ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. if after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

On Tuesday evening, April 15, 2008 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
Z08-02 — 210 WEST WORTH STREET - submitted by Izak & Joe Gregory for property
located at 210 West Worth Street and platted as Lots 4A & 4B, Block 2, City of Grapevine
Addition. The applicant is requesting rezone 0.327 acres from "R-7.5" Single Family
Residential to "CBD" Central Business District for the development of a public parking lot
for Dino's Steak House. The property is owned by Izak & Joe Gregory.
Z08-03 & CU08-08 — GRAPEVINE DODGE - submitted Chrysler Realty Company for
property located at 2601 William D Tate Avenue and proposed to be platted as Lot 1 R,
Block 1, Frank Parra Addition. The applicant is requesting to rezone 2.231 acres from
"CC" Community Commercial to "PID" Planned Industrial Development and a conditional
use permit to amend the previously approved site plan, specifically to enlarge the site for
vehicle storage. The property is owned by The Estates of A C and Audrey Stone.
CU08-06 — DINO'S STEAK HOUSE - submitted Dino's Restaurant for property located at
342 South Main Street and platted as Lots 6A and 6C1, Block 2, City of Grapevine
Addition. The applicant is requesting a conditional use permit to allow a restaurant with the
possession, storage, retail sale and on -premise consumption of alcoholic beverages (beer,
wine, and mixed drinks) in conjunction with a restaurant. The property is zoned "CBD"
Central Business District and is owned by Gregory Investments.
CU08-07 — TEXAS TOYOTA - submitted TXVT Development, Inc. for property located at
316 East Dallas Road and platted as Lot 1 R1, Block 1, M & H Addition. The applicant is
requesting a conditional use permit to amend the previously approved site plan, specifically
to change the use to an automotive repair/collision repair center for Texas Toyota with
outside vehicle storage. The property is zoned "LI" Light Industrial District and is owned by
Hayes Leasing Company.
CU08-09 — INWOOD ESTATES VINEYARDS, INC - submitted by Inwood Estates
Vineyards for property located at 603 South Main Street #303 and platted as Lot C, Block
15, City of Grapevine Addition. The applicant is requesting a conditional use permit to
allow a wine tasting facility with on -premise and off -premise consumption of alcoholic

beverages (wine only) located within Mawker Coffee Shop. The property is zoned "CBD"
Central Business District and is owned by Harry Hines Medical Center.
SU08-01 — VERIZON WIRELESS - submitted by Zone Systems for property located at
1060 Texan Trail and platted as Lot 1, Block 1, TW K Addition. The applicant is requesting
a special use permit to amend the previously approved site plan for an existing unmanned
cellular facility. The property is zoned "LI" Light Industrial District and is owned by Lead
Concepts Inc.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

GRAPEVINE CITY COUNCIL AND
PLANNING AND ZONING COMMISSION
Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve
the request.
Purpose of Request:
The public hearing is to consider an application submitted by TXVT Development, Inc. for
property located at 316 East Dallas Road and platted as Lot 1 R1, Block 1, M & H Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU03-54 (Ord. 04-03) for the sale, display and repair of new and used medium and
heavy duty trucks and associated outside land uses, specifically to change the use to an
automotive repair/collision repair center for Texas Toyota with outside vehicle storage. The
property is zoned "LI" Light Industrial and is owned by Hayes Leasing Company. A copy of
the site plan is on file with the Department of Development Services.

PROPERTY LOCATION AND SIZE:
The subject property is located at 316 East Dallas
Road and platted as Lot 1 R1, Block 1, M & H
Addition. The addition contains approximately 3.115
acres and has 256 feet of frontage along Nash
Street, 130 feet of frontage along Jean Street and
152 feet of frontage along Dallas Road.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU03-54 (Ord. 04-03) for the sale, display, and repair of new and used medium
and heavy duty trucks and associated outside land uses specifically to change the use of
the property to an automotive repair/collision repair center.
With this request the applicant intends to convert the former Hayes Truck Leasing site
which has not been in operation for several years, into an automotive repair/collision repair
center for Texas Toyota. Outside storage of vehicles awaiting repair will be limited to that
area screened by a solid masonry screening wall. What was previously used as display
area for new vehicles associated with the Hayes Truck Leasing business in front of the
main structure along Dallas Road has been converted into employee/customer parking and
has been landscaped accordingly. The applicant has added a solid masonry screening
wall along the western, eastern, and southern property lines to screen the structure and
vehicle storage area from view.

The property is currently zoned "LI" Light Industrial District and is developed as the Hayes
Truck Leasing facility which is no longer in operation.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and the immediate surrounding area were rezoned in the 1984 City
Rezoning from 1-1" Light Industrial District to "LI" Light Industrial District. CU99-23 (Ord.
No. 99-80) was approved in May 1999, amending the previously approved site plan of the
subject site in order to allow the retail sale and outdoor display of new medium sized
trucks. Conditional Use Request CU96-24 (Ord. 96-77) approved by Council at their
October 15, 1996 meeting established the truck leasing facility with the sale and repair of
new and used heavy trucks and associated outside land uses. Conditional Use Request
CU01-41 was considered and denied by Council at their August 21, 2001 meeting. At that
meeting the applicant requested to expand the site for further inventory/outdoor display of
new, medium -duty trucks. The property to the south was rezoned from "C-2" Community
Business District to `PCD" Planned Commerce Development District. The City of
Grapevine purchased this property and had it rezoned to "GU" Governmental Use District
in 1987 (Z87-20). At the January 20, 2004 meeting Council approved a revised conditional
use request on the subject property (CU03-54) for an expansion of the main structure and
an expansion to the site to be used for additional employee parking however neither
expansion took place.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "LI" Light Industrial District — Nations Rent
SOUTH: "GU" Governmental Use District and "LI", Light Industrial District —
Grapevine Community Recreation Center, Grapevine Public Library and
the Grapevine Convention Center, several nonconforming single family
homes
EAST: "LI" Light Industrial District — Richard's Auto Body Shop, and VicWest
Steel
WEST: "LI" Light Industrial District — Johnson Excavation Company
AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.

MASTER PLAN APPLICATION:
The Master Plan designates the subject property as an Industrial land use. The applicant's
proposal is in compliance with the Master Plan.
THOROUGHFARE PLAN:
The Thoroughfare Plan designates Dallas Road as a Type "C" Minor Arterial, with a
minimum of 80 -feet of right-of-way to be developed as four lanes with a center left turn
lane. Nash Street is designated as a Type F Collector requiring a minimum of 60 -feet of
right -of way to be developed as two lanes.

RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU03-54 (Ord. 04-03) for the sale, display, and repair of new
and used medium and heavy duty trucks and associated outside land uses specifically
to change the use of the property to an automotive repair/collision repair center, and
take any other action necessary.
BACKGROUND INFORMATION
Conditional use request CU08-07 was submitted on behalf of Texas Toyota with the
intent to occupy the former Hayes Truck Leasing site and use it as automotive
repair/collision repair center for Texas Toyota.
The Planning and Zoning Commission and the City Council tentatively approved CU08-
07 at the April 15, 2008 public hearing with the stipulation that the applicant consider
making changes to the building elevations in consultation with the City's Historic
Preservation Officer and improve the landscaping on the site by adding trees along the
western elevation to help screen the view of the bay doors all of which are to be
considered and approved by the Site Plan Review Committee.
The applicant met with David Klempin, the City's Historic Preservation Officer and
based upon his recommendation agreed to remove the red accent color that was
present on all four building elevations and allow a red accent band on the front elevation
only along with the stipulation that the exterior elevations be power washed clean but
the existing color of the structure remain. The applicant has also added a solid row of
trees along the western elevation to screen the bay doors from view. See the attached
site plan, landscaping plan, and colored elevations.

A copy of Ordinance 2008-19 and a copy of the approved site plan are enclosed.
On April 15, 2008, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.

Committee on May 14, 2008:
