' Tate Avenue and is proposed to be platted as Lot Hall -Johnson Sy�6� ADP a 11 R, Block 1, Towne Center Addition #2. The site r--- o contains 1.3345 acres and the entire Planned m Glade Rd. ;, 1 1 Commercial Center contains approximately 62.47 =I acres. The subject property has approximately 223.48 feet of frontage along William D. Tate Avenue. REQUESTED ZONE CHANGE/CONDITIONAL USE AND COMMENTS: The applicant is requesting a Conditional Use Permit to amend the approved site plan of CU99-63 (Ord. No. 99-166) for a planned commercial center, specifically to develop a 4,448 sg. ft. bank. The applicant is proposing the development of a 4,448 square foot Bank One with four drive through lanes. Sheet 1 of the exhibits indicates that a fifty -foot landscape buffer will be located along both William D. Tate Avenue and Ira E. Woods (S.H. 26). This was approved with the last conditional use, CU99-63. The planned commercial center complies with the landscape regulations with this new submittal as well. 0:/ZCu/C000-11.4 1 March 22, 2000 (9:05AM) PRESENT ZONING AND USE: The property is currently zoned "CC", Community Commercial District with a Planned Commercial Center designation, HISTORY OF TRACT AND SURROUNDING AREA: The subject property was zoned "C-2" Community Business District prior to the 1984 City Rezoning. The tract was platted as the Towne Center Addition in 1986. The addition was replatted twice in 1989. Conditional Use Permit CU89-15 for a Planned Commercial Center to be developed as four lots with three restaurants (Lubys, Arby's and International House of Pancakes) and one retail center, was approved in 1989. A one-year extension of CU99-15 was approved in December 1990. CU91-19 for both a Jack in the Box Restaurant and an amendment to the approved site plan of Luby's Cafeteria was approved in 1991. CU93-05, approved in 1993, again amended the approved site plan and sign for Luby's Cafeteria. CU95-02 (Ord. No. 95-10) was approved in February, 1995, allowing the possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer and wine only) in conjunction with an existing restaurant for Jason's Deli. The Towne Center Addition 11 which contains 62.47 acres, was rezoned in 1992 (Z92-09 and CU92-23) from "PCD" Planned Commerce Development District to "CC" Community Commercial District with a conditional use permit for a planned commercial center which brought forward the development of the Target store. In 1994, the site plan was amended to include Ross Dress for Less, Barnes and Noble, Famous Footwear, and Showcase Hallmark (CU94-31, Ord. No. 94-100). In 1995 the master site plan was amended again to allow for the development of Linens N' Things on Lot 4R-1 with Mattress Giant and Chesapeake Bagel on Lot 5 (CU95-16). In 1996, the site plan was modified to develop retail space for Barbecue's Galore and Coleman Spas on Lot 9 (CU96-20), Office Depot and Cost Plus on Lot 6R (CU96-29), and a 20,000 square foot retail building on Lot 7 that houses Chuck's Hamburgers, Haltom's Jewelers, and Busybody Home Fitness (CU96-36). CU99-06 allowed the development of a 6,581 square foot restaurant (Mimi's Caf6) with the possession, storage, retail sale, and on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) along with an attached 3,295 square foot retail building. Section 2. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future-, to lessen congestion in the streets, to secure safely from fire, panic, flood and other dangers-, provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. ORD. NO. 3 Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein- shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained. This site has access to William D. Tate Avenue to the east and Ira E. Woods Avenue to the north. 2. William D. Tate Avenue is a four -lane, divided street within a variable width right-of-way. Ira E. Woods Avenue is a five -lane, undivided street within a variable width right-of-way. 3. There is no additional right-of-way dedication required at this time. 111. STORM DRAINAGE SYSTEM: 1. There are existing storm drain systems in William D. Tate Avenue and Ira E. Woods Avenue. There is also a detention facility approximately 500' west of this site that drains north under Ira E. Woods Avenue to the Farris Branch East watershed. 2. An approximate 5 acre portion of this site at the northwest corner of the proposed Lot 12 drains west to the existing detention facility. An approximate 7 acre portion of this site at the northeast corner of this site drains to the storm drain system in Ira E. Woods Avenue. The remainder of this site drains southeast to the storm drain system in William D. Tate Avenue. 3. The developer is proposing to extend storm sewer from the system in William D. Tate Avenue to serve Lot 11 R. With the future development of Lot 12, the developer will be required to extend an on site storm sewer system adequate to serve the development. 4. The developer will be required to design for on site and off site drainage in accordance with the City of Grapevine Code of Ordinances. IV. WATER SYSTEM: 1 There is an existing water line on the west side of William D. Tate Avenue that consists of 12" pipe from the southern end of this site to Ball Street and 24" pipe to Ira E. The existing water distribution system is adequate to serve the development of Lot 11 R.
