At their May 2, 2016 meeting, the Board of Zoning Adjustment acted on the following
cases:
BZA16-09 — Jay Balding, 2424 Lakeshore Drive, legally described Tracts 1B, 1 D
and 11-111, Solomon Cate Survey, Abstract 2002
The Board approved the following request
Section 15.G.1, "R-7.5" Single Family District, Area Regulations requires a
minimum front yard setback of 30 -feet. The Board approved a variance of four -feet
(4') allowing a front yard depth of 26 -feet for an existing lot.
Section 15,G.2, "R-7.5" Single Family District, Area Regulations requires a
minimum rear yard setback of 25 -feet. The Board approved a variance of 12 -feet
allowing a rear yard setback of 13 -feet for an existing lot.
Section 15.G.5., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot depth of 100 -feet. The Board approved a variance of twelve -feet (12')
allowing a lot depth of 88 -feet for an existing lot.

Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
2828 Peninsula Drive, platted as Lot 3, Block 3, Placid -Peninsula as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically, the
subject site is an existing developed lot, and the existing structure was built in 1978. A
form survey of the subject site is unavailable within the permit records. The site is
noncompliant with the current Zoning Ordinance (82-73) relative to the required twenty five
foot rear yard setback adjacent to the east property line for the existing dwelling.
The owner intends to expand the existing dwelling from approximately 2,258 -square feet,
which includes an attached garage to approximately 2,992 -square feet by adding a 415 -
square foot garage expansion adjacent to the north property line and a 320 -square foot
carport attached to the front of the dwelling adjacent to Peninsula Drive. The proposed
garage expansion adjacent to the north property line and carport attached to the front of
the dwelling does not increase the level of non -conformity on the subject site. The
application was submitted by property owner Bradley Maciulelicz.

E. CHANGING NONCONFORMING USES:
1. Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.

My husband and I reside at 2823 Peninsula Drive, which is directly across the street for Brad and Beth
Maciulewicz's residence. We received notification about the variance hearing for their property on
Monday, April 28th. As we are unable to attend, I did want to let the City of Grapevine and the
Maciulewicz's know that we support the approval of the variance request. Peninsula Drive is a lovely
and unique area of Grapevine, and property improvements only benefit both the City and homeowners
in the long run.
