114 L AND NORTHWEST HIGHWAY IN THE CITY OF
GRAPEVINE, TEXAS AS SURPLUS; AUTHORIZING THE
CITY MANAGER TO EXECUTE A SPECIAL WARRANTY
DEED FOR THE CONVEYANCE OF SAID PROPERTY
PURSUANT TO SECTION 272.001(B) OF THE LOCAL
GOVERNMENT CODE; PROVIDING A SAVINGS CLAUSE;

EFFECTIVE DATE
WHEREAS, the City of Grapevine is the owner of an easement for highway
purposes, as described in the document recorded in Volume 3467, Page 409, Deed
Records of Tarrant County, Texas (hereinafter referred to as the "Easement", and being
shown and described in the attached Exhibit "A", which exhibit is incorporated herein by
reference); and
WHEREAS, the City of Grapevine previously dedicated the Easement for use by the
� � Texas Department of Transportation; and
WHEREAS, the Texas Department of Transportation has executed a Partial
Release of Easement instrument for the Easement, thereby releasing any interest or rights
in the Easement; and
WHEREAS, the City of Grapevine is the successor in title to a certain portion of
roadway shown and described in the attached Exhibit "B", which exhibit is incorporated
herein by reference (hereinafter referred to as the "Street"); and
WHEREAS, the Texas Department of Transportation has issued Minute Order No.

WHEREAS, the property owner of the tract in the southwest quadrant of the
intersection of BS 114 L and Northwest Highway has requested that the Easement and
Street be abandoned, vacated, and conveyed pursuant to Section 272.001(b) of the Local
Government Code; and
WHEREAS, the Easement and Street are hereby declared surplus as they are not
� needed for public use and will not be needed in ±he future for public use; and
s WHEREAS, the Easement and Street constitute a narrow strip of land that because
of their shape and small area cannot be used independently under the current zoning,
�,, � subdivision, or other regulations; and
WHEREAS, abandoning, vacating, and conveying the Easement and Street will
relieve the City of Grapevine, Texas from the cost and expense of maintaining said
property; and
WHEREAS, the passage of this ordinance is deemed to be in the best interest of
the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated here in above are true and correct and are
hereby incorporated into the body of this ordinance by reference as if copied in their
entirety.
Section 2. That the City Manager is hereby authorized to execute any documents
necessary to abandon, vacate, or convey the Easement and Street to the adjacent property
owner pursuant to Section 272.001(b) of the Local Government Code, including but not
limited to a Special Warranty Deed.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
�`�" severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such access easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.
