SUBJECT: EASEMENT ABANDONMENT — LOTS 1 & 2, BLOCK 1,
GRAYSON/121 ADDITION
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 24 -foot wide mutual access
easement located along Grayson Drive in Lots 1 and 2, Block 1, Grayson/121 Addition,
and take any necessary action.
BACKGROUND INFORMATION:
The owners of Lots 1 and 2, Block 1, Grayson/121 Addition have requested that the 24 -foot
mutual access easement be abandoned. The owners of the lots no longer require this
access easement for accessibility between the individual lots. This mutual access
easement is not currently incorporated into the existing site plan of Skatetown or the
approved site plan for D/FW Honda.
Cross access is provided between these two lots at another location and does not require
this easement.
Staff recommends approval.

EXHIBIT 1
BEING a tract of land situated in the J.R. Stephens Survey, Abstract No. 1490, Tarrant County, Texas,
and being a portion of a tract of land described by deed to Federal Deposit Insurance Corporation as
recorded in Volume 10512 Page 1166 of the Deed Records of Tarrant County, Texas, same tract being
known as an ingress/egress easement as shown across Lot 1 and Lot 2 of Grayson/121 Addition, an
addition to the City of Grapevine, as recorded in Cabinet A, Slide 1958 of the Map Records of Tarrant
County, Texas, and being more particularly described as follows:
COMMENCING at the northwest corner of said Lot 1, and the southwest corner of Charter Hospital
Addition, an addition to the City of Grapevine, as recorded in Cabinet A, Slide 46 of the Map Records of
Tarrant County, Texas, same being in the easterly line of Grayson Drive (70 foot right-of-way);
THENCE South 03°09'42" East, with the west line of said Lot 1, and the easterly line of said Grayson
Drive, a distance of 167.09 feet to the POINT OF BEGINNING;
THENCE over and across said Lots 1 and 2 the following courses and distances:
-North 89°40'33" East, a distance of 62.57 feet to a point for corner-,
-South 03°33'28" East, a distance of 100.64 feet to the beginning of a tangent curve to the left
having a radius of 38.00 feet;
-Along said curve to the left, an arc length of 27.54 feet to a point for corner;
-South 45'04'15" East, a distance of 125.19 feet to a point for corner;
-South 40°39'53" West, a distance of 78.77 feet to a point for corner in the easterly line of said
Grayson Drive, same being at the beginning of a non -tangent curve to the right having a radius of
300.00 feet -
THENCE Along the easterly line of said Grayson Drive, and with said curve to right having a chord
bearing of North 49°33'54" West, a chord length of 24.00 feet and an arc length of 24.01 feet to a point
for corner;
THENCE over and across said Lots 1 and 2 the following courses and distances:
-North 40°39'53" East, a distance of 56.59 feet to a point for corner;
-North 45'04'15" West, a distance of 102.91 feet to the beginning of a tangent curve to the right
having a radius of 62.00 feet;
-Along said curve to the right, an are length of 44.92 feet to a point for corner;
-North 03°33'28" West, a distance of 77.96 feet to a point for corner;

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
TWENTY-FOUR FOOT MUTUAL ACCESS EASEMENT IN
THE CITY OF GRAPEVINE, TEXAS AS HEREINAFTER
DESCRIBED; PROVIDING A SEVERABILITY CLAUSE;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owners of Lot 1 & 2, Block 1, Grayson/121 Addition,
recorded in Cabinet A, Slide 1958, Plat Records of Tarrant County, Texas, the property
containing a twenty-four foot (24') mutual access easement, more specifically described
in Exhibit "A" attached hereto and incorporated herein for all purposes, has requested the
mutual access easement, as herein after described be abandoned and vacated; and
WHEREAS, the mutual access easement is not needed for public use and will not
be needed in the future for public use; and
WHEREAS, abandoning and vacating the said mutual access easement will relieve
the City of Grapevine, Texas from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the mutual access easement located within the property
described in Exhibit "A", attached hereto and incorporated herein for all purposes, is hereby
abandoned and vacated for public use and the same is hereby abandoned and vacated
insofar as all public right, title, interest in and to said mutual access easement is
concerned.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the mutual access easement is no longer needed by the
public for public usage and would create a hardship or burden upon the City of Grapevine
to keep open and maintain such mutual access easement creates an urgency and an
emergency for the immediate preservation of the public health, safety, and general welfare
which requires that this ordinance shall take effect immediately from and after its passage
and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 17th day of April, 2001.
