ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete when filed and
will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.
I have read and understand all of the requirements as set forth by the application for

1. Please add case number CU07-21 to all each sheets.
2. Two separate cases will exist for the Tastings restaurant and retail
store. Please provide two separate overall site plans for the each
case. Highlight on the site plan the area for the retail store
only.
Overall Site Plan
3. Please include the following on the overall site plan: vicinity map;
graphic and numerical scale; remove the floor plan layer from sheet
1/3 for Building -C and label Building -C as four-story residential;
label the parking garage as five -level parking garage; label the
adjacent streets and the right-of-way, South Main Street (100 -ft. r -o-
w), West Dallas Street (90 -ft. r -o -w) and East Nash Street (50 -ft. r -
o -w), on the west, north and south sides respectively; label the
parallel parking along South Main Street and along East Nash
Street; and 909 South Main Street, suite 110 to the title block.
4. Please correct the north arrow on sheet 1/3.
5. Please note the attachment to this document includes a site data
table for Buildings A -C, plus the parking garage. Please include
this information on the overall site plan sheet. Also please include
the parking count and site information also found on the attachment.
The site information should reflect a change to the lot coverage
which includes the addition of elevators to Buildings A and B.
6. Please include the applicant name and contact information.
7. Please add the following note:
a) CU07-21 is a conditional use request for the sale, storage, and
on -premise consumption of alcoholic beverages (beer, wine and
mixed beverages) and outside dining in conjunction with a

8. Please ghost in the restaurant floor plan, deemphasizing the restaurant
and emphasizing the retail store.
9. Please include the square footage of the store in a data table.

10. Please label the elevator on the Main Street, south and east elevations.
The above comments must be reflected in the revised submittal,
which is due by Thursday, August 30 at 12:00 p.m. for the September
18 joint public hearing. Please submit the revised documents to the
Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
one (1) colored version of the overall site plan on 11" x 17" or a digital
version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold)
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of

Ordinances as follows: Section 20, Townhouse District Regulations relative to a complete
revision of the ordinance, Section 41, "PD" Planned Development Overlay, relative to the
general use and justification of the ordinance, and revision to all applicable sections of the
zoning ordinance relative to the elimination of public utility uses as a permitted use, and
any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

REQUESTED ZONE CHANGE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan associated with Z05-10 (Ord. 2005-75) specifically to allow the possession storage
retail sale and off -premise consumption of alcoholic beverages beer and wine only) in
cornunction with a retail store (CU07-20) and to allow the possession storage retail sale
and on -premise consumption of alcoholic beverages (beer, wine and mixed drinks) in
conjunction with a restaurant (CU07-21).
The applicant proposes to establish a retail store and a restaurant in two separate suites
within the Fairfield at Main Street development which is under construction at the southeast
corner of South Main Street and Dallas Road. The retail store, (Tastings Fine Wine and
Art) proposes to occupy 342 -square feet. The restaurant (Tastings Restaurant and Bar)
proposes to occupy 2,358 -square feet which includes an outdoor covered patio dining
area. The retail store and the restaurant will front South Main Street.

floor consisting of retail lease space and the second and third story consisting of residential
apartment units. To the east of these structures, a surface parking area of 60 spaces will
separate these two buildings from the parking garage and remaining four story apartment
structure. Parking on site totals 570 spaces which exceed the minimum requirements (496

During the public hearing on September 18th discussion centered on restaurant uses in this
new mixed use project and the possible negative impact restaurant uses could have on this
project if they were allowed to consume the majority of the retail space on the ground floor
of both retail buildings. Subsequently, both requests were tabled to the October 16th public
hearing. Two meetings were held with representatives of Fairfield Development, the
developers of the Fairfield on Main mixed use project to discuss limitations on restaurants,
regardless of alcohol beverage sales. As a result of those meetings, along with favorable
consideration of both Tastings requests, Fairfield Development has agreed that any
additional full service restaurant uses are not permitted on the subject property with the
exception of coffee shops, bakeries, sandwich shops, and wine tasting rooms which shall
require approval of a conditional use permit. The ordinance for CU07-21 has been
amended to reflect this agreement.

This letter is to verify that your request for a conditional use permit to amend the previously approved
site plan associated with Z05-10 (Ord. 2005-75) specifically to allow the possession, storage, retail sale
and off -premise consumption of alcoholic beverages (beer and wine only) in conjunction with a retail
store (CU07-20) and to allow the possession, storage, retail sale and on -premise consumption of
alcoholic beverages (beer, wine and mixed drinks) in conjunction with a restaurant (CU07-21) for
property located at 909 South Main Street #109 (Retail Store) and 909 South Main Street #110
(Restaurant) and platted as Lot 1, Block 1, Grapevine Corner Addition was approved by the City
Council on October 16, 2007 with the condition that additional full service restaurant uses are not
permitted on the subject property with the exception of coffee shops, bakeries, sandwich shops,
and wine tasting rooms which shall require approval of a conditional use permit in accordance
with Section 40 "MXU" Mixed Use District Regulations and that the restaurant not be open past
midnight any night of the week. A copy of Ordinance 2007-56 and 2007-57 and a copy of the
approved site plans are enclosed.
On October 16, 2007, the Planning and Zoning Commission recommended the City Council approve the
request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which
the City Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit
is obtained and the erection or alteration of a structure is started, or (2) an Occupancy Permit is
obtained and a use commenced.
