SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA23-15

BACKGROUND INFORMATION:
The City Council at their November 21, 2023 meeting approved the first reading of an
ordinance, conditional use permit CU23-21 to allow for a 2,056 square foot training area
expansion along the southern elevation to the existing fitness studio specializing in mixed
martial arts.
The subject property is developed as a 10,620 square foot free-standing commercial
building on a 52,124 square foot (1.196 acre) lot. The property was developed in 1948 and
is platted as Lot 1R, Starnes Addition. The zoning district for the subject property after the
time of development was “C-2”, Community Business District and the property was rezoned
to “HC”, Highway Commercial District in the 1984 City-wide Rezoning.
The application was submitted by Shawna Mohler, property owner.
REQUEST:
The applicant is requesting a conditional use to allow for a 2,056 square foot training area
expansion along the southern elevation to the existing fitness studio specializing in mixed
martial arts.
The following special exception is requested:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing commercial structure to
remain as developed with an expansion and to allow exceptions to Section 53,
Landscaping Regulations.
ATYPICAL CONDITION:
Staff finds that an atypical condition exists for the requested special exception. Specifically,
the subject property is an existing lot that was developed in 1948 prior to the rezoning of
the property in the 1984 City-wide Rezoning from “C-2”, Community Business District to
“HC”, Highway Commercial District. Currently and as proposed, the site is not compliant

with Zoning Ordinance (82-73) relative to the requirements in Subsections 53.H.1, Interior
Landscaping, 53.H.2, Perimeter Landscaping, and 53.I, Non-Vehicular Open Space. The
lot is 4.4% below the required total for maximum impervious area and minimum open
space. The proposed expansion does not exacerbate the current conditions of the site.
Highway Commercial District Required Existing
Total Open Space 7,818 square feet/ 15% 5,549 square feet/ 10.6%
Total Impervious Area 44,306 square feet/ 85% 46,575 square feet/ 89.4%
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment:
Approve a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73,
Subsections 43.E.3, Nonconforming Uses and Structures and Subsections 53.H.1, Interior
Landscaping to allow the existing commercial structure to remain as developed with an
expansion and to allow exceptions to Section 53, Landscaping Regulations as shown on
the plot plan.

summary table, etc.
• Enlarge labels so that they are legible on 11” x 17”.
• Remove notes 1 & 2.
