when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

WHEREAS, Wood Golden, Ltd. is the owner of a 0.9280 acre tract of land located in the William
Bradford Survey, Abstract No. 131, in the City of Grapevine, Tarrant County, Texas and being part
of that certain tract of land conveyed to Trinity Industries, inc., by deed recorded in Volume 9720,
Page 1557, Deed Recorded, Tarrant County Texas, and being more particularly described as
follows:
BEGINNING, at a 5/8 -inch iron rod found for corner, said point being located on the north right-
of-way line of State Highway 114 (S.H. 114 - variable width R.O.W.) and also being the southeast
corner of Lot 1, Block 1, of Grandys of Grapevine, an addition to the City of Grapevine according
to plat recorded in Volume 388-214, page 33, P.R.T.C.T.;
THENCE, North 00 degree 05 minute 17 second West, leaving the north line of S.H. 114, and
with the east line of the Grandy's of Grapevine tract, passing at 266.27 feet a 5/8 -Inch iron rod
found for the northeast corner of same, continuing, in all, a distance of 275.05 feet to a 5/8 -inch
Iron rod with "Gonzalez & Schneeberg" cap found for corner, said point being the beginning of a
non -tangent curve to the left having a radius of 835.00 feet;
THENCE, with said curve to the left, through a central angle of 00 degree 38 minute 24 second, an
arc distance of 9.33 feet (chord bears South 84 degree 37 minute 57 second East, 9.33 feet) to a
5/6 -inch Iron rod with "Gonzalez & Schneeberg" cap found for the end of said curve;
THENCE, South 84 degree 57 minute 09 second East, a distance of 138.27 feet to a 5/8 -inch iron
rod with "Gonzalez & Schneeberg" cap found for corner;
THENCE, South 00 degree 05 minute 17 second East, a distance of 275.00 feet to a 5/8 -inch iron
rod with "Gonzalez & Schneeberg" cap found for corner, said point being located on the
aforementioned north line of S.H. 114;
THENCE, North 84 degree 57 minute 09 second West, with the north line of S.H. 114, a
distance of 147.59 feet to the POINT OF BEGINNING and containing 40,425 square feet or 0.928
acres of land, more or less.

LAVA LOUNGE
1. Based upon the square footage of the dining areas the occupant load has
been determined to be 189. The required parking for determined
occupant load is 66 spaces rendering the site approximately 23 spaces
deficient. The current level of parking is not sufficient to accommodate the
proposed use.
2. A minimum of ten feet is required for off-street parking adjacent to
property lines (Section 53.H.2.b., Zoning Ordinance). One of the two
proposed parking spaces adjacent to the west property is within the
required buffer and must be removed.
3. Please number sheets in consecutive order and add case number CU08-
19 to the signature block of all sheets.
4. Please include a table on the landscape plan sheet which details required
and provided interior, perimeter and non -vehicular open space
requirements. Please see Section 53.1-1.1. and 2. and 53.1 of the Zoning
Ordinance for the landscape requirements.
5. The City of Grapevine has adopted the 2006 International Fire Code.
Based on the adopted code, the room addition will require a fire sprinkler
system for the entire premises. Please contact Craig Reed at (817) 410-
8100 for questions regarding sprinkler systems.
6. Please add the following notes to the site plan:
a) Conditional use request CU08-19 is a request to amend the
previously approved site plan of CU99-76 (Ord. 2000-11) for a
drive through restaurant and a 40 -foot pole sign, specifically to
eliminate the drive through window and allow the possession,
storage, retail sale and on -premise consumption of alcoholic
beverages (beer, wine and mixed beverages) along with a
2,222 square foot addition in conjunction with a restaurant.
b) The entire site is the premises.
7. The projecting sign (Lave Lounge) attached to the south building elevation
is not permitted in the Community Commercial District. Please see
Section 60.H.1.b. of the City of Grapevine Zoning Ordinance regarding the
restriction.
8. A driveway permit was issued by TX DOT for a joint use drive between
this site and the adjacent site to the east (Kinko's). The permit has since
expired. If you are interested in pursuing this access drive please contact
Scott Dyer in Public Works at (817) 410-3136 for information regarding the
drive.
9. Please provide a copy of the approved plat of the subject property. The
boundary lines/dimensions of the plat and site plan must match.
10. Please add one column to the site summary chart showing the amount
required and provided: Height in stories and feet, percentage masonry,
total building area, total lot area, total impervious area (building and paved
area), and total open space (landscaped area).
11. Please label the existing refuse storage area on the site plan and label the
materials used and the height shown on the east elevation.
12. Please label the booth seating as shown on the floor plan.
13. Please note on the site plan that all the requirements of the Grapevine Soil
Erosion Control Ordinance shall be met.
14. Please add the following signature block, minimum size 3" x 4", to each
sheet.

scheduled for the next available agenda.

On Tuesday evening, September 16, 2008 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
Z08-07 — SKINNER CUSTOM HOMES - submitted by Skinner Custom Homes for property
located at 410 North Dove Road and platted as Lots 5A, 513, and 6 Block 7, WC Lucas
Addition. The applicant is requesting to rezone 1.38 acres from "R-7.5" Single Family
Residential to "R-5.0" Zero -Lot -Line Residential for the development of six lots. The
property is owned by Star Bible Publishing.
CU08-17 — GAYLORD TEXAN - submitted by Gaylord Hotels for property located at 1501
Gaylord Trail and platted as Opryland Addition. The applicant is requesting a conditional
use permit to amend the previously approved site plan, specifically for the addition of a
resort pool complex, food and beverage pavilion and an event pad site. The property is
zoned "PCD" Planned Commerce Development and is owned by Gaylord Hotels.
CU08-19 — LAVA LOUNGE - submitted by Guan Tan for property located at 401 East
State Highway 114 and platted as Lot 3, Block A, Trinity Industries Addition. The applicant
is requesting a conditional use permit to amend the previously approved site plan,
specifically to enlarge the existing structure and allow the possession, storage, retail sale
and on -premise consumption of alcoholic beverages (beer, wine and mixed beverages) in
conjunction with a restaurant. The property is zoned "CC" Community Commercial and is
owned by Wood Golden Ltd.
CU08-20 - GREAT WOLF LODGE - submitted by Great Wolf Lodge of Grapevine for
property located at 100 Great Wolf Drive and platted as Lot 1 R, Block 1 R, Great Wolf
Addition of Grapevine. The applicant is requesting a conditional use permit to amend the
previously approved site plan, specifically to allow additional parking and an exterior
elevation change. The property is zoned "CC" Community Commercial and is owned by
Great Wolf Lodge of Grapevine LLC.
CU08-22 — GOODWILL INDUSTRIES - submitted by Goodwill Industries for property
located at 2100 West Northwest Highway and platted as Lot 2, Grapevine Plaza Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan for a planned commercial center, specifically to establish a retail store and drop-off
donation center for Goodwill Industries. The property is zoned "SP" Site Plan and is owned
Old
by Goodwill Industries.
FUTURE LAND USE MAP II UPDATE MP08-02 - amending the Official City of Grapevine
Future Land Use Map II for properties located on Starnes Street and platted as Lots B, C,
L, M and N, J J Hall Addition and the north portion of Lot 1 R, Starnes Addition from "CO"
Commercial and "RM" Residential Medium Density to "LC" Commercial Light Intensity. The
property is owned by multiple owners.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve
the request.
Purpose of Request:
The public hearing is to consider an application submitted by Guan Tan for property
located at 401 East State Highway 114 and platted as Lot 3, Block A, Trinity Industries
Addition. The applicant is requesting a conditional use permit to amend the previously
approved site plan, specifically to enlarge the existing structure and allow the possession,
storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) in conjunction with a restaurant. The property is zoned "CC" Community
Commercial and is owned by Wood Golden Ltd. A copy of the site plan is on file with the
Department of Development Services.

Airport staff has reviewed the proposed application submitted by Guan Tan for
property located at 401 East State Highway 114 requesting a conditional use permit to
amend the previously approved site plan to enlarge the existing structure and allow
the possession, storage, retail sale and on -premise consumption of alcoholic beverages
in conjunction with a restaurant.
We do not object to the proposed use if this zoning change is granted. The
applicant should be advised of their obligation under Federal Aviation Regulation to
notify the FAA of their intent and to seek a FAA airspace review.

PROPERTY LOCATION AND SIZE:
The subject property is located at 401 State Highway
114 East and is platted as Lot 3, Block A, Trinity
Industries Addition. The lot contains 40,425 square
feet. The property has 148 feet of frontage along the
Frontage Road of State Highway 114 East and 138
feet along Capitol Street.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU99-76 (Ord. 2000-11) for a drive-through restaurant and a 40 -foot pole sign
specifically to eliminate the drive through window and allow the possession storage retail
sale and on -premise consumption of alcoholic beverages (beer wine and mixed
beverages) along with a 2,010 square foot addition in conjunction with a restaurant
The applicant is proposing to expand the unoccupied former Burger King restaurant and to
establish a new restaurant with on -premise sales, consumption and storage of alcoholic
beverages. The applicant proposes a 2,010 square foot addition to the existing 3,500
square foot structure resulting in 5,510 square foot restaurant. The required parking of 46 -
spaces is being met. The drive-through of the former restaurant has been eliminated with

this request. The two signs shown on the site plan will utilize existing poles and will have
an area of 144 square feet and five square feet along the Highway 114 Service Road and
Capitol Street respectively.
PRESENT ZONING AND USE:
The subject property is currently zoned "CC" Community Commercial District and is
developed with an unoccupied restaurant.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in the 1984 City Rezoning to PCD, Planned Commerce
Development. Zone change request Z87-17 approved the existing "CC" Community
Commercial District. At the March 18, 1997 meeting a conditional use request (CU97-02,
Ord. 97-25) was approved for the Burger King on the subject site however the applicant
allowed the conditional use permit to expire. A conditional use request (CU99-76, Ord. 00-
11) for a drive through restaurant (Burger King) and a 40 -foot pole along the frontage of
State Highway 114 was approved at the February 15, 2000 meeting. Prior to the approval
of the Burger King the subject site remained undeveloped with the exception of the
adjacent Grandy's Restaurant and Kinko's/Fed Ex Copies.
The Chevron/McDonalds and properties to the north were rezoned from "S -P", Site Plan
zoning and "C-2", Community Business to "CC" Community Commercial District and "PO",
Professional Office District in the 1984 City Rezoning. The Chevron was renovated in
1990 in accordance with CU90-05. At the July 16, 1996 meeting a conditional use request
(CU96-16, Ord. 96-46) was approved the redevelopment of the Chevron/McDonald's
property allowing a convenience store with gasoline, off -premise alcoholic beverage sales,
and a car wash in conjunction with a restaurant. At the September 17, 1996 meeting a
conditional use request (CU96-27, Ord. 96-80) was approved a 40 -foot pole sign on the
Chevron/McDonald's site.
Grandy's Restaurant developed in 1987 and was required to rezone from "PCD", Planned
Commerce Development District to "CC" Community Commercial District due to the
minimum two acre lot size. A conditional use request (CU05-43, Ord. 2005-56) for a
planned commercial center (Epicentre at Grapevine) was approved at the July 19, 2005
meeting on the "PO" Professional Office District zoned property on the east side of South
Main Street north of Capitol Street. A conditional use request was approved at the March
21, 2006 meeting on the Epicentre site to establish a restaurant (Bob' Steak and Chop)
with on -premise consumption, storage and sales of alcoholic beverages (beer, wine and
mixed beverages). A conditional use request was approved at the December 19, 2006
meeting on the Epicentre site to establish a restaurant (Fireside Pies) with on -premise
consumption, storage and sales of alcoholic beverages (beer, wine and mixed beverages).
The Site Plan Review Committee (SPRC) at their August 27, 2008 meeting approved
conditional use request CU08-14 to allow outdoor seating for Fireside Pies. The former
First National Bank of Grapevine (presently Wells Fargo) was on November 11, 1995

rezoned (Z95-16, Ord. 95-89) from "PO" Professional Office District to "HC" Highway
Commercial District to accommodate the expansion of the former Payton -Wright
Dealership onto their property. The property to the south was rezoned from "PID" Planned
Industrial Development District to "CC" Community Commercial District. The property has
developed as the Super 8 Motel, National Tire and Battery, Schlotzsky's Restaurant and
Salt Grass Steakhouse.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "PO" Professional Office District - Baymont Motel
SOUTH: "CC" Community Commercial District - Salt Grass Steakhouse,
National Tire and Battery and Super 8 Motel
EAST: "CC" Community Commercial District and "PCD" Planned Commerce
Development District — Fed Ex/Kinko's and undeveloped
WEST: "CC" Community Commercial District - Grandy's
AIRPORT IMPACT:
The subject tract is located within "Zone A" Minimal Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land use. This request is
in conformance with the Master Plan.

storage, retail sale and on -premise consumption of alcoholic beverages (beer, wine, and
mixed beverages) along with a 2,010 square foot addition in conjunction with a restaurant

Addition was approved by the City Council on September 16, 2008. A copy of Ordinance
2008-49 and a copy of the approved site plan are enclosed.
On September 16, 2008, the Planning and Zoning Commission recommended the City
Council approve the request.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.
