ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete when filed and
will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry.
Public hearings may be continued to the next public hearing. Public hearings will not be
tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all filing fees. The application,
along with the required filing fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period.

BEING all that certain lot, tract or parcel of land situated in the James Gibson Survey, Abstract
Number 586 in the City of Grapevine, Tarrant County, Texas and the James Gibson Survey,
Abstract Number 1715 in the City of Grapevine, Dallas County, Texas, and being Lot 2, Block A
of Grapevine Mills Crossing, an addition to the City of Grapevine, Dallas and Tarrant Counties,
according to the plat thereof recorded under Document Number 20070135804 of the Plat
Records of Dallas County, Texas and in Cabinet A, Slide 11865 of the Plat Records of Tarrant
County, Texas, and being more particularly described as follows:
BEGINNING at a 11V2 inch iron rod set with cap stamped "ARTHUR SURVEYING COMPANY" in
the north line of that certain tract of land described in deed to Crow -Billingsley Airport No. 1,
Ltd., recorded in Volume 7143, Page 600 of the Deed Records of Tarrant County, Texas, said
point bearing South 89 degrees 21 minutes 54 seconds West at a distance of 175.00 feet from the
southeast corner of Tract A of said Grapevine Mills Crossing and the northeast corner thereof
being in the west line of State Highway 121;
THENCE South 89 degrees 21 minutes 54 seconds West, along the north line of said Crow -
Billingsley tract, a distance of 171.20 feet to a11/2 inch iron rod set with cap stamped "ARTHUR
SURVEYING COMPANY`;
THENCE along the east line of Lot 3 of said Block A the following two (2) courses:
North 00 degrees 37 minutes 10 seconds West, a distance of 133.09 feet to a11/2 inch iron
rod set with cap stamped "ARTHUR SURVEYING COMPANY";
North 37 degrees 19 minutes 28 seconds East, a distance of 120.55 feet to a11/2 inch iron

5. Please note the following sheets are needed for the revised submittal:

general notes; elevations; sign elevation; dimension control; grading;
water and waste water plan; drainage area map; drainage plan; and
landscape plan; . All other sheets can be omitted for the revised submittal.
6. Please add the following note to sheet C-1. "All the requirements of the
Grapevine soil erosion control ordinance shall be met during the period of
construction". Please correct the spelling of ordinances on Line 12 of
page C-1.
7. Mechanical and electrical equipment, including air conditioning units must
be screened from public view.
The above comments must be reflected in the revised submittal,
which is due by Thursday, May 31 at 12:00 p.m. for the June 19 joint
public hearing. Please submit the revised documents to the Department
of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
one (1) 11"x17" color rendering of the landscape plan in a digital format
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the
subject tract object to the case, a 3/4 vote of the City Council is required to approve

Purpose of Request:
The public hearing is to consider an application submitted by Allen & Ridinger Consulting,
Inc. for property located at 3950 North Grapevine Mills Boulevard and platted as Lot 2,
Block A, Grapevine Mills Crossing Addition. The applicant is requesting a conditional use
permit to amend the previously approved site plan to allow the development of a retail tire

Grapevine Mills Boulevard and is platted as Lot 2,
Block A, Grapevine Mills Crossing Addition. The site
I contains 37,680 square feet and has 121 feet of
frontage along State Highway 121.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU06-55 (Ord. 2007-06) for a planned commercial center, specifically to allow a tire
and battery store and a 20 -foot pole sign.
The applicant proposes to develop a 7,900 square foot National Tire and Battery (NTB)
store on a 37,680 square foot lot at the southeast corner of the 18 acre tract located at the
southwest corner of State Highway 121 and North Grapevine Mills Boulevard. One 20 -foot
pole sign is proposed on the south side of the NTB building.
PRESENT ZONING AND USE:
The property is currently zoned "CC" Community Commercial District and is under
development.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding properties were rezoned in the 1984 City Rezoning from 1-1"
Light Industrial District to "HCO" Hotel Corporate Office District and "PID" Planned
Industrial Development District. The subject property was rezoned (Z96-08) in June 1996
to "CC" Community Commercial District for a retail shopping development that never
occurred. The property to the west currently occupied by the Grapevine Mills Mall and its
associated outparcel development was rezoned in 1995 to "CC" Community Commercial
District to facilitate the development of the mall. Numerous conditional use requests have
been approved at this location since the development of the mall. The property to the
immediate south is developed as an Ashley's Furniture store. At the October 19, 2004
meeting, Council approved a conditional use permit (CU04-32) for the establishment of a
15 -acre planned commercial center as well as the signage necessary to serve the site that
is located just south of the Ashley Furniture site. Across Grapevine Mills Boulevard North
to the north several conditional use permits have been approved for Magic Mike's
convenience store with gasoline sales (CU98-01) and Speedway Grapevine Car Wash
(CU04-01). Council approved at the February 21, 2006 meeting a conditional use permit
(CU06-03) to establish a planned commercial center in conjunction with a furniture store
(La -Z -Boy) and a 40 -foot pylon sign along Grapevine Mills Parkway. Conditional Use
Request CU06-55 (Ord. 07-06) was approved by Council at their December 19, 2006
meeting for a planned commercial center along with four 40 -foot pole signs.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CC" Community Commercial District—Magic Mike's convenience

SOUTH: "CC" Community Commercial District—Ashley's Furniture, vacant

AIRPORT IMPACT:
The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B,
the following uses may be considered only if sound treatment is included in building design:
multi family apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.

MASTER PLAN APPLICATION:
The Master Plan designates the subject property as Commercial land use. The applicant's
proposal is in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Grapevine Mills Parkway as a Type A, Major Arterial
with a minimum 100 -foot right-of-way developed as six lanes with median. North
Grapevine Mills Boulevard is designated a Type B, Major Arterial with a minimum 80 -foot
right-of-way developed as four lanes with median.

This letter is to verify that your request for a conditional use permit to amend the previously
approved site plan of CU06-55 (Ord 07-06) for a planned commercial center, specifically to
allow a tire and battery store on property located at 3590 North Grapevine Mills Boulevard and
platted as Lot 2, Block A, Grapevine Mills Crossing Addition was approved by the City Council
on June 19, 2007 with the condition that the 20 -foot pole signs be eliminated from Lots 1
and 2. A copy of Ordinances 2007-33 and a copy of the approved site plan are enclosed.
On June 19, 2007, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter
how minor or major) can only be approved by city council through the public hearing
process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
