The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, August 27, 2012 at 6:00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:

heard in the regular public hearing.

session, Monday evening, August 27, 2012, at 6:15 P.M., in the Council Chambers, 200

CALL TO ORDER
Chairman Debbie Holt called the Public Hearing Session of the Board of Zoning
Adjustment to order at approximately 6:20 P.M.
ROLL CALL
Chairman Holt held roll call and announced that all were present.
PUBLIC HEARING
The next item for the Board of Zoning Adjustment to consider was BZA12-07 submitted
by David Cox for property located at 310 East College Street, proposed to be platted as
Lot 5BA, Block 22, City of Grapevine Addition.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations requires a
minimum lot width of sixty-five (651) feet.
The applicant requested a variance of eighteen (18') feet allowing a lot width of forty-
seven (47') feet for an existing lot.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant requested a special exception to allow the remaining residential structure
to remain as developed and the expansion of the residential structure as shown on the
plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
variance and special exception. Specifically, the City of Grapevine Addition was
originally platted in 1913 predating the City's first zoning ordinance. The sale of property
by deed had reshaped original boundaries of the subject property and adjacent sites
and developed lots existed adjacent to the subject site eliminating the possibility of
expanding the lot to meet the lot width.
He stated that there were two tracts of land under common ownership that were being
platted into one parcel and Tarrant Appraisal District records indicated that the original
dwelling was built in 1925.
With no questions for Mr. Triplett, David Cox of 617 Rancho Laredo Trail, Southlake,
Texas, took the Oath of Truth; and requested favorable consideration of his request and
offered to answer any questions of the Board.
Debbie Holt asked about trees on the site plan. Mr. Cox stated that there was an 80
year old tree in the front yard they wanted to preserve. He stated that they had
consulted an arborist and was told that pouring a concrete driveway would kill the tree.
He stated that they had elected to install crushed granite.
Robert Rainwater asked Staff crushed granite was i` .! impervious or !` i
Ron Stombaugh stated that crushed granite would be considered pervious. He a
q-.tated that Historic Preservation had approved the use of crushed granite.
With no further questions for Mr. Cox and no additional speakers, Ron Cook made a
motion to close the public hearing. Robert Rainwater seconded the motion which

Ken White then made a motion that a special condition existed with regard to the
following variance to "R-7.5" Single Family District, Area Regulations: Section 15.G.4.,
allowing a lot width of forty-seven feet (47') for an existing lot. Robert Rainwater
seconded the motion which prevailed by the following vote:

The next item for the Board of Zoning Adjustment to consider was BZA12-09 submitted
by Terry Brockett for property located at 2001 State Highway 121, legally described as
Lot 4, Block 1, 121 & 26 Addition.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use.
The applicant requested a special exception to allow the existing structure to remain as
developed as shown on the plot plan.
Section 60.H.5.a., Sign Standards, Required Setback, requires a minimum setback
of ten- feet (10').
The applicant requested a variance of ten -feet (10') for the relocation of a pole sign
relative to the future widening of State Highway 121.
Mr. Triplett explained that Staff found a special condition existed for the special
exception and variance requested. Specifically, this existing platted and developed lot
was in complete compliance with all development criteria.
He further stated that the proposed widening of State Highway 121 and the acquisition
of approximately 21 -feet of frontage from the subject property had created a condition in
which the existing sign no longer met the required setback, as well as other
nonconformities relative to building and landscaping setback requirements.
With no questions for Mr. Triplett, Terry Brockett of 7923 East McKinney, Denton,
Texas, took the Oath of Truth; and requested favorable consideration of his request and
offered to answer any questions of the Board.
Robert Rainwater asked if the sign height would remain the same. Mr. Brockett stated
that it would.

made a motion to close the public hearing. Ken White seconded the motion which

Staff recommends the Board of Zoning Adjustment approve the following variance and
special exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for the
property addressed as: 310 East College Street, proposed to be platted as Lot 5BA, Block
22, City of Grapevine Addition as follows:
Section 15.G.4., "R-7.5" Single Family District, Area Regulations requires a minimum
lot width of sixty-five (65') feet.
The applicant is requesting a variance of eighteen (18') feet to this requirement and if
approved by the Board would allow a lot width of forty-seven (47') feet for an existing lot.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
If approved by the Board, the remaining residential structure would be allowed to remain as
developed and would allow the expansion of the residential structure as shown on the plot
plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the variance and special exception requested.
Specifically, the City of Grapevine Addition was originally platted in 1913 predating the
City's first zoning ordinance. The sale of property by deed, particularly in this block, has
reshaped the original boundaries of the subject property and adjacent sites. Tarrant
Appraisal District records indicate the original dwelling was built in 1925. Developed
property exists to the east and west eliminating the possibility of expansion.
On April 25, 2012 the Historic Preservation Commission approved certificate of
appropriateness CA12-13 on the subject site to preserve a front portion of the dwelling,
remove the majority of the structure and allow an expansion of the dwelling as shown on

the site plan and building elevations. Based upon the plans submitted to the Historic
Preservation Commission, the owner has begun preliminary construction in anticipation of
favorable approval by the Board. The two tracts under common ownership are being
platted into one parcel. The application was submitted by David Cox.

My family wants to keep our home where it currently has been for 88 years, for many reasons.
We want to renovate the original home built in 1924, and add a new addition to the back of the
home. If moved back, this would disrupt the historic preservation of one of the first historic
homes in Grapevine. Also, the home adjacent to ours is also setback at 26 feet, and the historic
guidelines show that they shall be consistent. This creates an attractive streetscape, especially
since we have a shared driveway.
We have talked to the neighbors in the community about keeping this historic home in the same
location and all have agreed that historically it only makes sense. For example, the home located
at 405 E. Texas Street was allowed to stay at their original setback line, which was not at the
current zoning ordinance of 30 feet. The home was renovated and added onto and looks
absolutely beautiful and is only a benefit for all the residence of Grapevine.
My family has lived in this home for 30 years and it is very special to all of us. We are
renovating it so the next generation and future generations will live there. Keeping the historic
location of this home is very important and sentimental to my family. We are not asking for
anything that is not already there. Please approve our request to keep the home where it is now.
It's a win-win for all: the City, the Historic Preservation Commission, the neighborhood, and our
family. Thank you.
5. State the grounds for the request and detail any special conditions which cause hardships that in your opinion justify the
variance(s) or special exception(s) you are requesting. Examples of special conditions are: hills, valleys, creeks, power poles,
elevations, irregular lot or tract shapes, etc. The Board of Zoning Adjustment must determine a special condition or conditions
exist(s) before making a motion to approve a request. If it is determined that no special condition exists, the motion must be to
DENY the request.

6. Explain any unique circumstances, if applicable, not considered by the Zoning Ordinance. Examples: (1) If the Grapevine
City Council approved a plat prior to present zoning ordinance requirements; or (2) the ordinance was amended or a policy
change was adopted after initiation of the plans check process for a building permit or other phase of the development process.
[The Historic Preservation Commission at their April 25, 2012 meeting approved Certificate of Appropriateness CAI 2-13.
The approval included renovation of the existing home and expanding the home to the rear.
[The HPC guidelines section 3.7.3 Setbacks, states the home's setback shall be consistent with adjacent buildings which is at 26 -feet.
7. Attach a detailed diagram of the site drawn to scale, and any other drawings or photographs necessary to help explain the
case to the Board, show on the diagram all easements, building lines, encroachments, and the variance(s) requested. The
requested variance(s) should be quantified by an appropriate measurement (distance, percentage, etc.)

4. Maximum Building Coverage: The combined area occupied by all main and
accessory buildings and structures shall not exceed forty (40) percent of the
total lot area.
5. Maximum Impervious Area: The combined area occupied by all buildings,
structures, off-street parking and paved areas shall not exceed sixty (60)
percent of the total lot area.
6. Minimum Floor Area: The minimum square footage of a dwelling unit shall
be not less than twelve hundred (1,200) square feet of floor area.
G. AREA REGULATIONS:
The following minimum standards shall be required:
Depth of front yard, feet — 30
A minimum of fifty (50) percent of the area of the lot within the required front
yard setback shall be a landscaped area.

6. DISTANCE BETWEEN BUILDINGS: The minimum distance between
principal or accessory buildings on adjacent lots shall be not less than twelve
(12) feet.
7. Only one single-family detached dwelling shall be permitted on each lot or lot
of record, as the case may be.
Whenever an R-7.5 Single family development is located adjacent to an existing
multi -family district (RMF -1, RMF -2, R-3.75, R-TH) or a non-residential district,
without any division such as a dedicated public street, park or permanent open
space, all principal buildings or structures shall be set back a minimum of forty (40)

terminated by the Board of Adjustment in accordance with provisions
of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:

by the Board, would allow a setback of less than one -foot.
