Consider Conditional Use Application CU10-11 (Hartnett's Mexican Grill)and make a recommendation to the City Council. 3. Consider Conditional Use Application CU10-12 (Gaylord Texan) and make a recommendation to the City Council. 4. Consider Conditional Use Application CU10-13 (Bottlecap Alley/Icehouse Grill)and make a recommendation to the City Council. 5. JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU10 -10 AND CU10 -11 - HARTNETT'S AMERICAN GRILL AND MEXICAN GRILL First for the Commission to consider and make recommendation to City Council was conditional use application CU10 -10 and CU10 -11 submitted by Ion Design Group for property located at 1265 and 1295 South Main Street and platted as Lot 1, Block 1, Epicentre at Grapevine Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU08 -28 (Ord. 08 -70) for a restaurant development specifically to allow the possession, storage, retail sale, and on- premise consumption of alcoholic beverages (beer, wine, and mixed beverages) outside speakers and outside dining in conjunction with two restaurants. 061510 1 P & Z JOINT PUBLIC HEARING JUNE 15, 2010 Mr. Bryan Klein and Mr. Paul Guernsey, representing the applicant and owner, were available to answer questions and requested favorable consideration. Discussion was held regarding the outdoor speakers and the distance from the residential area. Mr. Klein stated that the speakers were for ambient music in the courtyard area during restaurant business hours. Additional parking will be available from 6 pm to 3 am on the property to the east. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU10-10. Monica Hotelling seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Lowery, Hotelling, Fechter, and G. Martin Nays: None In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU10-11. Gary Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Lowery, Hotelling, Fechter, and G. Martin Nays: None CONDITIONAL USE APPLICATION CU10-12 - GAYLORD TEXAN Next for the Commission to consider and make recommendation to City Council was conditional use application CU10-12 submitted by Gaylord Hotels for property located at 1501 Gaylord Trail and platted as Opryland Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU09-15 (Ord. 09- 24) for a planned commercial center in conjunction with a hotel and convention center, specifically to allow outdoor speakers in conjunction with a fireworks viewing area. Ms. Angela Mitcham, representing the applicant, was available to answer questions and requested favorable consideration. Ms. Mitcham stated that the outdoor speakers and viewing area would be used in conjunction with the firework events held between May and September. Mr. Mike Morris representing the Northeast Neighborhood Association spoke in support of the application. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Jimmy Fechter moved to approve conditional use application CU10-12. Mark Lowery seconded the motion. After a brief discussion, 061510 2 JOINT HEARING JUNE i Jimmy Fechter moved to amend his motion to approve CU10 -12 with the condition that the outdoor speakers are allowed between May and September in conjunction with the Convention and Visitors Bureau firework displays, Mark Lowery seconded the amended motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Lowery, Hotelling, Fechter, and G. Martin Nays: None CONDITIONAL USE APPLICATION CU10 -13 & SPECIAL USE APPLICATION SU10- 05 - BOTTLECAP ALLEY/ICEHOUSE GRILL Next for the Commission to consider and make recommendation to City Council was conditional use application CU10 -13 and special use application SU10 -05 submitted by Cencor Realty Services for property located at 1469 West State Highway 114 and platted as Lot 7, Block 1, Towne Center Addition No. 2. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU96 -36 (Ord. 97- 08) for a planned commercial center, specifically to allow the possession, storage, retail sales and on- premise consumption of alcoholic beverages (beer, wine and mixed beverages) and a monument sign in conjunction with a restaurant. The applicant was also requesting a special use permit to allow for the use of one billiard table. Mr. Greg Colchin, the applicant, was available to answer questions and requested favorable consideration. Mr. Larry Marshall, the business owner, stated that he is the founder of Cotton Patch and this will be the first location for this concept. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Monica Hotelling moved to approve conditional use application CU10 -13. Herb Fry seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Lowery, Hotelling, Fechter and G. Martin Nays: Wilson In the Commission's deliberation session, Monica Hotelling moved to approve special use application SU10 -05. Herb Fry seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Lowery, Hotelling, Fechter and G. Martin Nays: None 061510 3 P & Z JOINT PUBLIC HEARING JUNE 15, 2010 CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the May 18, 2010 Planning and Zoning joint public hearing. B J Wilson moved to approve the Planning and Zoning Commission minutes of May 18, 2010 with the correction that Jimmy Fetcher voted Nay on CU10-08. Jimmy Fetcher seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Lowery, Hotelling and Fechter Nays: None Abstain: Fry and G. Martin With no further business to discuss, Herb Fry moved to adjourn the meeting at 8:20 p.m., Monica Hotelling seconded the motion which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, Lowery, Hotelling, Fechter and G.
