HARDY, DIRECTOR OF DEVELOPMENT SERVICES `r MEETING DATE: DECEMBER 21, 2004 SUBJECT: DEVELOPMENT SERVICES TECHNICAL REPORT OF CONDITIONAL USE APPLICATION CU04-40 APPLICANT: Dilip Pranav PROPERTY LOCATION AND SIZE: The subject property is located at 205 State Highway 114 West and is platted as Lot 14, Block 6, Metroplace 2nd Installment. The property contains approximately 3.80 acres and has 50 feet of frontage along the State Highway 114 West service road and 25 feet of frontage along Main Street. REQUESTED CONDITIONAL USE AND COMMENTS: The applicant is requesting a conditional use permit to amend the approved site plan of CU99-79 (Ord. 00-05) for a planned commercial center specifically to allow the development of a 110 room hotel and to allow the possession, storage, retail sale and on - premise consumption of alcoholic beverages _ (beer, wine, and mixed beverages) in coniunction with a restaurant. The applicant proposes to develop a 110 -room Hilton Garden Inn that will meet all the requirements for new hotel construction established after April 18, 2000. These requirements include a minimum room size of 380 square feet, a full service restaurant with service to the general public, meeting space and a swimming pool with a minimum area of 1,000 square feet. 0:/ZCU/CU04-40.4 I December 13, 2004 (11:44AM) The property is currently zoned "CC", Community Commercial District with a Conditional Use Permit for a Planned Commercial Center and is developed with several restaurants, bowling/gaming facility and a hotel. HISTORY OF TRACT AND SURROUNDING AREA: The subject property and the surrounding area to the south, east and west were rezoned in the 1984 citywide rezoning from the 1-1", Industrial District to the "PID", Planned Industrial Development District. The property located at the southwest corner of Main Street and the frontage road of State Highway 114 West was rezoned to the "CC", Community Commercial District in 1985 for the purpose of developing a high rise office building with a bank, but it was not constructed. The subject property and the property to the south, east and west was rezoned in 1993 (Z93-04, Ord. No. 93-19) from the "PID", Planned Industrial Development District to the "CC", Community Commercial District. The subject property and the surrounding lots received conditional use permits for the Planned Commercial Center of Metroplace, 2nd Installment, allowing for the development of EI Fenix Restaurant (CU93-16), Tony Roma's (CU94-12), China Coast (CU94-23), Olive Garden (CU94-24), and Joe's Crab Shack (CU97-23) with on -premise consumption of alcoholic beverages. The China Coast Restaurant was never constructed. Joe's Crab Shack amended the approved site plan in 1997 to allow the addition of an outdoor playground area. CU98-70 was approved in December 1998, providing for a 3 -story Holiday Inn Express on Lot 13. CU99-51 and SU99-13 were approved in September 1999 for laser tag arena and a bowling alley on Lot 6R-1. CU99-59 allowing modifications of the approved floor plan on the Olive Garden restaurant was approved in December 1999. The property east of South Main Street was rezoned in 1990 from the "PID", Planned Industrial Development District to "CC", Community Commercial District (Z90-04). Saltgrass Steakhouse and Schlotzsky's Sandwich Shop are currently located in this area. North of State Highway 114 West has been rezoned "HC" Highway Commercial District since the 1984 citywide rezoning and is developed with the First National Bank building; Payton -Wright Ford and Tia's Mexican Restaurant. Conditional Use Request CU99-79 was approved by Council at their January 18, 2000 meeting with allowed for additional signage for the Holiday Inn Express hotel and a slight revision to the parking layout for Lot _ 6R-1. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "HC", Highway Commercial District — First National Bank, Payton - Wright Ford Dealership, Macaroni Grill and Chili's. The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial land use. The applicant's request is in compliance with the Master Plan. Section 2. The City Manager is hereby directed to amend the official zoning map of the City of Grapevine, Texas, to reflect the herein conditional use permit. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general welfare of the community. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from fire, panic, flood and other dangers; provide adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adequate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 5. This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ORD. NO. 3 ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
