DRAINAGE EASEMENT ABANDONMENT — LOT 4, BLOCK 1,
WINDSOR FOREST EAST ADDITION
City Council consider adopting an ordinance abandoning 854 square feet of the existing
fifty foot drainage easement located through the Lot 4, Block 1, Windsor Forest East
Addition, and take any necessary action.
BACKGROUND INFORMATION:
The owner of Lot 4, Block 1, Windsor Forest East Addition has requested 854 square feet
of the existing fifty foot drainage easement along the rear of the lot be abandoned. The
property owner has a backyard pool which encroaches into the drainage easement. This
abandonment will clear up the encroachment. Staff recommends approval.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF A DRAINAGE EASEMENT IN THE CITY OF
GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED;
PROVIDING A SEVERABILITY CLAUSE; DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the property owner of Lot 4, Block 1, Windsor Forest East Addition,
recorded in Cabinet A, Slide 1620, Plat Records, Tarrant County, Texas, more specifically
described in Exhibit "A" attached hereto and incorporated herein for all purposes, has
requested 854 square feet of the existing fifty foot drainage easement along the rear of the
lot, as herein after described be abandoned and vacated; and
WHEREAS, the 854 square feet of the existing fifty foot drainage easement is not
needed for public use and will not be needed in the future for public use; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the 854 square feet of the existing fifty foot drainage easement
located within the property described in Exhibit "A", attached hereto and incorporated
herein for all purposes, is hereby abandoned and vacated for public use and the same is
hereby abandoned and vacated insofar as all public right, title, interest in and to said 854
square feet of the existing fifty foot drainage easement is concerned.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the 854 square feet of the existing fifty foot drainage
easement is no longer needed by the public for public usage and would create a hardship
or burden upon the City of Grapevine to keep open and maintain such drainage easement
creates an urgency and an emergency for the immediate preservation of the public health,
safety, and general welfare which requires that this ordinance shall take effect immediately
from and after its passage and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this the 7th day of December 2004.

All that certain tract or parcel of land being a part of Lot 4, Block 1, Windsor Forest East, an addition to the City of Grapevine,
Tarrant County, Texas, according to the plat recorded in Volume A, Slide 1620, Plat Records of Tarrant County, Texas and being
more particularly described as follows:
BEGINNING at a 1/2" iron rod set in the north line of said Lot 4 from which a 1/2" iron rod bears North 89 degrees 34 minutes 02
seconds East, a distance of 50.00 feet, the same being the northeast corner of Lot 4;
THENCE departing said north line South 39 degrees 02 minutes 24 seconds East, a distance of 24.87 feet to a 1/2" iron rod set for
corner;
THENCE South 00 degrees 29 minutes 49 seconds East, a distance of 36.94 feet to a 1/2" iron rod set for corner;
THENCE South 42 degrees 01 minutes 04 seconds West, a distance of 22.94 feet to a 1/2" iron rod set for corner;
THENCE North 00 degrees 29 minutes 49 seconds West, a distance of 73.31 feet to the POINT OF BEGINNING and containing
854 square feet or 0.02 acres of land within the metes recited.
