All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please add case number CU08-33 to the signature block, as shown
below, to all sheets and label the sheet numbers in consecutive
order.
2. Please rotate the site plan/landscape plan, placing north at the top
of the page and also delete the contour lines from the site plan.
3. Please dimension on the site plan the distance of the proposed pole
sign to the nearest property line. The minimum required setback is
ten (10) feet. Please show the depth of the proposed pole sign
cabinet on sheet PA -5.
4. Please dimension a typical parking space and include an internal
traffic circulation plan on the site plan.
5. Please provide in a tabular/chart format the landscaping
requirements found in Section 53.H.1&2 and I, Interior, Perimeter
and Non -vehicular Open Space respectively, of the City of
Grapevine Zoning Ordinance (the Ordinance).
6. Please add the following note to the face of the site plan: All the
requirements of the Grapevine Soil Erosion Control Ordinance shall
be met during the period of construction.
7. Please designate a refuse storage area on the site and landscape
plans. All users are required to show the location and
screening of a dumpster whether it is used or not. Please label
the material used for the screening including the gate. Please label
on the landscape and site plans the material and height of the
screening fence on the south side of the site adjacent to Bear Run
Drive.
8. Please provide in a tabular/chart format the kind of building material
used for the existing and proposed structure and please include the
percentage of masonry used on the entire structure excluding doors
and windows. Please dimension the existing building on the site
plan and label the material used on the elevations.
9. Any area of the site which is proposed for outdoor storage needs to
be designated on the site plan. Please provide an elevation or
details, including material used for the overhead shading system.
Please add a note on the site plan the lighting levels at the property
line will not exceed 3.0 footcandles.

11. Please add the following note to the site plan:
Conditional Use CU08-33 is a request to allow outside storage in
conjunction with a garden and pet supply store and a 20 -foot pole
sign.
The above comments must be reflected in the revised submittal,
which is due by Tuesday, November 25th for the December 16, 2008
joint public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
one (1) colored rendering of the elevations and landscape plan on 11" x
17" sheet or a digital version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, December 16, 2008 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU08-33 — MARSHALL GRAIN COMPANY - submitted by Marshall Grain Company for
property located 3535 William D Tate Avenue and platted as Lot 1, Block F, Bear Run
Addition. The applicant is requesting a conditional use permit to allow outdoor storage in
conjunction with a garden and pet supply company and a 20 foot pole sign. The property is
zoned "CC" Community Commercial and is owned by Grapevine Nursery.
SU08-05 — CHESAPEAKE ENERGY - submitted by Chesapeake Operating, Inc. for
property located at 3740 Euless -Grapevine Road and proposed to be platted as Lot 1,
Block 1, A C Stone Addition. The applicant is requesting a special use permit to allow gas
well drilling and production in a nonresidential district. The property is zoned "PID" Planned
Industrial Development and is owned by Curnes Partners, LP.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

Bear Run Townhome Association consists of 12 residences and is located directly
adjacent to the property located at 3535 William D. Fate Avenue with application being
submitted by Marshall Grain, Company.
This response is a unified declaration from all property owners of Bear Run Townborne
Association which includes addresses of 3600, 3601, 3602, 3603, 3604, 3605, 3606,
3607, 3608, 3609, 3610, and 3611.
The following conditions should be met prior to approval of Marshall Grain Company's
application for permit at said location:
1. There are no other pole signs on any of the other business in the immediate area
and installation of the pole sign is based on approval of the City issuing a
"Conditional Permit". We object because approval of the "Conditional Permit" and
installation of the pole sign could and will lower our property value.
2. Since we have no idea of what the outdoor storage will consist of, we request that
the screening fence be masonry. If this is not possible, then a wood fence, board on
board, 8 feet tall, should be constructed to ensure noise and trash containment. We
are pleased that the dumpster is being relocated per the site plan. The dumpster
area should have masonry or wood screening on all sides, especially any side which
is visible from the street.
3. Rear gate should also be wood or other material to ensure that the storage area
and/or any dumpsters inside the property will not be visible from the street.
4. Gates should remain closed. If the rear gate is used for deliveries, no trucks
should be allowed to use Soft Wind Court or the alleyway behind any of the Bear
Run Townhomes as an approach entrance to the rear gate.
5. Deliveries should only be allowed during business hours (we had that issue with,
Calloways) — with residence bedroom facing the delivery area, noise is a problem
after business hours.
6. Rodent problem - after Calloways left we were overrun with huge field
mice. With this type of business, expectation of rodent problem will be more
significant.
7. No small animals, e.g. chickens or various small animals should not be sold from
this property. We are concerned with the potential odors associated with housing
animals such as chickens. If approved to sell small animals, what are the operating
plans to control the odor from any stored products and/or any small animals?
In summary, we question what this type of business will do to the value of our
property. Previous occupant, Calloways, was thought of as a neighborhood nursery,
this business is more of an animal supply/feed store.

The subject property is located at 3525 William D.
Tate Avenue and is platted as Lot 1, Block F, Bear
Run Addition. The addition contains 3.997 acres and
has approximately 541 feet of frontage along the
northbound service road of William D. Tate Avenue
and 627 feet of frontage along Bear Run Drive.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow outside storage and a 20 -foot
pole sign in conjunction with a garden and pet supply company.
The applicant proposes to utilize the former Calloway's Nursery site to establish the
Marshall Grain Company. Marshall Grain intends to sell plants, garden and pet supplies in
a retail store/greenhouse containing 22,000 square feet. Approximately 41,500 square feet
of space behind the store will be utilized as an outdoor display storage area, a portion of
which will utilize an overhead shading system to shade merchandise. The outdoor display
area will be screened by a six foot wooden fence adjacent to Bear Run Drive. The
applicant also proposes erecting a 20 -foot pole sign south of the main entrance along
William D. Tate Avenue.

PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is developed with
a single story commercial structure formerly occupied by Calloway's Nursery.
The City Council on October 18, 1983 rezoned the subject site from "I-1" Light Industrial
District to "S -P" Site Plan District (Z83-35/Ord. 83-65) for commercial uses. At the
Council's December 16, 1986 meeting the subject property was rezoned to "CC"
Community Commercial District (Z98-17/Ord. 86-76). The property to the north was zoned
14' Light Industrial District before the 1984 City Rezoning. At the May 5, 1998 City
Council meeting Conditional Use Permit CU98-13 was approved which allowed outside
storage in the "PID" Planned Industrial Development District in conjunction with a U -Haul
Storage and truck leasing facility. At the Council's December 16, 1986 meeting the site to
the south was rezoned to "R-TH" Townhouse District (Z98-17/Ord. 86-76). At the March
22, 1994 City Council meeting the site to the east, known as Bear Creek Park, was
rezoned to "GU" Governmental Use District (Z94-02/Ord. 94-25).
SURROUNDING ZONING AND EXISTING LAND USE:

This letter is to verify that your request for a conditional use permit to allow outside storage
and a 20 -foot pole sign in conjunction with a garden and pet supply company on property
located at 3525 William D Tate Avenue and is platted as Lot 1, Block F, Bear Run Addition
was approved by City Council on December 16, 2008 as shown on the approved site plan
with the condition that the pole sign be moved to a location north of a projected line
perpendicular to the right-of-way from the southwest corner of the greenhouse. A copy of
Ordinance 2008-75 and a copy of the approved site plan are enclosed.
On December 16, 2008, the Planning and Zoning Commission recommended the City
Council approve the request.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit or Planned Development Overlay shall be valid for a period
longer than one (1) year from the date on which the City Council grants the Conditional
Use Permit or Planned Development Overlay, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an

RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU08-33 (Ord. 08-75) approved at the December 16, 2008
meeting to allow outside storage and a 20 -foot pole sign in conjunction with a garden
and pet supply company, specifically to establish the location of a new pole sign, and
take any other action necessary.
At the December 16, 2008 meeting Council approved on the subject site a 22,000
square foot retail store/greenhouse (Marshall Grain Company) with 41,500 square feet
of outdoor display and storage area. A condition of approval of the original request was
the pole sign be moved from the original proposed location, south of the greenhouse to
a location north of the southwest corner of the greenhouse.
With this request the applicant proposes to erect a 20 -foot high, 108 square foot pole
sign north of the southwest corner of the greenhouse. Please see the attached plans.

The proposed Marshall Grain store will be similar to the Calloway's store that preceded it
in this location. It will serve many of the same customers. Calloway's sold garden
supplies and plants, as will we. We will just have a higher percentage of garden supplies
and a lower percentage of plants. In addition we will offer some other categories,
primarily pet food and supplies. We plan to offer an attractive, but down-to-earth
shopping environment where customers can wander through all of our departments. Our
customers will be able to shop the entire store and pick up merchandise themselves
whether they're looking for a dog collar, a bag of cat food, 5 flats of pansies, or 20 bags
of organic fertilizer. We will also offer delivery of merchandise to customers' homes.
When we are fully ramped up, we expect to employ 20 to 25 people in the Grapevine
store.
The outward appearance of the store and traffic patterns should not differ significantly
from those observed with the previous store. The only change in outward appearance th
we propose is the addition of a pole sign. This store should certainly cause no harm to t
value or enjoyment of surrounding properties. I
