HaIlJohnson ti�so A'rP°" a Crossroads of DFW. The addition contains 1.56 .0 acres. The property has approximately 179.09 feet of m Glade Rd.m _� frontage along S.H. 114 Service - Road and approximately 407.24 feet of frontage along Crossroads Drive. REQUESTED ZONE CHANGE/CONDITIONAL USE AND COMMENTS: The applicant is requesting approval of a revision of the approved site plan for CU99-18 (Ord. No. 99-72) for a planned commercial center, specifically for the addition of a 6.720 sq. ft. restaurant, Carraba's Italian Grill, with the possession, storage retail sales and on - premise consumption of alcoholic beverages (beer, wine and mixed drinks) and a fortv-foot pole sign. The applicant is requesting to develop a 6,720 square foot, 228 -seat restaurant under the name of Carraba's Italian Grill. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District with a Planned Olzm/cu00-09.4 1 March 23, 2000 (9:50AM) { Commercial Center designation. Numerous conditional use permits have been granted within this planned commercial center for on -premise consumption of alcoholic beverages in conjunction with a restaurant and 40 -foot pole signs. The site in question is currently undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was zoned 1-1" Light Industrial District prior to the 1984 City Rezoning. The subject property was rezoned from "GU" Governmental Use District and "PID" Planned Industrial Development District to "CC" Community Commercial District with a master site plan for a Planned Commercial Center in conjunction with an Outback Steakhouse (Z92-04 and CU92-14). TGI Fridays amended the approved site plan (CU92-20) at the December 15, 1992 joint public hearing and developed a restaurant with on -premise consumption of alcoholic beverages and a 40 -foot pole sign. California Pizza Kitchen was approved at the January 18, 1994 joint public hearing (CU93-14) which also allowed for a restaurant with on -premise consumption of alcoholic beverages and a 40 -foot pole sign. CU94-03 was approved by Council on March 22, 1994 and allowed TGI Fridays to consolidate two smoking areas into one area with an approved floor plan. Council approved CU94-10 on May 17, 1994, which allowed for the development of a Don Pablos restaurant with on -premise consumption of alcoholic beverages and a 40 -foot pole sign. CU94-11 was also approved at the May 17, 1994 joint public hearing which established a f Boston Chicken restaurant with a 40 -foot pole sign within the planned commercial center. CU94-25 and CU94-26 were heard and approved at the September 20, 1994 joint public hearing—CU94-25 established a Red Robin restaurant with on -premise consumption of alcoholic beverages and CU94-26 allowed changes to the floor plan for Don Pablos restaurant. CU94-36 was approved at the December 20, 1994 joint public hearing and allowed for additional wall signage for the California Pizza Kitchen. CU95-07 established Denney's Restaurant with a 40 -foot pole sign and was approved at the May 16, 1995 joint public hearing. CU95-18 was approved at the August 15, 1995 joint public hearing which allowed for a 40 -foot pole sign and a 20 -foot pole sign for Red Robin Restaurant. CU98-08 was approved on April 21, 1998 at the joint public hearing, which allowed for a 781 square foot expansion to the existing restaurant. CU99-19 was approved on May 4, 1999 allowing for the development of a 7,956 square foot 292 seat restaurant under the name of Logan's Roadhouse, with a 40 -ft. pole sign. To the west, Classic Chevrolet has be granted numerous conditional use permits (CU91- 01, CU92-01, CU92-16, CU94-02) for a car dealership with automobile repair, 40 -foot pole signs, a used car showroom with eight service bays, parts storage, sales offices and a customer lounge area. CU95-15 was approved by Council on June 20, 1995 and allowed Classic Chevrolet a 6.354 acre expansion to develop a paint and body shop, a used car sales building, with display and inventory parking. CU96-31 was approved by Council on November 19, 1996 and allowed for an additional pole sign and the revision of sign copy 0:/zcu/C000-09.4 2 March 22, 2000 (9:29AM) on another. The Hayley Addition to the north, another planned commercial center also has numerous conditional use permits for restaurants with on -premise alcoholic beverage sales, 40 -foot pole signs, several retail stores, and eight screen theater, and a convenience store with gasoline sales and off -premise consumption of alcoholic beverages (beer and wine only). NORTH: "HC" Highway Commercial District—Mobile Service Station, La Madeleine, Chili's Grill and Bar, Romano's Macaroni Grill SOUTH: "CC" Community Commercial District—Don Pablos, Boston Chicken, Denny's Restaurant, Red Robin EAST: "CC" Community Commercial - Outback Steakhouse WEST: "CC" Community Commercial District—California Pizza Kitchen, Classic Chevrolet The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B, the following uses may be considered only if sound treatment is included in building design: multi family apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The restaurant expansion is an appropriate use in this noise zone. A portion of the planned commercial center at the southwest corner is located within "Zone C" zone of greatest effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone C, industrial and commercial uses that can tolerate a high level of sound exposure are appropriate. The proposed restaurant is an appropriate use in this noise zone. The Master Plan designates the subject property as a commercial land use. effect on the promotion of health and the general welfare; effect on light and air; the effect on the overcrowding of the land; the effect on the concentration of population; the effect on the transportation, water, sewerage, schools, parks and other facilities-, and WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested conditional use permit should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been satisfied by the submission of evidence at a public hearing; and WHEREAS, the City Council further considered among other things the character of the existing zoning district and its peculiar suitability for particular uses and with the view to conserve the value of buildings and encourage the most appropriate use of land throughout this City; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the granting of this conditional use permit, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and WHEREAS, the City Council of the City of Grapevine, Texas, does find that the conditional use permit lessens the congestion in the streets, helps secure safety from fire, panic and other dangers, prevents the overcrowding of land, avoids undue concentration of population, facilitates the adequate provisions of transportation, water, sewerage, schools, parks and other public requirements; and WHEREAS, the City Council of the City of Grapevine, Texas, has determined that there is a necessity and need for this conditional use permit and has also found and 2 .......... Section 2. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas. to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000-00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
