HomeMy WebLinkAboutItem 02 - Amended Thoroughfare PlanMEMO TO: FROM: MEETING DATE: SUBJECT: RECOMMENDATION: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL ROGER NELSON, CITY MANAGER 4/ DECEMBER 7, 2004 AMENDED THOROUGHFARE PLAN City Council consider adopting an ordinance amending the City of Grapevine Master Thoroughfare Plan in its entirety, and take any necessary action. BACKGROUND: Staff previously briefed the City Council in a workshop on November 2, 2004 on the revised Master Thoroughfare Plan proposed for adoption. Council agreed with Staff's proposed revisions in the workshop. Staff advised the Council that the revisions would be submitted to the City Council for formal action in a subsequent meeting. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ADOPTING THE CITY OF GRAPEVINE THOROUGHFARE PLAN REVISED 2004; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, after substantial study and numerous public hearings and meetings of the city were conducted at which the public was invited to attend and express their views, thoroughfare plan (the "Thoroughfare Plan 1987-2030") was prepared by Freese and Nichols, Inc., for the City of Grapevine, Texas (the "City") and adopted through the passage of Ordinance No. 87-15; and WHEREAS, the Thoroughfare Plan 1987-2030 has been amended from time to time with the passage of a series of ordinances; and WHEREAS, the City Council finds it necessary to adopt amendments to the City's Thoroughfare Plan, and to replace all prior versions of the Thoroughfare Plan; and WHEREAS, City Council has followed all necessary statutory and legal prerequisites to the adoption of the City of Grapevine Thoroughfare Plan Revised 2004, and has found that the passage of this Ordinance serves the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS. Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. The City of Grapevine Thoroughfare Plan Revised 2004, a true and correct copy of which is included herewith as Exhibit "A" and is on file with the City Secretary of the City of Grapevine, Texas, is hereby adopted by the City Council as the Thoroughfare Plan of the City. All prior versions of the Thoroughfare Plan are hereby amended in their entirety and replaced with Exhibit "A". Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance become effective form and after the date of its passage and it is accordingly so ordained.
