine by the year
2010 at which time very little additional undeveloped residential land will be left.

SUBJECT: HORSE AND CARRIAGE SERVICE IN HISTORIC DISTRICT
RECOMMENDATION:
City Council to consider adopting a contract for the best bid meeting City specifications to
Olde Tyme Carriage Company for horse and carriage service in portions of the Downtown
Historic District.
BACKGROUND:
Request for proposals were processed in accordance with Local Government Code,
Chapter 14951, Section 252.041 and 252.043. Proposals were opened on November 13,
1998.
Notice to bidders was published in the Grapevine Sun and the Fort Worth Star Telegram
on October 29, 1998, and November 5, 1998. Requests for proposals were sent to four
vendors with one vendor responding.
An increase in tourists in the Downtown Historic District has suggested a need for a horse
and carriage provider. In September, City Council adopted an ordinance allowing horse
and carriage service on the right-of-way under a contract with the City. That Council action
allowed staff to proceed with solicitation of vendors.
An RFP process was used to select the vendor. Boundaries of operation would be Dooley
Street, Wall Street, Church Street and Hudgins Street. The required hours of operation
would be Friday and Saturday evenings from 6:30 p.m. to 8:00 p.m. Additional hours of
operation would be available except for weekdays before 6:30 p.m. Operation during
festivals would be prohibited within festival grounds. The selected vendor would use the
area behind the gazebo for loading and unloading except during festivals, when other
arrangements would be made.
The City Attorney has reviewed the attached contract.
Staff recommends approval.

WITNESSETH
WHEREAS, Licensee has made application to operate a horse-drawn carriage service
in the City ofGrapevine, TaX8S. upon and over city St[ggtS as a8eO in exhibit in Said
City; and
WHEREAS, the City Council, upon duly considering said application, has found a public
need and necessity for such service;
NOW, THEREFORE, in consideration of the mutual covenants hereafter Set forth, the
parties do hereby agree as follows:
1.
Licensee iShereby granted the PRIVILEGE and LICENSE touse the present and
future streets in the area bounded by Dooley Street, Church Street, VVaU StneGt, and
Hudgins Street of the City of Grapevine, T8X8S for 3 tnnO of one year oOOnrOenoin8
February 1, 2000 in its business Of providing h0rSg'dn8vvn carriage service for hire
within the City's rDuDiCip8| limits. Such service shall beconfined tothe area depicted OO
Exhibit A. The Licensee agrees to be provide service Friday and Saturday evenings
from 8:30 p.m. to 8:30 p.m. Other hours are optional. Such service will not be permitted
between 7:00 a.m. and 0:30 p.0. Monday through Friday eXCHctS as requested Or
authorized bythe City.
2.
A. Licensee acknowledges its property and operations shall beand remain subject to
such reasonable regulation by the City as it is or may be necessary to protect the
interests ofthe general public.
B. For and in COnSidBr8UOO of the privilege and license granted herein to operate its
horse-drawn c8Oi8gan upon the City's streets, Licensee Sh8U pay the City a
licensing fee Of $250.00.
C. The supervision and/or revocation of the privilege granted herein may be
accomplished under the applicable provisions of the ordinances and Charter of the
City of Grapevine and the laws of the State of Texas.

Licensee covenants and agrees that at all times during the operation of public
carriage service, it shall keep its equipment in neat, clean, operable and safe condition,
attractive to the general public. All drivers and operators of such equipment shall be
well-trained and capable of operating such equipment, and will operate same in a
courteous and safe manner in accordance with the laws and ordinances of the City of
Grapevine and the State of Texas. Licensee shall operate and conduct such operation
in a manner that will not be disturbing or annoying to the general public.
Licensee covenants and agrees that it shall take all reasonable measures to
keep all city streets and other property clean of animal excrement resulting from the
Licensee's operations hereunder. Such excrement shall be collected and disposed of
on a daily basis, and failure by the Licensee to maintain said streets and property in a
manner described herein shall be grounds for termination of this license and agreement.
Licensee shall utilize "diapers" on its horses as a reasonable measure to keep city
streets and other property clean of equine fecal matter but the use of said diapers shall
not mitigate the Licensees responsibility to remove all equine fecal matter from city
streets. An area will be designated for horse urination by the City. That area must be
cleaned with water at the end of each evening if it has been used for such purpose.
4.
Licensee's service shall be available to all members of the general public who
pay for such service, and Licensee shall not discriminate against anyone in the
furnishing of its service, or the charges thereof, on account of race, color, religion, sex
or national origin.
5.
Licensee acknowledges that it property and operations shall be and remain
subject to such reasonable regulation by the City as is or may be necessary to protect
the interests of the general public. As such, Licensee understands and acknowledges
that during the term of this agreement the City of Grapevine may adopt such ordinances
which further regulate the operation of Licensee's service within the City of Grapevine,
and Licensee agrees that upon the adoption thereof, Licensee shall begin conduction its
operation in compliance with the provisions of such ordinances, regardless of the terms
and conditions of this agreement. in the event the terms and conditions of this
agreement are in conflict with the provisions of any such ordinance adopted by the City,
the parties hereto agree that the provisions of such ordinance shall supersede the terms
and conditions of this agreement to the extent they are in conflict.

officer, agent, servant, oremployee ofthe City. Licensee shall have exclusive control of

enterprise between City and Licensee.

It is further understood and agreed between the Parties hereto that the legal title
to the City streets belongs to the State, and City ofGrapevine exercises such powers
over the streets aahave been delegated tOitbvthe Constitution nfthe State OfTexas or
by the Legislature; that the City of Grapevine holds the streets QS trustee for the public
and that the City of Grapevine cannot oDntngci Rvvey its duty and its legislative power to
COntnD| the streets for the use and benefit of the public. It is accordingly agreed that if
the governing body of the City of Grapevine, to wit, its City COUnoi|, should at mOviirne
dU[iOQ the term hereof close, v3O8tg, and abandon all or any portion of said StregtG, Or
use or C8USg permit the said portions of street to be used for any public purpose,
including but not limited to underground, surface or overhead communication, drainage,
sanitary gevvenag8, transmission of natural gas Or g|8CtriCitv. or any other public
purpOae, whether presently contemplated Or not, then City may do SO without any
liability under this Agreement.

Licensee covenants and agrees to indemnify and hold harmless City, it's officers,
agents, servants and employees, from and against any and all claims or suits for
property damage and/or personal injury, including death to any and all persons, of
whatsoever kind of character, whether real or asserted, arising out of or in connection
with Licensee's exercise of the privilege granted herein. Licensee hereby assumes all
liability and responsibility for any and all claims or suits for property loss or damage
and/or personal injury, including death to any and all persons, of whatsoever kind or
character, whether real or asserted, arising out of or in connection with all acts or
omissions of Licensee, its officers, agents, employees, contractors, subcontractors,
licensees, invitees or patrons.
Licensee covenants and agrees that it will obtain and maintain in force
throughout the term of this agreement, a policy or policies of general liability insurance
in the amount of $500,000 per occurrence for bodily damage and $1,000,000 aggregate
for property damage pertaining to its services and operations hereunder; that said policy
or policies shall be with a reputable company licensees to do business in the State of
Texas; that a certificate evidencing the fact of current insurance coverage shall be
maintained on file with the City throughout the term of this agreement.

Licensee covenants and agrees it is obligated to discharge any claim or
judgement against it finally established by law, and that failure to do so for a period of
one hundred eighty (180) days thereafter shall ,ipso facto, terminate all authority under
this agreement.
12.
It is specifically covenanted and agreed by and between the parties hereto that
nothing herein contained shall ever be held or construed to confer upon the Licensee
exclusive rights or privileges however, Licensee shall have right of first refusal for any
additional horse-drawn carriage or similar vehicle service within the City of Grapevine.
13.
Licensee agrees that it will not assign its rights or the privilege herein granted
without the prior written consent of the City, and any attempted assignment without such
prior written consent shall be null and void.

14.
Venue of any suit or cause of action of any nature whatsoever brought under this
agreement shall lie exclusively in Tarrant County, Texas.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS MAKING OFFICIAL THE FINDING AND
DETERMINATION AS TO THE POPULATION AND NUMBER
OF INHABITANTS OF AND WITHIN THE CITY OF
GRAPEVINE, TEXAS AS OF DECEMBER 31, 1999 AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council of Grapevine, Texas has found and determined that it
will be for the benefit of said City to have a revised estimate of the population and number
of inhabitants, and that the City make an official finding thereof, and
WHEREAS, the City Council has directed that an unofficial census of the population
of the City of Grapevine be taken; and
WHEREAS, based upon the 1990 Census Report, City building records, and the
investigation and review of the City's growth by the Development Services Department, it
has been found and determined that the City of Grapevine, Texas, as of December 31,
1999 actually has within its limits a population of 39,190.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That the City Council has officially found and determined, and does
now find and determine, that the population of the City of Grapevine, Texas, as of the 31st
day of December 1999, is 39,190.
Section 2. That the City Secretary is hereby directed to forward a copy of this
resolution to the Texas Highway Department so that they may change the population signs
on the roads and highways entering and leaving the City of Grapevine, Texas.
Section 3. That this resolution shall become effective from and after the date of
its final passage.
