DISCUSS PRCIPOSED AMENDMENTS TO APPENDIX D �,..� CC}MPREHENSIVE ZC}NING URDINANCE NO. 82-73 SECTION 12 DEFINITIONS AND SECTlON 52 TREE PRESERVATION 09/21/99 � Development Services Director Hardy briefed the City Council and Planning & Zoning Commission regarding proposed amendments to Appendix D, Section 12 Definitions �„�, relative to Item 70 Customary Home Occupation to redefine the current definition to reduce/eliminate the problems that exist relative to home-based businesses. Mr. Hardy reviewed the proposed amendments to Appendix D, Section 52 Tree Preservation relative to restricting the removal of trees in drainage easements and the mitigation of tree removal, both authorized and unauthorized. There was no action taken by the City Council or the Planning and Zoning Commission. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding (A) pending or contemplated litigation relative to public safety jurisdiction issues at Dallas/Fort Worth International Airport and (B) conference with City Manager and Staff to receive information relative to economic development prospects under Sections 551.071 and 551.075, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Roger Nelson stated there was no action necessary relative to (A) pending or contemplated litigation , relative to public safety jurisdiction issues at Dallas/Fort Worth International Airport and (B) conference with City Manager and Staff to receive information relative to economic �,,,, development prospects under Sections 551.071 and 551.075, Texas Government Code. 09/21/99 NOTE: City Council continued with the Regular City Council meeting in open session in the Council Chambers. City Council and Planning &Zoning Commission to conduct a public hearing relative to Zoning Application Z99-13 filed by The Cumberland Fund requesting rezoning of approximately 52.8 acres from "PID" Planned Industrial Development District to "CC" Community Commercial District Regulations for a mixed use retail, hotel and restaurant development. The subject property is located at 1701 State Highway 26. 7. City Council and Planning &Zoning Commission to conduct a public hearing relative to Conditional Use Application CU99-38 and application for the final plat of Lots 5R and 6R, Ruth Wall No. 2 Addition being a replat of Lots 5 and 6. The applications were filed by King Arthur's Convenience Store with the conditional use application requesting to amend the site plan approved by Ordinance No. 94-49 for a drive through convenience store with the possession, storage, retail sale and off-premise consumption of alcoholic beverages (beer and wine only) to allow retail expansion and the addition of gasoline sales. The subject property is located at 1600 Fairway Drive and is zoned "GU" Governmental Use District Regulations. 9. City Council and Planning & Zoning Commission to conduct a public hearing relative to the application filed by Ms. Bobanne Richardson for the final plat of Lots 30R1 and 31 R, Block 2, Hidden Lake Estates, Phase Two being a replat of Lot 30R, Block 2. The 0.5682 acre property is located on the south side of White Oak Lane, east of Hidden Lake Drive and is zoned "R-7.5" Single Family District Regulations. 10. REQUEST FOR FUTURE COUNCIL ITEMS City Attorney John F. Boyle, Jr. addressed the City Council regarding House Bill 156 that � amended the Open Meetings Act to expand the definition of a meeting to include a governmental body receiving information from, giving information to, asking questions of, or receiving questions from any third person. He noted that the broadened definition of "rneeting" brought into question the Citizen Comment section on the City's City Council agenda due to the fact that such participation on items which were not included on the meeting's posted agenda appears to be included in the definition, thereby prohibiting such participation. Mr. Boyle stated the Tarrant County District Attorney has sought a clarification of this issue from the Attorney General and it is probable that the Attorney General will rule to allow the practice of citizen participation items to continue without a posting requirement. Until an opinion is issued by the Attorney General, Mr. Boyle recommended the Citizen Comment section be eliminated from all agendas and limited to Request for Future Council Items. He noted the City's standard policy is that if the public hearing for a zoning case has been closed, it is not permissible to allow additional testimony. Mr. Boyle noted there had been Citizen Comment forms submitted tonight to address the City Council and only the ones addressing items on the posted agenda would be allowed to make comments tonight. GERRY LEMOND Ms. Gerry Lemond, 1259 West Hudgins, speaking on behalf of her parents that reside on Lucas Street, requested the City Council not eliminate parking of recreation vehicles on the City's right-of-way. She requested the City Council consider a grandfather clause to the proposed ordinance for those that have been parking their recreational vehicles in streets for years. ITEM 10C. MR. JEROME LAGALY Mr. Jerome Lagaly, 3618 Grandview Drive, commented he could not address the Council as he wanted to speak regarding parking in residential districts and that public hearing was closed. ORDINANCE, CHAPTER 23 TRAFFIC, ARTICLE VI, COMMERCIAL AND OTHER OVERSIZED VEHICLES This item was discussed after Item 37. City Manager Nelson recommended approval of an ordinance amending the Grapevine _ , Code of Ordinances, Chapter 23 Traffic, Article VI, Commercial and Other Oversized Vehicles prohibiting parking in the City rights-of-way of commercial vehicles, oversized vehicles and trailers. The ordinance includes exclusions for those vehicles whose � ' operators are carrying out standard, expeditious business activities that happen daily all 11 09/21/99 over the community. The ordinance also allows for parking of boats and recreational vehicles on the street for a four-hour period. Mr. Nelson reported that enforcement of the ordinance will be by the Police Department. He advised that City Staff has discussed at length the ramifications of this ordinance and recognizes that several citizens will be affected. Therefore, enforcement of this ordinance will be delayed for 60 days to let citizens know how these new requirements affect them. Discussion ensued relative to the permit that allows parking on a paved surFace have a map attached as an exhibit depicting the approved parking location. It was noted that the City's parking permit would not supercede any deed restrictions or covenants in place for any subdivision. It was also discussed that the 4 hours allowed parking in the street be extended to 24 hours to allow adequate time to load/unload a vehicle for a trip. Mr. Gaither advised that the project to be constructed is an 18-hole golf course with clubhouse facility, which incorporates a Dallas Cowboy's theme. The golf course will include a Class A golf course, practice facilities, maintenance facilities, and a clubhouse of the highest quality design and operation. He noted this project is the first of its kind for any National Football League Team and it will put the Cowboys and Grapevine in the forefront of sports facilities in North Texas. The golf course and clubhouse will be open to the public as a daily fee course. The course and facilities will be constructed entirely by Grapevine Golf Club, L. P. with no public monies in the project. The golf course also will be constructed in compliance with all current environmental regulations.
