CU24-05.4sprc 1 TO: SITE PLAN REVIEW COMMITTEE MEMBERS FROM: ALBERT TRIPLETT JR., PLANNER II DATE: FEBRUARY 7, 2024 SUBJECT: CONDITIONAL USE REQUEST CU24-05; ROCK & BREWS RECOMMENDATION Staff recommends the Site Plan Review Committee (SPRC) consider proposed changes to Conditional Use request CU23-06 (Ord. 2023-033), to amend the previously approved site plan for a planned commercial center which allowed the possession, storage, retail sale, and on- and off-premise consumption of alcoholic beverages (beer, wine and mixed- beverages), outdoor dining, outdoor speakers and a 40-foot pole sign in conjunction with a restaurant. This request is specifically to relocate the pole sign, add a flag pole and a small Veterans memorial, and revise landscaping. The subject site is platted as Payton- Wright Addition, Block 1R, Lot 1R4, and is currently zoned “HC”, Highway Commercial District. REQUEST The applicant proposes to relocate the pole sign, from the southwest corner of the subject site, approximately 100 feet directly east along West State Highway 114 within a landscaped median. The area and height of the sign, 201 sq. ft. and 40-feet, respectively will remain unchanged. A small Veteran’s memorial and flag pole are proposed adjacent to the main entrance and larger shrubs will be added adjacent to the patio. BACKGROUND INFORMATION The subject property was rezoned from “C-2”, Community Business District to “HC”, Highway Commercial District in the 1984 City-wide Rezoning. • On July 20, 2021, City Council approved conditional use request, CU21-12 (Ord. 2021-33) for establishment of a planned commercial center and to allow the possession, storage, retail sale, and on- and off-premise consumption of alcoholic beverages (beer, wine and mixed-beverages), outdoor dining, outdoor speakers and a 40-foot pole sign in conjunction with a restaurant. • On March 3, 2022, the Site Plan Review Committee (SPRC) approved conditional use permit CU22-14 to reduce total lot area from 2.16 acres to 2 acres and reduce the restaurant’s (Rock N Brews) patio area from 5,226 square feet to 4,301 square feet on proposed Lot 1R. • On May 1, 2023, SPRC referred conditional use permit request CU23-06 to the June 20, 2023, joint City Council and Planning and Zoning Commission meeting for their consideration. CU24-05.4sprc 2 • On June 20, 2023, City Council approved conditional use request, CU23-06 (Ord. 2023-033) to revise building elevations and the floor plan on Lot 1R4 to remove the “to-go” area, to relocate the cooler, freezer, and utility room, reduce outdoor dining area, and add landscaping. /at
