when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all riling fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please number sheets in consecutive order and add case number CU07-
34 to the signature block of all sheets. Each sheet needs to be sealed by
a registered surveyor, architect or engineer. Please add a north arrow and
graphic and numeric scale to each sheet.
2. The City of Grapevine has adopted the 2006 International Fire Code.
Based on the adopted code, the room addition will require a fire sprinkler
system for the entire premises. Please contact Mike Keefer — Fire
Marshall at (817) 410-3482 for questions regarding sprinkler systems.
3. Please add the following notes to the site plan stating the purpose of the
conditional use request:
a) Conditional use request CU07-34 is a request to amend the
previously approved site plan of CU03-35 (Ord. 03-63) for the
possession, storage, retail sale and on -premise consumption
of alcoholic beverages (beer, wine and mixed beverages) in
conjunction with a restaurant, specifically to add outside dining
and additional square footage to the restaurant.
b) The entire site is the premises.
4. Please provide a letter describing the proposed changes to the premises.
5. In addition to the site plan please provide: a landscape plan which
illustrates existing conditions; the current south and west building
elevations; and any proposed additional signage to the premises or
building facade.
6. Please provide a copy of the approved plat of the subject property. The
boundary lines/dimensions of the plat and site plan must match.
7. Please add a site data chart to the site plan showing the amount required
and provided: Height in stories and feet, percentage masonry, total
building area, total lot area, total impervious area (building and paved
area), and total open space (landscaped area).
8. Please label all existing conditions, i.e. parking surface, dumpster
screening, etc. Please label proposed changes to the site plan/floor plan
and provide the total square footage of both indoors and outdoors.
9. Please add a total seating chart indicating the total number of indoor and
outdoor fixed and temporary seating. Please indicate the consumption
areas, storage areas and point of sale areas on the floor plan.
10. Please add the following signature block, minimum size 3" x 4", to each
sheet.

The revised submittal shall include:
one (1) Mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edae to the left edae
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, January 15, 2008 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU07-34 - BAJA MEXICAN GRILL - submitted by Gloisa Inc for property located at 1212
William D Tate Avenue and platted as Parcel E, Towne Center Addition. The applicant is
requesting a conditional use permit to amend the previously approved site plan, specifically
to add additional square footage to the restaurant. The property is zoned "CC" Community
Commercial and is owned by Greenway -Grapevine Ltd.
CU07-43 - GREAT WOLF LODGE - submitted by Great Wolf Lodge for property located at
1400 State Highway 26 and platted as Lot 1, Block 1, Great Wolf of Grapevine Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan, specifically to allow the addition of a miniature golf course and revise the entry porte-
cochere. The property is zoned "CC" Community Commercial and is owned by Great Wolf
Lodge of Grapevine LLC.
CU07-44 - LUCAS FUNERAL HOME - submitted by JNL Texas Holdings for property
located at 1331 West Wall Street and platted as Block 1, Dellwood Acres Addition. The
applicant is requesting a conditional use permit to allow a funeral home. The property is
zoned "PO" Professional Office and is owned by Grapevine -Wall Street Partners 1.
SU07-03 - ONCOR ELECTRIC DELIVERY - submitted by Oncor Electric Delivery
Company for property located at 3201 State Highway 360 and proposed to be platted as
Lot 2, Block 1, Grapevine SH 360 Substation Addition. The applicant is requesting a
special use permit to allow the development of a public utility distribution facility and
equipment. The property is zoned "PID" Planned Industrial Development and "R-TH"
Townhouse District and is owned by Robert Schlegel.
FUTURE LAND USE MAP II UPDATE MP07-02 - amending the Official City of Grapevine
Future Land Use Map II for property currently zoned "R -MF -2" Multifamily District located
east of Wood Street between East Wall Street and East Worth Street.
AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City Council
and the Commission will consider amendments and changes to the Comprehensive Zoning
Ordinance, No. 82-73, same being Appendix D of the Code of Ordinances as follows:
Section 28, "CBD" Central Business District relative to restaurants as a conditional use and

any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.

The subject property is located at 1212 William D.
Tate Avenue and is platted as Parcel E, Grapevine
Towne Center Addition. The addition contains 1.27
acres. The property has approximately 255 feet of
frontage along William D. Tate Avenue.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU03-35 (Ord. No. 03-63) for the possession, storage retail sale and on -premise
consumption of alcoholic beverages (beer, wine, and mixed drinks) in coniunction with a
restaurant specifically to add outdoor dining and additional square footage
The applicant is proposing to expand into the adjacent space formerly occupied by Wings
and Things. The 338 square foot addition plus four outdoor dining tables will be used as
additional seating for the existing 3,930 square foot restaurant.
The applicant also operates Peace Burgers, a 1,307 square foot restaurant adjacent to
Baja Mexican Grill in the remainder of the space, formerly occupied by Wings and Things.

PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District and is developed
with a shopping center.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and the area to the south and west were rezoned from "C-2"
Community Business District to "CC" Community Commercial District during the 1984 City
Rezoning. Seven conditional use permits have been approved on this site. CU87-05 (Ord.
87-49) was approved for Elaine's Oven Ready Pizza with alcohol beverage sales. CU89-
05 (Ord. 89-33) was approved for Samir's Restaurant with alcohol beverage sales.
Esparza's Too was approved by Council June 18, 1991 (CU91-11, Ord. 91-38) also with
alcohol beverage sales. CU92-05 (Ord. 92-24) was approved March 24, 1992 for Royal
Cathay Restaurant with alcohol beverage sales. CU98-06 (Ord. No. 98-39) was approved
in March 1998 allowing for the provision of a 20 -foot multi -tenant pole sign on the site.
CU01-14, approved by the Site Plan Review Committee in March 2001, allowed for the
expansion of the bar area in Esparza's Too. CU01-45 (Ord. No. 01-75) was approved in
September 2001 allowing a restaurant with on -premise alcoholic beverage sales. CU03-35
(Ord. No. 03-63) was approved in October 2003 for an existing restaurant with on -premise
alcohol sales to enlarge the square footage and provide a take-out counter. The zoning for
the areas to the north and east were not changed during the 1984 City Rezoning. In
Towne Center Addition No. 2, to the north of the site, CU06-32 (Ord. No. 06-56) was
approved in August 2001 to revise the elevations, floor plan and a monument sign for an
existing restaurant. Tate Street Plaza, to the east of the site, is a planned commercial
center with a restaurant with alcoholic beverage sales, an automotive retail service center,
and a drive through restaurant. The Hayley Addition, south of the U.S. Post Office was
zoned 1-1" Light Industrial prior to the 1984 City Rezoning. The Hayley Addition, currently
zoned "HC" Highway Commercial District, is a planned commercial center with a variety of
retail uses, including restaurants with on -premise consumption of alcoholic beverages, and
a gas station with off -premise consumption of alcoholic beverages (beer only).

The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land use. This request
is in conformance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates William D. Tate Avenue as a Type C Minor Arterial with
a minimum 80 -foot right-of-way developed as four lanes with a center left turn lane.

on -premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in conjunction
with a restaurant, specifically to add outdoor dining and additional square footage for property

approved by the City Council on January 15, 2008. A copy of Ordinance 2008-03 and a copy
of the approved site plan are enclosed.
On January 15, 2008, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

Gloisa Inc. doing business as Baja Mex -Grill would like to inform you that we are
planning to expand by taking over the next door space previously occupied by
Wings-NJhings.
The space is approximately 1677 sq. ft it has a full kitchen with a walk in cooler
and a storage room, but only about 350 sq. ft will be use by Baja Grill for extra seating,
which is especially needed for the weekends. The rest of the dining room and kitchen will,
be used to open a new restaurant called Peace Burger, with a menu based on hamburgers,
sandwiches and chicken fingers. The restaurant will operate with out senwers, customers
will order at the counter just like a Sublvay restaurant, and it will have a fountain drink
station and salsa, bar.
Attached is an example of the menu and logo, but we are still working on the
details. We would like to open in about 4 weeks if possible. If you need more information
