HomeMy WebLinkAboutItem 14 - Cut-Through TrafficITEM 0 MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: ROGER NELSON, CITY MANAGER* MEETING DATE: MARCH 6, 2001 SUBJECT: CUT -THROUGH TRAFFIC BETWEEN STREETS RECOMMENDATION: City Council to approve an ordinance prohibiting cut -through traffic on property located between two streets or highways in Grapevine. FUNDING SOURCE: No funds required. BACKGROUND: The State Transportation code prohibits cut -through traffic from occurring at intersections. However, there are instances where the Police Department needs to prohibit cut -through traffic at locations not at an intersection. The school property (football stadium and administration building) between Highway 26 and Mustang Drive is an example of cut -through traffic problems we want to prohibit. In order to legally cite drivers using private property such as driveways, parking lots, business or residential entrances for cut through purposes it is necessary to adopt the attached ordinance. March 1, 2001 (9:54AM) • we A • AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE CODE OF ORDINANCES CHAPTER 23 TRAFFIC, ARTICLE 11 OPERATION OF VEHICLE, SECTION 23-34 REGARDING PROHIBITED TURNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the vehicular crossing of private or public property for the purpose of avoiding traffic or intersections can result in serious risk to the public health and safety. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Chapter 23 Traffic, Article 11 Operation of Vehicle, Section 23-34(c) is hereby amended in its entirety to read as follows: %N(c) Vehicles turning over or crossing a sidewalk, driveway, parking lot, or business or residential entrance to turn right or left from one street or highway to another is prohibited. Lack of intent is not a defense to this violation. - Section 3. That Chapter 23, Article 11, Section 23-34 is hereby amended by the addition of subsection 23-34(d) to read as follows: -(d) The city manager, or his agent, is hereby authorized to have proper traffic signs erected, constructed and placed at such points and along all streets covered by this section. - Section 4. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
