use by applicable district regulations (example: buffer yards, distance between users)

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "R-2" Two Family Residential prior to the 1984 City
Rezoning. During the City Rezoning the subject site was rezoned to "R-3.5" Two Family
District. At a January 16, 1990 meeting, Council approved a rezoning (Z89-17) of the
subject site to "CC" Community Commercial District and the property has remained vacant.
The Grapevine Plaza Shopping Center to the east was rezoned from "C-2" Community
Business District to "CN" Neighborhood Commercial District during the 1984 City Rezoning.
It was later rezoned (Z85-10) to "SP" Site Plan District to allow the development of a
shopping center with a grocery store with off -premise alcohol beverage sales. At the April
15, 2003 meeting, Council approved a conditional use permit (CU03-10) for a planned
commercial center for a future retail/office complex. At the August 15, 2006 meeting a
conditional use permit (CU06-31) was approved on the subject site to allow the
development of a medical office building. A zone change request (Z06-12) and a planned
development overlay (PD06-08) was approved by council at their October 17, 2006
meeting rezoning the property immediately to the north of the subject site which was part
of the original planned commercial center, from "CC" Community Commercial District to
"R-TH' Townhouse District with a planned development overlay to allow for reduced
setbacks, and private streets.

This letter is to verify that your request for a conditional use permit to amend the previously

On April 17, 2007, the Planning and Zoning Commission recommended the City Council approve

Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.

On behalf of our client, Homeyer Engineering, Inc. is pleased to make this Conditional Use
Permit submittal for the Animal Emergency Hospital of North Texas. The proposed building
consists of 12,772 square feet of office and associated veterinarian facilities. The proposed
use of a veterinary hospital in and of itself does not require a conditional use permit.
However, due to the emergency medical services that this facility will provide, there will be
the need to treat small animals for a day or two, thus creating an overnight stay. It is the
overnight stay that creates the need for the proposed conditional use permit.
Due to the building being located adjacent to State Highway 121, the proposed building is
located more than 150 feet away from any existing residential structure and is separated by
the existing access easement that serves the entire Westgate Plaza development. In
addition, the proposed facility does not include any external kennels. As a result, there will
not be any noticeable barking to disturb the adjacent properties.
Based upon the attached architectural renderings, the proposed building exterior will be
comprised of brick and stone with some EIFS for accent areas. The proposed building will
be an attractive addition to the City of Grapevine and the surrounding area. We look

Dear Grapevine City Council, Planning and Zoning members, and City Staff:
Thank you for giving us the opportunity to address some of the concerns which were
expressed at the March 21, 2007 City Council/P&Z meeting. First, our apologies for not
having an owner represented at this last meeting. After consultation with our engineer
and contractor, and having had no negative, comments from the city staff, we incorrectly
assumed that there would be no problems which our engineer could not answer. At the
upcoming meeting, several owners will be present, including most of the owners of
existing veterinary clinics in the City of Grapevine.
We are a group of twenty-six, veterinarians who own existing veterinary practices in and
around the City of Grapevine. We currently own the Animal Emergency Hospital of
North Texas (AEHNT) located in the City of Southlake. Our current Southlake facility
also houses the Dallas Veterinary Surgical Center (DVSC), a veterinary surgical referral
practice and the Veterinary Internal Medicine Center (VIMC), a veterinary internal
medicine referral practice. What we are proposing to build in Grapevine will house the
AEHNT, DVSC, VIMC and two other veterinary referral practices- the Animal
Ophthalmology Clinic and the Animal Dermatology Referral Clinic.
As you can see, our new facility will house several different practices; collectively we are
a veterinary.referral center. This is different from a regular veterinary clinic in several
important ways. First, our clients and patients come to us by referral from surrounding
veterinary clinics. For instance, Drs. Epperson and Steinle at the Northwest Veterinary
Clinic in Grapevine send their, emergency patients to the Animal Emergency Hospital of
North Texas (AEHNT). Dr. Ford at the Grapevine Veterinary Clinic may send a patient
which needs back surgery to the Dallas Veterinary Surgical Center (DVSC). Secondly,
We do not provide ancillary services such as; grooming, boarding, or sale of pet supplies.
Our patients stay at our facility only until such time as the service for which they were
referred (emergency, surgery, etc) has beencompleted. The patient at that point is sent
back to its referring veterinarian. To repeat and emphasize a point- we -do not board pets
and we will not in the future. All of the patients we see are non-farm animals. None of us
practice on horses, cows, goats, pigs, etc and we will not have any facilities or equipment
needed to see them.
It Js our understanding that there were concerns expressed about our dumpster, trash
generated, and odor control. Weare professionals and take seriously the image we project

not only to our clients, but to our neighborhood. We do not, have not and will not tolerate
offensive odors or an unappealing grounds and landscape. Our biohazards (needles,
scalpels, etc) are placed in special containers and, removed from our building by a
specialized company, regulated by state and federal law, and disposed of in a safe ,and
legal manner outside the City of Grapevine. All other waste is in sealed plastic bags and
I laced in a dumpster which is emptied several times a week. In addition, our deceased
,pets are treated with the same amount of respect as our well pets. We use a privately
owned and operated pet cemetery located outside of the Grapevine city limits. They
provide us with a cold storage unit which is housed inside of our facility and conduct
biweekly pickup and disposal of the deceased pets. I would invite you to visit our current
facility in Southlake to see how seriously we take these matters.
We hope to become a positive and responsible addition to the City of Grapevine. and look
forward to addressing any, other concerns you may have.

I am writing you as a citizen of the City of Southlake and a client of the Animal Emergency
Hospital of North Texas which currently has its business in Southlake, Texas. My wife and I have
been long time clients of the Animal Emergency Hospital of North Texas. Not only does the
Hospital do a first class job of taking care of our pets but they also maintain a first class facility with
