The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, November 5, 2012 at 6:00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:
Ron Cook

constituting a quorum. Also present were City Council Representative Roy Stewart, and
the following City Staff:

CALL TO ORDER
Vice -Chairman Ron Cook called the Briefing Session of the Board of Zoning Adjustment
to order at approximately 6:00 P.M.
ROLL CALL
Vice -Chairman Cook held roll call and announced that all were present except
Chairman Debbie Holt.
NEW BUSINESS
Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to
be heard in the regular public hearing.
ADJOURNMENT
With no further discussion, Robert Rainwater made a motion to adjourn. Ken White
seconded the motion which prevailed by the following vote:

200 South Main Street, Grapevine, Texas with the following members present:

WEST WALL STREET
The next item for the Board of Zoning Adjustment to consider was BZA12-13 submitted
by Martin O'Connor for property located at 1331 West Wall Street, proposed to be
platted as Lots 1 & 2, Block 1, Shamrock Ventures Addition.
Section 15.H., "R-7.5" Single Family District, Buffer Area Regulations requires a
minimum buffer of 40 -feet from the adjoining property line for all principle
buildings and structures.
The applicant requested variances of fifteen -feet (15') and twenty -feet (20') allowing
buffer areas of twenty (20) feet along the northern property line for the proposed Lot 1
and the western property line for the proposed Lot 2 and twenty-five (25') feet along the
northern property line for the proposed Lot 2.
Mr. Stombaugh explained that Staff found special conditions existed for the requested
variances. Specifically, both proposed lots met all requirements relative to width, depth,
and area for the "R-7.5" Single Family District. The 40 foot buffer placed a hardship on
the development of the two (2) lots. The buffer requirement reduced the buildable width
to 39 feet and eliminated 49 percent of the lot from being built upon for a principal
structure for the proposed Lot 1. The buildable area of the proposed Lot 2 would be
reduced by 38 percent and further be compromised by a buffer along the western and
northern property lines.
Mr. Stombaugh explained that the applicant requested a variance of 20 feet along the
northern property line for the proposed Lot 1, and a small portion of the western
property line for the proposed Lot 2, as well as 15 feet to the northern property line for
the proposed Lot 2. He stated that the 40 foot buffer would be maintained to the north of
the subject property so adequate buffering would be present between the newly created
residential property and the remaining "PO" Professional Office District property.
He went on to state that on October 16, 2012 Council approved on the first reading of
an ordinance a *zone change request to rezone the subject site from "PO" Professional
Office District to "R-7.5" Single Family District for the development of two (2) single
family lots, and if approved by the Board the second reading of the ordinance for the
subject site would be scheduled to be considered by Council at their November 20,
2012 meeting.
With no questions for Mr. Stombaugh, Jim O'Connor of 1712 Avalon Drive, Colleyville,
Texas, took the Oath of Truth; and requested favorable consideration of his request and
offered to answer any questions of the Board.
With no questions for Mr. O'Connor and no additional speakers, Robert Rainwater
made a motion to close the public hearing. George Dalton seconded the motion which
prevailed by the following vote:
Ayes: Cook, White, Rainwater, Dalton, DeAngelo
Nays: None
Absent: Holt

following vote:
Ayes: Cook, White, Rainwater, Dalton, DeAngelo
Nays: None
Absent: Holt

Staff recommends the Board of Zoning Adjustment approve the following variances to the
Grapevine Comprehensive Zoning Ordinance 82-73 for the property addressed as: 1331
West Wall Street, proposed to be platted as Lots 1 & 2, Block 1, Shamrock Ventures
Addition as follows:
Section 15.H., "R-7.5" Single Family District, Buffer Area Regulations requires a
minimum buffer of 40 -feet from the adjoining property line for all principle buildings
and structures.
The applicant is requesting a variance of 20 feet to this requirement along the northern
property line for the proposed Lot 1. The applicant is also requesting a variance of 20 feet
along a small portion of the western property line and 15 feet to the northern property line
to this requirement for the proposed Lot 2. If approved by the Board it would allow a buffer
area of 20 feet along the northern property line for the proposed Lot 1. It would also allow
a buffer area of 20 feet along the western property line and 25 feet along the northern
property ling for the proposed Lot 2.
SPECIAL CONDITION:
Staff finds that a special condition exists for the variances requested. Specifically, both
proposed lots meet all requirements relative to width, depth and area for the "R-7.5" Single
Family District. Strict adherence to the 40 foot buffer requirement places an unreasonable
hardship on the development of the two lots. Given the rectangular shape of the proposed
Lot 1, strict application of the buffer requirement reduces the buildable width of the lot to 39
feet and eliminates 49 percent of the lot from being built upon for a principal structure. The
buildable area of the proposed Lot 2 is reduced by 38 percent and is further compromised
by a buffer along both the western and northern property lines. Lastly, the historic
designation of the former farmhouse structure on the adjacent "PO" Professional Office
District zoned property to the north assures that the intensity of land uses will be
compatible with the residential use of the subject lots negating the need for buffers.

The applicants for this request, Messrs. Martin and Jim O'Connor, own the entire property,
i.e., the subject property and the property immediately to the north which is currently zoned
"PO" Professional Office District. The 40 foot buffer requirement will be maintained to the
north of the subject property so adequate buffering will be present between the newly
created residential property and the remaining "PO" Professional Office District property.
On October 16, 2012 the Council approved on the first reading of an ordinance a zone
change request to rezone the subject site from "PO" Professional Office District to "R-7.5"
Single Family District for the development of two single family lots. If approved by the
Board the second reading of the ordinance for the subject site is scheduled to be
considered by the Council at their November 20, 2012 meeting.

4. Maximum Building Coverage: The combined area occupied by all main and
accessory buildings and structures shall not exceed forty (40) percent of the
total lot area.
5. Maximum Impervious Area: The combined area occupied by all buildings,
structures, off-street parking and paved areas shall not exceed sixty (60)
percent of the total lot area.
6. Minimum Floor Area: The minimum square footage of a dwelling unit shall
be not less than twelve hundred (1,200) square feet of floor area.
G. AREA REGULATIONS:
The following minimum standards shall be required:
1. Depth of front yard, feet — 30
A minimum of fifty (50) percent of the area of the lot within the required front
yard setback shall be a landscaped area.
2. Depth of rear yard, feet - 25
3. Width of side yard on each side, feet - 6
4. Width of lot, feet - 65
Except reverse frontage lots shall be a minimum of ninety-five (95) feet in
width.
5. Depth of lot, feet - 100
6. DISTANCE BETWEEN BUILDINGS: The minimum distance between
principal or accessory buildings on adjacent lots shall be not less than twelve
(12) feet.
7. Only one single-family detached dwelling shall be permitted on each lot or lot
of record, as the case may be.
0 H. BUFFER AREA •
Whenever an R-7.5 Single family development is located adjacent to an existing
multi -family district (RMF -1, RMF -2, R-3.75, R-TH) or a non-residential district,
without any division such as a dedicated public street, park or permanent open
space, all principal buildings or structures shall be set back a minimum of forty (40)

feet from the adjoining property line. The setback area shall contain appropriate
landscape improvements, fencing, berms or trees to adequately buffer adjoining
uses.
I. HEIGHT REGULATIONS:
The following maximum height regulations shall be observed:
1. Height of principal structure, two (2) stories not to exceed thirty-five (35) feet.
2. Height of accessory structure, one story not to exceed sixteen (16) feet,
except a storage building which shall not exceed ten (10) feet in height.
J. OFF-STREET PARKING:
Provisions for the parking of automobiles shall be allowed as an accessory use to
any principal permitted use provided that such shall not be located on a required
front yard. Off-street parking shall be provided in accordance with the provisions of
Sections 56 and 58 of this Ordinance and other applicable ordinances of the City.
Parking of recreational vehicles, recreational trailers, motor homes, or boats (all
listed hereinafter referred to as vehicles) is prohibited in the required front yard
except in the following circumstances:
1. Pursuant to a permit to park said vehicle on a paved driveway in the front
yard issued by the Director of Development Services (Director), or his
designee, after a determination is made by the Director that it is not
feasible to park said vehicle in the side or rear yard.
2. For any length of time for all or any part of three (3) consecutive days, the
said vehicles may be parked in the required front yard on a paved
driveway for three (3) consecutive 24-hour days, or any part of three (3)
consecutive 24-hour days. For example, vehicle could be parked in front
yard on Friday evening at 10:00 p.m. and all day for the next two (2)
days, Saturday and Sunday, with the authorized parking time ending at
12:00 a.m. Sunday night. Parking of the vehicle in the front yard for all or
any part of consecutive Friday, Saturday, and Sunday, or any other
combination of three (3) consecutive days, is allowed. If the vehicle
parked in front yard at any time on Monday in the example, the vehicle is
parked in violation of this ordinance.
K. OFF-STREET LOADING:
No off-street loading is required in the R-7.5 District for residential uses. Off-street
